1. Contractor has not, nor has any other member, representative, or agent of the firm,
company, corporation or partnership represented by him, entered into any combination,
collusion or agreement with any person relative to the price to be bid by anyone at such
letting nor to prevent any person from bidding nor to induce anyone to refrain from
bidding, and that this bid is made without reference to any other bid and without any
agreement, understanding or combination with any other person in reference to such
bidding. Contractor further says that no person or persons, firms, or corporation has, have
or will receive directly or indirectly, any rebate, fee, gift, commission or thing of value
on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any

ineligible, or voluntarily excluded from participation in this transaction by any Federal

3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.

a. For purposes of this Certification, "Iran" means the government of Iran and any
agency or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5,
as amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor
retain any employee or contract with a person that the Contractor subsequently learns is
an unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work
eligibility status of all of Contractor's newly hired employees through the E-Verify
Program as defined by I.C. 22-5-1.7-3. Contractor's documentation of enrollment and
participation in the E-Verify Program is included and attached as part of this bid/quote;
and
5. Contractor shall require his/her/its subcontractors performing work under this
public contract to certify that the subcontractors do not knowingly employ or contract
with an unauthorized alien, nor retain any employee or contract with a person that the
subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has
enrolled in and is participating in the E-Verify Program. The Contractor agrees to
maintain this certification throughout the term of the contract with the City of South
Bend, and understands that the City may terminate the contract for default if the
Contractor fails to cure a breach of this provision no later than thirty (30) days after being
notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a
contract by the City of South Bend through its agencies, boards, or commissions shall not
discriminate against any employee or applicant for employment in the performance of a
City contract with respect to hire, tenure, terms, conditions, or privileges of employment,
or any matter directly or indirectly related to employment because of race, sex, religion,
color, national origin, ancestry, age, gender expression, gender identity, sexual
orientation or disability that does not affect that person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment,
materials, or any combination of the foregoing including, but not limited to, public works
contracts awarded under public bidding laws or other contracts in which public bids are
not required by law, the City, its agencies, boards, or commissions may consider the
Contractor's good faith efforts to obtain participation by those Contractors certified by
the State of Indiana as a Minority Business ("MBE") or as a Women's Business
Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive
bidder.
In no event shall persons or entities seeking the award of a City contract be required to
award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate
against said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE
Utilization Board shall prohibit that person or entity from being awarded a City contract
for a period of one (1) year from the date of such determination, and such determination
may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination
commitment shall be made a part of any contract which it may henceforth enter into with
the City of South Bend, Indiana or any of its agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for
employment in the performance of this contract with privileges of employment, or any
matter directly or indirectly related to employment, because of race, religion, color, sex,
gender expression, gender identity, sexual orientation, handicap, national origin or
ancestry. Breach of this provision may be regarded as material breach of contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my
statutory obligations to the use of steel products or foundry products made in the United
States (I.C. 5-16-8-1). I hereby certify that I and all subcontractors employed by me for
this project will use steel products or foundry products made in the United States on this
project if awarded. I understand I have an affirmative duty to notify the City in my bid
that my proposal does not include the use of steel products or foundry products made in
the United States. I understand it is my sole obligation and responsibility to provide a
justification to the City, subject to review and approval, why the cost of United States
made steel or foundry products is unreasonable. Prior to award and upon submission of
bid which does not use steel products or foundry products made in the United States, the
City, through its director of public works, shall make a determination if the price of
United States made steel or foundry is unreasonable. I understand that violations
hereunder may result in forfeiture of contractual payments.

Pursuant to notices given, the undersigned offers bid(s) to the City of South Bend in accordance
with the following attachment(s) which specify the class or item number or description, quantity,
unit, unit price.

