Gentlemen:
In reply to your requ est for an opinion upon the annexed petition, I be
to advise that I have examined the law with respect to vacation proceedings and whfie
I am ndt informed as to the exact question on which you want an opinion, I can say
nnerally that the Board of Works has power to order the vacation of a street or part
hereof as provided by Clause 5,Section 8696 Barns Rev. St. If the Board desires to
vacate this strap it will be necessary to pass a preliminary resolution giving notice
of the same by publication fixing & time for hearing on remonstrances and at fuch hearing
-take final action confirming , modifying or rescinding such resolutions, 'Thereafter,
the Statute provides for the necessary steps as shown by the sections of the St4tu to
following Section 8696.
All of the proceedings relating to vacation of streets appear in Thornton's
Law of Cities and Towns Sections 97 to 104 inclusive., Since this vacation seems to be
for•the benefit of the property ovmers on the South side.of La Monte Terrace, I think
it *oa ld be entirely proper for the Board to require them to pay the costs of sUch
proceedings if the Board so desires.

I have been asked for an opinion as to the necessity of publish ng notices fo;
bidding for street lighting,°referring parttdularly to the contract of the Welsbach Street,
Lighting Company for lights in River Park Clause 9, of Section 8696 Barns Rev. St.
provides as follows:
" The Department of Public Works at least twelve months before the
expiration of any Such contract or contracts which are or may hereafter be in force
shall be published once each week for two successive weeks in a newspaper of general
cireu lation in such City, give notice that it will receive bids for such supplies" .
I can not find that this requirement of the law has ever been changed excep-
that this notice will now be required to.be published in two newspapers of opposite
Political faith.

before°the Board in regard to complaint about defective gas lights -in River Park,
and explained to the Board about gas lights freezing up in.winter and mthervvise did not
see that lights were de.fp,ctive.

City of South Bend, Indiana.
Gentlemen: -
The River Park Civic Association representing all the people of River
Park, respectfully submit the following grievances to our' present Gas Lighting
System.
Evidently the C,as Control in Raver Park is not adequate enough to supply
the street lights and residence and domestic use, we do not realize more than 50%
of the candle power installed and the same is tsu a in the domestic use. The trapping
of the pipes, freezing and other defects, give us less than 50% efficiency of lights -
Installed. Many more lights are absolutely needed which can not be provided, because
no gas mains reach certain'dist..ricts, and the lights are very poor at the best.
We emphatically`requ est the annulment of said Contract with the Welsbach
Lighting Company of America, and ask that you give us Electric Lights' in their
stead. We understand an underground Electric Light System can be installed at
30% less cost, and 40% more efficiency at the same amount in total, that the City
is now paying.

Attorney R. Obenchain representing the New'Jersey Indiana and Illinois
Railway Company with Mr. T. D. Hines President of the New Jersey, Indiana & Illinois
Railway Company appeared before the Board and Riled amended blue print and petition.
The Board advised Attorney Obenchain that if the New Jersey, Indiana &.Illinois
Ry. Company would give a strip of ground 14 foot wide from present East and west
Alley to Fisher Street along Lot 5820 that the Board wouhdconsider biasing
the alley requested to be closed in petition. Attorney Obenchain advised the Board
that this matter would be takme up and reported on at a later date.

Resglved,by the Board of Public Works of the City of South Bend,
Indiana, that:
Whereas, on the 30th. day of November, 1921, Samuel M. Robinson
and others, filed in
the office of the Auditor of St. Joseph ,Countyw in the State of
Indietna. `their petition for the improvement of a certain highway, under an Act of
the General Assembly
of the State of Indiana, commonly known as the County Unit Road
Act", the beginning,
course and termination of which proposed improvement is as
follows:
Commencing at a,point on the Division Road where the
Portage Road.intersects it at the center of Section 8,
in Township 37 North, range 2 East, in said County of
St. Joseph; thence running east along said Division
Road on the east and west half section lines of Sections '
8.9 and 10, of said township and range, to the center of
said section number 109 where it intersects Olive Street,
in the City of South Bend, in said County and State; being
two miles in length, and which inter.sectton with Olive
Street is its eastern terminus.
And Whereas, said petition was afterward duly referred to the
County surveyor of said county, and said Board of Commissioners and County Surveyor have
duly filed their determination and report thereon, with complete plans, speefications
and an accurate profile of the said highway to be improved by said Proceedings:
And whereas, a pert of said 41ghway proposed to be improved is
within the corporate limits of the said City of South Bend, which said part is a
portion of West Division Street in said City;
Therefore Be It Resolved by the Board of Public Work% of�the
City of South,Bend, Indiana that this Board does hereby consent to and approve thesaid
proposed improvement of said street and highway, and of said portion of sa d West
Division Street in said'City of South Bend, by the Board of Commissioner of St. Joseph
County State of Indiana, under said petition, as set forth and described in said
proceeainggsp and according to the said plans, specifications and profile now on file
in the office of the Auditor of said County; the ggrade within the City is- to conform
to the established grade of said Division Street 3n said City.
On motion, the foregoing resolution was duly made, passed and
d-dopted, this 28th. day Hof Feb.• 1922.

Mrs. Lamport and airs. De Lorenzi of the Visiting Nurses Association
met with the Board and and requested that the Board give the•Visiting Nurses Association
the privelege of using; all of the house; owned by the City north of the City Hall and
in which they now have two rooms. The Board took this matter under advisement for
an answer later. °
Tiir. Dale -(Plumber appeared before the Board and requested -permission
to tap into sewer,on Keller street and Stocker Place. Board advised Mr. Dile to
submit his request in writing and permission would be granted,
Property owners appeared in re ard*to petition for street light
at Francis Street and Wayne Street. The petition filed last year was referred.to the
Bole and Wire inspector for a report ,
Board instructed Clerk to notify RepresentAtive of the Postal Telegraph
Company to appear before the Board in regard to matt+Qrs ,pertaining to their
Company in this.City. -
Communication received from National Serum Company in regard to Garbage
Same read and placed on file.
Communication received from R.,T. Smith in regard to Garbage. Read and
placed on file.
Petition received read and placed on file for sewer on 11th. Street
from Mishawaka Avenue to St. .Joseph River.
City Engineer filed partial estimate No. 1. for the plipe sewer Improve-
ment on Corby Street from Eddy Street to East line of the third plat of Park.
