IMPROVEMERF RESOLUTION NO. 133
RESOLVED, by The Board of Public Works of the City of South Bend,Indian.a:
That it is deemed and. desired necessary to construct a Trunk` Sewer on Sample Street
which from its size and eharact e r, i s not only intended and adept ed for the use of
the abutting property holders,but is hlso intended and adapted to receive the seer::
age from collateral drains already constructed or which may be hereafter constructd
as follows, to, -wit:- Beginning at the intersection of Olive Street and Stimple
Street; 1`a2 ,a�,st along the center line of Sample Street to the center of Lincoln
Street: .encOstill East along the Center of said Sample to the center of
Kusciuzko Street mth a 20 inch pipe; thence still East along the center of said
Sample Street to the center of union Street with a 19 inch ;pipe; thence -still
East along the center of said Sample Street to the center of Webster Street with a,
15 'inch pipe, together with the house connections to the curb line along the line
of said improvement, and said sewer with its appurtenances, shall be constructed
in accordance with prof'iles,details, drawings and specifications on rile in the
office _of the Department of Board of Public Works of said City. The cost of said
sewer shall be divided. as follows: 1. So much of such cost as shall be equivalent
to the construction of an adequate local sewer not adapted to receive the sewerage
from collateral drains or sewer,if built along the property holders and by the
City of South Bend, Indina,if it is determined that the City is benefited by said
sewer,in the manner and to the scare extent 'as a local sewer are paid for by them,
under the statue in such cases made and provided. 2. The escess cost, over and
above what would be equivalent to the cost of a local sewer, if built along the
line,shall be assessed against each piece of property in the district or area to be
drained, and against the City, if it is determined that the City is benefited by the
said sewer, according to the manner and method prescribed by law; all of which
described property beneficially affected lies within the follov.ng described terri-
tory in the City of South Bend,County of St. Joseph and State of Indiana,tp-Vtt:
Beginning at the intersection of the center line of Olive Street and the center
line of the right -of way of the Grand Truhk Western Railway; thence northeasterly
following the center line of the right-of-way of tr}e Grand Trunk Western to the
center line of the first alleY West of Harris Street; thence south along the cen-
ter line of the first alley west of Harris Street to the center of the first alley
'>outh of F+brd Street;thence East along the center 'line of t&. first alley south of
Ford Street to the First Alley East of Union Street;thence South along the center
line of the first alley East of Union Street to the first alley North of Sample
Street;thence East along the center line of the first alley North of Sample Street
to the center of Webster Street;thence South along the center of Webster Street to
a point 660 feet south of the south line of Sample Street;thence West parallel with
and 660 feet south of the south line of said Sample Street to the center of Olive
Street; thence North along the center lime of said Olive Street to the center line
of the ri pht -o f-way of the Grand Trunk Western Railway Comp any, whi ch point is the
place of beginning.
Each piece of property in said district or area above descrbed,including the abut-
ting property holders and the City of South Bend,Indiana,if the said City is bene-
f'ited,shall be assessed,as beforesaid,to pay t.ne cost over and above what would
be equivklentto the cost of a local sewer;all of which will more fully appear by
reference to profiles, details, drawiings,and specifications on file in the office
of the Department of the Board. of Public 1$1orks of said City; and such improvement
is now ordered.

TRUNK SEWER, under. IMPROVEMENT RESOLUTION No. 133,and shall be constructed accrod-
ing to the plans and specifications prepared by the City Civil Engineer,filed here--
with.
Notice of this resolution shall be published on the 9th, day of March
and on the 16th. day of March 1912 in,the South Bend Daily Times.

Public Improvements and on said day at 7:45 P.M. said Board will at its said .o-ffi ce
hear and consider any remonstrators and person interested or whose property is
affected by said public improvement nd will decide whether the benefits that will
accrue to the property, abutting and adjacent to the proposed improvements and to
said city will be equal to,or exceed the estimated cost of the proposed improvement
as estimated bynthe City Civil Engineer. A Bond or Bonds to be issued to the
Contractor in payment of such work where the property owner signs waiver required,,
as according to law. Mich said bonds shall bear interest at the rate of six per
cent per annum,payable as provided by law.

The City Attorney appeared before the Board regarding the Welsbach.Street Lighting
Contract, The Board empowered the Attorney to take w:riatever legal steps n*c-
essary to properly place the matter before the City Common Council. The City
v' The City Attorney made oral report on his progress in obtaining options on ease—
ments on land laying along the purposed route of the Bowman Creek Sewer.
Permission was granted by the Board to ,the Central Union Telephone Company of
this City to replace their present 50f't. pole at the southeast corner of Portage
Avenue and Navarre St. , with a new 50 f't . pole.

Heal ing given on pavement and walk and curb on North Lafayette Street from Navarre Street
,to Foote Street under Improvement Resolution No. 132.
In theabove matter No remonstrators appeared and no rerronstrance's were filed. The Board
therefore finds in each and e very case of said improvements that the benefits to the
property and to the City of South Bend., are equal to the estimated cost of said improve-
ments, and the r"Lne are hereby in all things ratified, confirmed and approved.
Resolved, that notices be pbbli shed on the 13th. day of March,,1912 and on the 20th. of
March 1912, in the South Bend Daily Times. stating that the Board will receive bids
for the: construction of the aforesaid improvement Up to 10:00 A.M. on the 10th. day of