It is the intent of these specifications to describe a vehicle or piece of equipment for the City of
South Bend. The unit shall be bid as a fully equipped complete unit as set out in the attached
specifications. No partial or split bids will be accepted. Unit to be bid with and without trade-in
if applicable. Vendor to complete bid proposal contained in this bid specification and attach to
the submitted bid.
These are minimum specifications. Any variation from the specifications must be spelled out on
a separate deviation list in order for the bid to be valid. Any items not listed on the deviation
sheet will be assumed to be part of the unit.
Proprietary products or specific manufacturers may be referenced herein. Such references are
only made to demonstrate minimum scope, quality, and style of the equipment desired.
Equipment that is bid pursuant to these specifications shall be of equal quality and size, or
greater, to those referenced, and are subject to approval by the South Bend Board of Public
Works.
Vendor shall provide all information requested in specifications to qualify for bid. If information
on brochure submitted does not completely cover specifications requested, it shall be typed and
attached to brochure.
If an alternate is included within these specifications, please be advised that, alternate items
placed in the specifications are to determine the best configuration of the item within a budgeted
amount and may be included in the award criteria. If the Board elects to award one or more
alternate(s), the base bid price and the alternate bid price(s) will be totaled and compared for all
bidders offering the final configuration. Award will be made based on the lowest
responsible/responsive bid prices submitted for the base bid with selected alternate(s), if
applicable. Failure to submit a bid on an alternate may result in the entire bid being non-
responsive, depending on the final configuration of the product.

Payment will be processed once the unit is inspected and accepted as to meeting the
specifications by the Division of Central Services. This will include all manuals and warranty
documentation.
Bidder must state as accurately as possible an intended delivery date from the date of the
bid award. Due to the age of the City's existing fleet, it is imperative that the unit's be

Jet Rodder
Specifications: 9 cubic yard minimum capacity centrifugal compressor (fan Yes x❑ No❑
type) vacuum system. Vacuum and flushing system must have
the ability to be varied separately. Fans need to be equipped
with and auto greasing system.
Debris Body: The debris body shall be cylindrical and constructed from a Yes x❑ No❑
minimum '/" high strength, non -corrosive steel with a
minimum yield point of 50,000 PSI and a minimum tensile
strength of 70,000 PSI. Bulk heads to be 3/8" minimum.
Debris storage body shall have a minimum useable capacity of
(9) cubic yards. Manufacturer supplied dimensional drawings
and documentation shall be included with bid. State useable
capacity.
For the safety of the operator, the debris tank shall have two
liquid level indicators that are visible from the operator's
station.
The body shall have a fall -size rear door that is hinged at the
top and equipped with a replaceable neoprene type seal to
prevent leakage. Rear door to be hydraulically operated up to a
minimum 90 degrees and down and shall include a safety prop.
Hydraulic locks to be provided.
The rear door shall be equipped with a body drain hose which
allows operator to drain off excess liquids while retaining
solids.
Debris body shall be dumped by raising the body to a 50-
degree angle utilizing a forward mounted, double acting
hydraulic telescoping hoist minimum. Unit to include safety
prop. A system of high-pressure spray nozzles shall be
installed to completely flush the debris tank, including top,
sides, bottom and rear door.
The debris body shall be fixed on an independent frame,
separate from the chassis frame and mounted via a 3-point
mounting system to allow flexing to occur without causing

frame damage.
The rear tank shall have a minimum 5" diameter liquid drains
with bronze gate valve which may be located on the rear door.
Also, a power pump off system inside debris body shall be
included that has a screen inside the debris body to prevent
debris from lodging in pump causing pump to clog up and not
function correctly. Drain will have a minimum of 15' of lay
flat hose. State height of decant drain opening.
A decant system shall be provided that assures 80% of debris
tank liquids are drained off while on the street.
The rear door shall have a decant screen to aid in the decanting
process.
For the safety of the operator and to eliminate the possibility of
the debris tank encountering tree limbs and electrical power
lines, under no circumstances shall the debris body elevate
during the decant process.
For the safety of the operator and to increase productivity, the
decant process must occur at the operator's station and shall
not require the operator to leave his station to relocate or
reposition the truck.
Debris body shall be supplied with a bolt on spill shield that is
easily removed for cleaning. Shield will be a minimum 12" on
bottom half to keep debris away from the rear of the machine,
including the rear bumper assembly and water tanks. Body to
be painted green to match existing fleet.
A manual tank body prop shall be provided. Installation of
prop shall be accomplished from the side of the chassis. Units
requiring the operator to position themselves under a raised
body will not be accepted.
An automatic stainless -steel ball(s) check valve shall be
installed inside the debris body to prevent over filling. When
the debris tank is full, the device shall automatically stop the
flow of the air to the vacuum system and prevent water and
debris from entering the positive displacement vacuum pump.
The unit must be able to safely dump the complete load of
debris with a full tank of water.
The air drawn from the debris body must pass through a filter

