RESOLUTION NO. 276
RESOLUTION RELATING TO ACQUISITION OF PROPERTY
BY CONDEMNATION, IND. R -57, LASALLE PARK
W EREAS, it is necessary by the Board of Commissioners of the Depart-
ment o Redevelopment of the City of South Bend, Indiana, to acquire the
follow'ng real estate in the urban renewal area known as Ind. R -57 - LaSalle
Park P oject, in the City of South Bend, Indiana:
W EREAS, the Department of Redevelopment of the City of South Bend,
Indiana, has made an effort to purchase the above- described property from
the ow ers, but the Department and said owners have been unable to agree
as to the purchase price, or the preliminary title examination has the
proper y to be owned by the county auditor, or greatly encumbered.
B17 IT RESOLVED, that the Executive Director cause a notice and final
offer n writing to be made to each of the above owners at the respective
concur d -in price, which final offer shall include an invitation to discuss
the ac uisition of owner's property with the Department of Redevelopment
within ten (10) days from mailing and a notification that Eminent Domain
procee ings will be instituted immediately after said ten (10) day period
if agr ement cannot be reached on the purchase price within said ten (10)
days.
B IT FURTHER RESOLVED, by the Commissioners of the Department of
Redeve opment of the City of South Bend, Indiana, that in the event an
agreem nt cannot be reached on the purchase of the property within ten (10)
days a ter notice of final offer, then the Commissioners do hereby deter-
mine t at they shall proceed to acquire the above- described parcels of real
estate under the power of Eminent Domain as described by the laws of the
State f Indiana in order to carry out the redevelopment plan, and their
attorn y, Bruce C. Hammerschmidt, is directed to file a complaint after
said t n (10) day period in the name of the City of South Bend, Indiana,
on beh if of the Department of Redevelopment in the appropriate Court of
St. Jo eph County, Indiana, in order that an appraiser be appointed to
establ sh the value of said real estate.

held oo October 17, 1969, in the Office of the Commission, 120 West LaSalle
Avenue Suite 1001, South Bend, Indiana.
