Committee Chair Dr. Oliver Davis called to order the Zoning and Annexation Committee meeting
at 4:33 p.m. He introduced members of the Committee and proceeded to give the floor to the
presenters.
Update: Zoning Ordinance
Tim Corcoran, Director of Planning for the Department of Community Investment with offices
located on the 14th floor of the County-City Building, stated, I wanted to introduce the new Zoning
Administrator,Angela Smith,who you all might remember from the County. We can get into more
of the details, but we have the special meeting set up tomorrow. We are happy to see you guys
there, if possible.
Bill No. 10-19- Rezoning: Land West and Adjacent to 6100 Nimtz Parkway
Jordan Wyatt, Planner for the Department of Infrastructure, Planning and Growth with offices
located on the 11th floor of the County-City Building, stated, The petitioner is requesting a rezone
and a special exception use for the area outlined in red(referencing a slide in a presentation which
is available in the City Clerk's Office). To the north are offices and vacant lands zoned 0, Office
District. To the east and south is Blackthorn Golf Course. To the west across the St.Joseph Valley

Parkway is vacant land zoned LI, Light Industrial District. On site, currently, is a portion of
Blackthorn Golf Course. The site plan shows a mix of Single-Family and Two (2)-Family
dwellings in addition to a private drive. Future development will need to meet the development
standards of the SF-Two (2), Single-Family and Two (2)-Family District. Both the rezoning and
the special exception use come to you with a favorable recommendation from the Area Plan
Commission. I would be happy to answer any questions.
Councilmember Tim Scott stated, Blackthorn and the whole industrial area has been underutilized
for many years. Anything we can bring to the tax roll, I think it is time to adapt and improvise
from the original plan.
Committeemember Jo M. Broden stated, With regard to this site, engineering or whatever, sewer
and water, is it there or not?
Brian McMorrow, Abonmarche Consulting with offices located at 750 Lincolnway East, replied,
Yeah, it is. There is public water and sewer. There are no changes planned and there is plenty of
capacity in that line.
Committeemember Broden followed up, Perfect. And my other question was relative to the
underutilization of Blackthorn. I believe the Blackthorn Office Park, can DCI get back to us on
that? I believe there was a two (2) year plan associated with that. I would like a status update on
that.
Councilmember Scott stated, I know before they came here, everything is approved with Fire and
Police. I don't know if anyone has had any more discussion but there is probably a proposed new
fire station going out there. I think that might be coming up in our budget. This and Portage Prairie
has really grown.
Mr. McMorrow stated, I'm here on behalf of the petitioner, Acquisition Group LLC. Acquisition
Group is the group that purchased the Blackthorn Golf Course from the City a number of years
ago. The intent here is to build a very special neighborhood that appeals to folks who may actually
be near an airport with golf course views. Also, it may be attractive to those wanting to invest in
Blackthorn Office Park. I know Notre Dame is trying to attract alums from both coasts to come
back home and invest in the community and this may be a great win-win to provide a housing
opportunity for folks like that as well as a business opportunity near-by. We think that these stay-
and-play type residences. I did hand out to Area Plan,and I'm willing to share with this Committee,
some pictures (which are available in the City Clerk's Office) of what these homes might look
like. We will come back to you as we refine these plans. Again,there would be thirty(30)to thirty-
six (36) simple lots created on what is now the practice hole.
Councilmember Regina Williams-Preston arrived at the meeting at 4:40 p.m.
Committee Chair Dr. Davis then opened the floor to members of the public wishing to speak in
favor of or in opposition to the legislation. There were none. He then turned the floor back to the
Committee for further comment or main motion.

Committeemember Broden made a motion to send Bill No. 10-19 to the full Council with a
favorable recommendation. Committeemember Gavin Ferlic seconded the motion which carried
by a voice vote of three(3) ayes.
Bill No. 11-19- Rezoning: 121 E. Tutt Street (Weather Amnesty)
Mr. Wyatt stated, The petitioner is requesting to rezone the property outlined in red(referencing a
slide in a presentation which is available in the City Clerk's Office) on your screen from MU,
Mixed-Use District to LI, Light Industrial District. To the north and east are vacant parcels zoned
LI, Light Industrial District. To the south, across Tutt Street is a manufacturing business zoned LI,
Light Industrial District. To the west is a temple of businesses zoned MU, Mixed-Use District and
GB, General Business District. On site currently is a warehouse and parking lot. The site plan
shows the existing structures and the parking lots remain with the addition of proper landscaping.
Future development will need to meet the development standards of the LI, Light Industrial
District. This property was rezoned last fall for the Weather Amnesty Center and this petition is to
return it to its original zoning. This comes to you with a favorable recommendation from the Area
Plan Commission. I would be happy to answer your questions.
Councilmember Broden stated, I would like to thank Pam Meyer, the DCI staff and the Legal
Department in terms of drafting up the document. And the City Administration's leadership in the
Mayor's Office to meet this need of our community. Also,thank you to Mr. Matthews for stepping
up and being a partner on this at a very critical time.
Mr. Corcoran stated, So, as you know, this was part of an agreement made late last year for the
warming center. As part of that agreement,the City committed to petitioning for the rezoning back
to Light Industrial and that is what this is all about right now. Pam Meyer has been working
diligently on this project and she was unable to be here today so I'm filing in.
Councilmember Broden stated,There was a past update from Ms. Meyer in terms of this. In terms
of the record, it was two (2) weeks ago. Thank you.
Committee Chair Dr. Davis then opened the floor to members of the public wishing to speak in
favor of or in opposition to the legislation.
David Matthews, 401 East Colfax Avenue, stated, I'm in favor of it and I'm glad to be of service.
Committeemember Ferlic made a motion to send Bill No. 11-19 to the full Council with a favorable
recommendation. Committeemember Broden seconded the motion which carried by a voice vote
of three (3) ayes.
With no further business, Committee Chair Dr. Davis adjourned the Zoning and Annexation
Committee meeting at 4:45 p.m.