system of adequate size to protect the vacuum system. The
system must be easily cleaned and maintained from the ground
level without putting the operator in harm's way.
The debris tank shall have a minimum of ten-year non -pro-
rated warranty. Warranty must cover materials, workmanship,
and rust through.
Steps to be included on front driver's side of tank for access to
inspection cover.
Water Tanks: Water tanks must have a minimum metered capacity of 1,000 YesEl No❑
gallons.
The fill system shall include an air gap anti -siphon design to
protect the water supply.
Water level gauge/tube shall be located at the operator's station
and fill station.
A 2 1/z" diameter x 25' long hydrant hose, with proper
connections, shall be included. The hose will be connected to
truck by quick connect for easy removal of hose from truck.
A continuous fill system shall be provided so that the unit may
be hooked directly to a hydrant.
The water tank shall come supplied with a "Y" pattern stainless
steel strainer to filter the water before it enters the tank.
The water tank shall carry a lifetime warranty against corrosion
or cracking.
The water supply to the pump shall allow dumping of the
debris tank and operation of the water pump while in the full
dumped position.
Vacuum
System: System shall be a centrifugal compressor fan system. The Yes x❑ No[-]
compressor shall be manufactured out of Corten steel or equal
for operator safety. The centrifugal compressors shall be
capable of air flows from 0 to 8,000 CFM's and pressures from
0 to 200" negative water pressure. The fans will be equipped
with and auto greasing system to prevent fans from being
under greased and/or over greased that will grease fans at the
correct hours of use.

For maximum material separation and to minimize the
possibility of material discharge to the atmosphere, the
compressor shall pull air from two separate ports of the debris
tank.
Compressors shall be able to vacuum wet or dry material
without damaging the vacuum system. Compressors shall also
carry an unconditional five (5) year warranty on the centrifugal
compressor.
The unit shall also have the ability to vacuum and jet rod to
depths of 100 feet. Compressor bearings to have an auto lube
system.
Vacuum
System Pick There shall be a warning light and audible alarm when the hose Yes x❑ No❑
Up Hose: is raised from the travel position.
Rotation, extension, and lift shall be controlled at the
operator's station by means of a "joy -stick" and by a portable
pendant control that can operate all boom functions including
the internal boom valve. Pendent control shall have a quick
disconnect and be able to reach beyond the extended boom in
any direction.
For operator safety, a vacuum shut off switch shall be provided
at the operator station that will instantly cut off vacuum air
flow and reduce engine RPM to idle.
8" pipe extensions to intake tube, two 7' extension tube, one 3'
fluidizer tube, one 3' extension tube, one 6' extension tube,
and two 5' clean a minimum of 40' and tube storage racks to
accommodate all tubes. Storage racks must be accessible from
ground level without raising the debris body, stooping down or
reaching up over the operator's shoulders, who is 5'5" tall.
Tubes to include: one 6' crowned extension tubes. All
necessary clamps plus two additional clamps. All necessary
items such as gaskets, etc. must be included.
The boom shall rotate right and left a minimum of 270 degrees.
Boom shall reach to the side a minimum of 23' from the center
of the truck and raise to a minimum height of 25'.
Boom shall have a minimum 1000-pound lift capacity.
The vacuum system pick up assembly shall be 8" heavy duty
with 8' extendable reach.

A diagram showing both vertical and horizon boom coverage
shall be supplied with the bid.
A boom tie down shall be supplied to keep the boom in a
stationary position while the unit is traveling over the road.
The vacuum intake system shall be 10" from front elbow to
debris body to prevent bricks and debris from getting stuck.
The vacuum intake system shall, by design, deposit solids in
the debris tank to ensure proper weight distribution between
the front and rear axles, for maximum driver control and
safety.
The wireless controller system shall include two controllers
and an in -cab charging system.
The boom shall include a "boom up" safety alarm system that
will sound inside the cab if the boom is not properly stowed
before transport.
High Pressure
Water Pump: The following is a description of the PTO driven high pressure
water pump currently used by the City of South Bend. This
system has proven very effective and does meet all of our
requirements for high pressure line cleaning. Any bidder
wishing to bid an alternatively driven pump may do so with a
detailed explanation of that system and the benefits to be
received by the City of South Bend from the use of such a
system. Such an alternative system may or may not be
acceptable to the City. If belt drive is being bid, a lifetime full
replacement warranty shall be included.
The system shall include a variable flow, heavy duty, high
pressure water pump that delivers a smooth, continuous
pressure and flow through the entire operating range of the
pump. The pump shall be capable of flows from 0-80 GPM and
from 0-2500 PSI.
The water pump shall be sized to allow the water system to
operate with 80 GPM at 2,000 PSI continuous duty rating.
Capable of 1" ID.
The high-pressure water pump will be designed so no damage
will occur if run at normal operating pressure without water for
10 minutes. A certification by the original water pump

