HomeMy WebLinkAboutNo. 0236 authorizing acceptance of bis of Warren Outlaw for land in LaSalle Park Project IND R-57RESOLUTION NO. 236 RESOLUTION AUTHORIZING THE ACCEPTANCE OF BID OF WARREN OUTLAW FOR LAND IN THE LASALLE PARK PROJECT, IND. R-57 WHEREAS, the South Bend Redevelopment Commission accepted bids by public offering on April 11, 1968, for sale of land within the LaSalle Park Project and that Place and Company, Incorporated, 1920 Ridge ale Road, South Bend, Indiana, bid for Parcel #18-10 was accep ed as being the highest acceptable bid; and WHEREAS, the South Bend Redevelopment Commission has received a petition in writing from Place and Company, dated September 20, 1968, requesting that their bid for the above named parcel of land be withdrawn and that they be relieved of all responsibility for the development thereof; and HEREAS, the South Bend Redevelopment Commission received at the afore aid mentioned public offering the bid of Warren Outlaw for Dispo ition Parcel #17-19 in the amount of $898.00; and WHEREAS, Mr. Warren Outlaw upon commencing construction upon said of made an excavation for the basement of a residential structure and found unsuitable soil conditions and thereupon petitioned the South Bend edevelopment Commission for relief from the purchase of Parcel #17-19 as being an unbuildable site, and further requests a refund of the pqrchase price on Parcel #17-19 and that he be permitted to pur- chaselDisposition Parcel #18-10; and HEREAS, the South Bend Redevelopment Commission after having made oil tests and analyses thereof now determines that Disposition Parce #17-19 is in its present condition an unbuildable residential site ; and NOW, THEREFORE BE IT RESOLVED THAT, the South Bend Redevelopment Commission approves the withdrawel of the bid of Place and Company for Parcel #18-10 and hereby further relieves Place and Company of all resporisibility from the purchase and development of said parcel under the Urban Renewal Plan; and author #17-1� yeas oz a s imi Warren E IT FURTHER RESOLVED THAT, the South Bend Redevelopment Commission izes and directs that the purchase price for Disposition Parcel be refunded to Warren Outlaw in the amount of $898.00 for the said parcel in its present condition is unbuildable, subject to ltaneous reconveyance of said parcel by Quit-Claim Deed from Outlaw and his wife to the Department of Redevelopment. BE IT FURTHER RESOLVED THAT, the South Bend Redevelopment Commission hereby authorizes reimbursement to Warren outlaw for his out-of-pocket expenses expended on said unbuildable parcel in the sum of $115.00, subject, however, to the approval and concurrence of the Department of Housing and Urban Development for such reimbursement. hereJE IT FURTHER RESOLVED THAT, the South Bend Redevelopment Commission accepts the bid of Warren Outlaw as follows: PARCEL No. Bidder Square Footage Price L8-10 Warren outlaw 10,315 $803.00 which is equal to the offered price for said parcel.
