Board met in regular session at 10 A.M. Mr. NI.edbalski absent.
✓Street Commissioner reported on the following defective walks South west corner of
Emeriek Street and Madison street; 915 West Perkins street:North East corner of
Fellow and Bronson street.
The foregoing walks ordered replaced under Improvement Resolution No. 54.and the
Clerk ordered to notify property holders of same.
✓ Street Commissioner reports the following wCk6ks in a dirty condition Lt the Nobth
West corner of Niles Avenue and Howard Street also Lot 19 of Stanfields & Fosters Ado
on Howard Street.
The foregoing walks ordered cleaned and the expense charged to the Property owners

Bond a:idContract given by the Indiana & Michigan Electric Compan.y.as principals,
and the Maryland Casualty company as surity,approved by the Board.
Resolved.by the Board of Public Work-, of the City of South Bend.Indiana.That
permission be hereby granted to the Indiana & Michigan Electric Co. to construct an
intake and discharge pipe line in Colfax Avenue from the east Bank of the St,Joseph
river to said Company's power house,whieh is located at the north east corner of
Bridge street and Colfax aveme.said permission s,-Lall be subject to the following
conditions;
The loeation of said intake and discharge pipes shall be along lines to be
established by the City Civil Engineer. The Indiana & jaichigan Electric Co. small att
their expense construct a new c&ncrete wing wall and protect the abuttment at the
South east corner of the Colfax Avenue Bridge. The aforesaid company shall construct
a ten inch Vitrified pipe sewer from the St,Joseph river to tj-;e west line of lot 6.
in MackAs Sub -Division for Viie benefit of the City and abutting property owners.
The line and grade to be given by the City Engineer. The afoersaid company shall
relay in a satisfactory manner IL11 pavements, cement sidewalks and curbing taken up
and shall file a Bond in the sum of $1,000.00 Food for a period of one year from the
completion of said work.to guarantee the repaving and repairing of any defective work
which may develop Mithin sueh specified time. All of the above work shall be done
at the risk of the said Indiana & Michi-;an electric Co. and they shall assume the
responsibility and risk of damages to the work or to t.;-.e property on said line of
work which s.all result from floods.backwater,caving of the street.settling of
foundation of bridge or other causes whatsoever connect6d-with the construction of sa
said work. The Board of Publie Works reserves the right to &point an Inspector.)who
shall be on the work during the construction of the wing wall and t.'Lie relaying of the
pavement )sirlewalk and curbing to see that said walk is constructed in a propermanner
The aforesaid Company shall pay to the City of South Bend.the sum of $3.00 per day
for each day said Inspectoe is required. Said inspector shall be under the direetiona
of the City Engineer,,wtlo shall have power to stop the work if Fame is not being
properly done.or if t.rje material being lised is not of aproved quality or for any
other good and sufficient cause. The time of completion of said work shall be 60 days
from the date of the starting.The time of completion is an essential element and the
sum of 050.00 per day s-.-Iall be paid the City of South Bend.for every day over the 60
days that the street is closed to traffie,which supris agreed is the liquidat6dr,
damages w ich the said City will sustain each day by reason of such delay. All work
of replacing the pavementwalkscurbing and construction of wing wall shall be under
the supervision of the City Engineer acting under the direction of the Board of Publd!
Works,and all work shall be according to the plans and specifications on file in the
office of said Engineer.. The I-ndiana & Michigan Electric company shall pay any and
all'judgments.)anOT other liabilites which may be rendered against or suffered by said
Cityand shall save the City �iarmless from every cause whatsoeverwhich may come
against or upon it by reason of the proposed work of said company hereby permitted
whether done or caused to be done by said company's a--ents.officers.Sub-Contractors
or employeesor any work connected with or relating thereto and said company s'all,
file a satisfactory bond to trie sum of 910,,000.00 conditioned for the faithful
preformance of its said work and the saving of said (1iyt harmless from every kind

equal to the estimated cost of said improvements andthe same are i,ereby in all things
ratified,confirmed and approved.
