Home My WebLink AboutNo. 0257 authorizing the president to rescind an option agreement and sign and accept a new option agrement in its place for Parcel No. 38-15 in LaSalle Park Urban Renewal Project INDIANA R-57RESOLUTION NO. 257 RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION AUTHORIZING THE PRESIDENT TO RESCIND AN OPTION AGREEMENT AND SIGN AND ACCEPT A NEW OPTION AGREEMENT IN ITS PLACE FOR PARCEL NO. 38 -15, IN THE LASALLE PARK URBAN RENEWAL PROJECT, INDIANA R -57 WHEREAS, Mr. Luke Jones, Jr. signed an Option Agreement with the South Bend Re evelopment Commission on March 3, 1969, for Parcel No. 38 -15, in the LaSalle Park Urban Renewal Project, Ind. R -57, located at 313 Iowa Street, which was accepted by the Redevelopment Commission at its regular meeting of March 7, 1969 and signed by its President, Donald A. Wiggins, on that date; and WHEREAS, said Option Agreement contained an error in the legal description of the property to be purchased under said Option Agreement; and WHEREAS, Mr. Luke Jones, Jr. has agreed to cancel said Option Agreement by reason that it does contain a faulty legal description of the property to be purchased, and has signed an Option Agreement which contains the correct legal description for the property to be covered by the Option Agreement. NOW, THEREFORE, BE IT RESOLVED, that the South Bend Redevelopment Com- mission hereby authorizes and directs that the Option Agreement signed by the owner on March 3, 1969 and by the Redevelopment Commission on March 7, 1969, is hereby cancelled and rescinded in its entirety and further authorizes the acceptance of the Option Agreement signed by the owner on March 18, 1969 con- taining the correct legal description and hereby authorizes and directs the President to sign and execute the said Option Agreement. Adopted at the regular meeting of the South Bend Redevelopment Commission held on March 21, 1969, at the office of the Commission, 120 West LaSalle Avenue, Suite 1001, South Bend, Indiana.