The water pump shall be capable of maximum water pressure
and flow while achieving maximum vacuum pressure. The
water pump shall operate independent of vacuum system.

A heat exchanger will be provided in the water system to cool
all hydraulic fluids on the unit, if required.
A monitor light shall be provided to indicate when designed
flow or pressure is exceeded.

The water system shall be designed to enable the operator to
turn water flow on/off at maximum psi and rpm without doing
harm to components.
Cold Weather
Protection: The system shall incorporate both a cold weather recirculation YesEl Non
system and an air purge system.
Low point drains shall be included throughout the water
system for complete cold weather draining.
Rotation Hose
Reel: The hose reel shall come with a mounted digital screen to show Yes x❑ No❑

The hose reel assembly shall be state of the art design.
The hose reel shall be mounted to assure adequate ground
clearance.
The hose reel capacity shall have a minimum 600' capacity of
1" I.D. sewer hose (2500 psi operating pressure; 7500 psi burst
pressure).
A 20' leader hose shall be supplied.
The hose reel shall be on the front of the truck along the center
line axis of the truck with the reel in its fixed position.
The hose reel and control panel shall articulate a minimum of

180 degrees allowing the operator to work in any position
through the arc. Articulation shall be hydraulically powered
and lock into operating position. Articulation hinge shall be
located on the curb side of the truck. A manufacturer's
certified document showing hose reel area coverage shall be
provided with bid packet.
The mounting of the hose reel shall not interfere when the
engine hood has to be opened for service/maintenance. Hose
reels that interfere, must be able to be moved out of the way by
means of an auxiliary power system, in case of
engine/hydraulic problems.
A heavy-duty AUTOMATIC hose level wind guide will assist
the operator in placing the hose evenly on the reel.
The reel shall have a digital footage counter and a backup
manual footage counter.
The hose reel shall be hydraulically powered in both directions.
It must have a full complement of controls for operating the
hydraulic motor incorporating a flow device to regulate the
rotational speed in both directions.
Manufacturer shall supply all additional equipment required to
make the hose wind properly on the reel, including hose
tensioning devises, if required.
Wireless

provided to the City at the time of delivery.
In addition to the warranties required above as part of the bid
price, the bidder is asked to describe any additional warranties
that are provided by the manufacturer on the equipment.
Specifically, the bidder is asked to describe any additional
warranties that might be available for the water pump, the
power train, the fan, and the debris body. If additional
warranties on these and other parts of the equipment can be
provided to the City at an additional cost, bidder should

indicate the terms of these warranties and the cost involved.
The cost of additional warranties should not be included in the
bid price but listed separately as options. We need written
certification of all extended warranties at the time of delivery.
Chassis 12 months/24,000 miles complete. Engine and
transmission as specified. The unit shall be awarded as a
complete unit including all sewer cleaning equipment. The
successful bidder will be responsible for all warranty repairs
and/or the transportation of the unit to and from authorized
warranty repair facility within 8 hours of notification excluding
weekends and holidays. Failure to do so will result in a $200

Bend. The City of South Bend reserves the right to have a

evaluations. The results of these performance evaluations will
determine if the unit bid meets the minimum performance
standards of the City of South Bend. The evaluation results are
the property of the City of South Bend and cannot be used by
anyone other than City employees for evaluation purposes.

each section of the manual, operational controls, safety shut
down, daily and weekly maintenance, and trouble shooting.

reasonable hourly rate for any additional training past that
time. Lodging and meals for the trainer are the responsibility

