Board met in regular sessipn at 10:00 A.M.
all menbers present.
Bids were opened on the following streets end' referred to the engineer for
tablulation .
�Erldy Street Sidewalk Improvement Resolution No. 53

/Resolved by the Board of Public Works in the City of South Bend, Indiana that
',in the case of sidewalks on St. Peter Street from South bend Avenue to Corby
Street Improvement Res'.olution No. 53. that all bids received b±n,this'mdtter
be , and the samre declared noll and void
Resolved by the Board of -Public Works in the -City of South benCl that frdm
and after the fifteenth (15th( day of March 1911 the letting out of ;;::the city's
general contract work to private individuals for construction after the date of
the first publication for bids have been duly advertised shall be discontinnued
fromaf kdsaid date, and no permit shall be issued to contractors fer construction
of game.

IMPROVEMENT RESOLUTION NO. 59.
✓ Resolved by the Board of Public Works of the City of South Bend Indiana.
That it is desired and deemed necessary, to make the following des cr_ibed public
improvements in the City as authorized by the following numbered Improvement
Resolution, adopted by said Board on the 10 th.-day of March 1911.
Resolved that an improvement be made of the kind, size, location
and terminal points as follows: Beginning at the center of La Salle Avenue and
St. Peter Street, thence north along the center line of said St. Peter Street to
a point: 100 feet South of the South line of Madison Street with a 12"vetrified pipr
pipe sezlv-r, together with the house connection to the curb line. Also beginning
at the center of Madison Street and St. Peter Street thence North along the
center line of said St. Peter Street to a point 140 feet south of the south
line of Cedar Street with a 12" viterfied sewer pipe, toget':per with the house
connections to the curb line along the line of said improvement
Detail drawings, plans, profiles and specificat ons are can file and
may be seen at the office of said Board and all work in the making of said
public improvement must be done in accordance therewith.
Said improvements shad be known and designated as ST. PETER
STREET PIPE SEWER. Notice of thin resolution shall be published on thel8th.
day of March and on to 25th. day of March 1911 in the South Bend Daily Times.
Said board has fixed the 7th. day of April 1911 a4 a rate upon which remon—
strances may be filed or heard by persons interested or affected by said public
improvements and on st,id day at 7:15 P.M. said Board will at its said office
hear and consider any remonstrrter and person'interested or whose property in
affected by said public improvement nd will decide whether the benefits that
will accrue to the property, abutting and adjacent to the proposed improvement
and to said City, will be equal to or exceed the estimated cost of thep opsedt-,,
improvementp, as estimated by the City Civil Engineer." A bend or bonds to
be ,issued to the Contractor in payment of such work where the property owner
signs waiver required, o.s according to lax, which said bonds shall bear interest
at the rate of six per cent per annum, payable as provided by law.

r That it is desired and deemed necessary, to make the following described public improve-
ments in the said City as authorized by the foilowing nunbered Improvement Resolution,
adopted by said Board on the loth. day of March 1911.
Resolved that an improvement be made of. the kind, size, location and
terminal.points as follows: Beginning at the center of Leland Avenue and Angella
Avenue, thence westerly along the center line of said Angella Avenue .to the center .of
Woodward. Avenue with a 201' vitrified pipe sewer; thRnee",northerly along the center line
of said Woodward Avenue and Blaine Avenue to the center of McCartney Street with a 20"
vitrified sewer pipe; thence west along the center of said McCartney Street to the center,
of Porttage Avenue with an 19" vitrified sewer pipe; thence northerly along the center
line of said Portage Avenue to South 1%£, line of Section 35 T.3F R. 2 east with a 15"
vitrified Aewer pipe. Also beginning at the center of McCartney Street and Portage
Avenue thence ,southerly along the center line of said Portage Avenue to h point 25 feet north
of the Northerly line of the Chicago, Indiana rand Soivahhern Railroads Company's right-of-
way jNith a 12" vitrified se-yer pipe. Together with the house connections to the curb
line _along the line of said improvement.
Detail drawings, plans, profiles and specifications are on file and may
be seen at -the office of said Board and all work _in the rmakin,q of said public improvement
.ri:tst be done in accordance therewith.
Said improvements slIall be known and designated as ANGELLA AVENUE,
McCARTNEY STREET AND PORTA:=,E AVENUE SEWER SYSTFX. Notice of this resolution shall be
published on the l9th. day of March and on the 25th. day of March 1911 in the South Bend
Deily Timers. Said Board has fixed the 7th. day of April 191.1 as a date upon which
remonstrances may be filed or J:h.eard by persons interAst.ed or affected by n€-40. public
improvements and on said day at 7:15 P.M. said Board will at its r€cid. office hear and
consider €any remonstrators and person interested or whose property is affected by said
public improvement and will decide whether the benefits that will accrue to tale property
abutting.and adjacent to the proposed improvements and to said City, will be equal to or
exceed the estimated cost of the proposed improvements, as estimated by the City Civil
Engineer. A boiid or bonds to be issued to the Contractor in payment of ,such work
where the property owner signs waiver required, as according to law. which said bonds
shall beer interest at the rate of six per cent per ennui, payable as provided. by law.
The City Engineer ,submitted the lust of property owners in the matter
of the Appropriation of certa.n property under condemnation resolution Nurber 91 which
list includes the names of the owners and. holders of property and of interests therein
sought to be taken or benefieialQ or injuriously effected, n.nd the description of the
several pieces of property t+vhich is affected by the said appropriation proceedings.
• Thereupen the Board proceededto award the damag s sustained and to
e,^sess the benefits accruing to each piece of property upon said lis .
It was thereupon, upon motion duly made and seconded and unanimously
adopted; rerolved that Said lis t, togiLther with the amounts of benefits ^,nd damages
acid net benefits and net damages therein set forth as to the several parcels of lend
be adopted and ordered spread upon this record by reference, and that the respective
amount of benefits contained in said list be and are hereby assessed against the
several tracts of land as specifically set Forth in said list, and that the respective
amounts 'of damages contained in t_ne said list be and are hereby awarded to the several
tracts of land as specifically set forth in said list, and that tile net benefits or
net damages, as the case may be as to the respective tracts, of land contained in, said
list are 'hereby awarded or assessed, as the case may be as to the said several tracts of
land. The Board hereby further sets off t e benefits: and damages each
against the other where both benefits and damages are as^es;sed against the sAfne apiece
of property, tract of land or interest, and hereby fixes 'said respective net benefits as
the amount that shall be paid by the respective owners as benefits, and further hereby fixe
the respective .n6t damages as to the several tracts as the amount that shall be paid to
the owners of the respective tracts as damages.
Thereupon, upon motion duly made and. ,seconded a7,d unanimously
adopted, the tenth clay of November was fixed as the day on which this Board will receive
or heir remonstrances from persons with regard to the amount of their respective awards
or assessments, and the clerk of this Board was instructed to prepare and cause to be
duly and legally given, notices to the owners of each parcel of property, showing the
amount of the assessment or ward, with a descri tiat} of the rop�erty ' ;ected ., rind the

on the 2.9th. day of April 1911 for the purpose of hearing any remonstrances which you