Inspection and
Delivery: The successful bidder shall arrange a final inspection of the

specifications as written, the City reserves the right not to
accept the unit until all corrections have been made by the
bidder to meet the specifications.
Criteria for
Award: The award of a contract pursuant to this specification, if any be
made, will be made within thirty (30) calendar days after the
opening of the proposals to the lowest responsible and
responsive bidder whose proposal complies with all the
requirements prescribed. Until the final award to the contract,
however, the right is reserved by the City to reject any and all
proposals and to waive technical errors.
Delivery Date

BID FORMS AND EXECUTION
A. Bidders are expected to examine the Drawings, Specifications, Proposal and all Instructions.
Failure to do so will be at the Bidder's risk.
B. Each Bidder shall furnish all information required by the Notice, Instructions to Bidders and
Specifications. Bids must be made on the form provided. The Bidder shall sign the Proposal
and Non -Collusion Affidavit, which is a part of the provided form, where indicated, provide a
notary signature and provide all other information required.
C. The Bidder shall sign the Proposal in the following manner: If the Proposal is made by an
individual, his/her name and post office address must be shown. If made by a partnership or
joint venture, the name and post office address of each member of the partnership or joint
venture must be shown. If made by a corporation, the Proposal must be signed by an officer
of the corporation or by a representative duly authorized by the corporation to execute the
Proposal in its behalf.
2. SEALED BIDS ONLY
A. Bids, Proposals, Guaranty, and other required documents must be submitted in a sealed

ADDENDA — NO VERBAL INTERPRETATIONS
A. No inquiries by Bidders relative to interpretation of Plans, Specifications, Special Provisions,
or other Bidding Documents will be answered verbally. If any prospective Bidder is unable or
unwilling to comply with one or more requirements of the bidding document, such Bidder
should so inform the Board of Public Works in writing. Upon receipt of such information,
consideration will be given to the advisability of issuing an Addendum which would thereupon
become applicable to all Bidders. Any such inquiry must be submitted at least seven (7) days
prior to the bid opening date in order to give the Board sufficient time to consider any
necessary Addendum. All answers to such inquiries, in the form of Addenda, will be furnished
to all prospective Bidders who have registered with the City. All Bidders are required to
acknowledge receipt of any Addenda by inserting the Addendum number and the issuing date
on executed Proposals.
REJECTION OF PROPOSALS CONTAINING ALTERATION ERASURES INCOMPLETE BIDS
AND ETC.
A. Proposals shall be rejected if they show any alteration of form, additions not called for,
conditional or alternate bids (except when and insofar as are invited), incomplete bids,
erasures or irregularities of any kinds.
B. All blank spaces for bid prices must be filled in, in ink, with the unit price and total price for
each item (This does not apply to divisible bids). In case of incorrect totaling of amounts and
where the unit price and the extension thereof do not agree, the unit price for each item shall
govern, and the City is authorized to correct all erroneous extension and totals for the purpose
of comparing bids.
TRADE DISCOUNTS
A. Trade discounts shall not be shown separately, but shall be incorporated in the Bidder's unit
price, unless otherwise specified.

A. Bidders may bid on one (1) or more vehicles, provided however, that the bid submitted for

A. The City of South Bend is exempt from the payment of federal excise and transportation taxes
levied under the provision of the Internal Revenue Code. It is also exempt from the Indiana

State Gross Retail Tax (sales tax). The City will furnish the successful Bidder with any
certificate of exemption required.
10. WITHDRAWAL OF BIDS,
A. Withdrawal of bids will be allowed only in those cases in which a written request to withdraw a
bid is received by the Board of Public Works prior to the date and hour for receiving and
opening bids. In such cases, the same will be returned to Bidder unopened.
11. ESCALATOR OR CONTINGENT CLAUSES
A. The use of escalator clauses or other contingent clauses by the Bidder is prohibited, unless
requested or permitted by the Invitation to Bid. No Proposal shall contain nor be
accompanied by any writing purporting to limit or qualify the City's right to accept such
Proposal or purporting to alter such Proposal or any Contract which may be executed
pursuant thereto.
12. PRICES MUST BE DELIVERED PRICES
A. The bid price shall be a delivered price. All materials shall be shipped F.O.B. destination as
specified in the Invitation to Bid. No fuel surcharges accepted.
13. AWARD — WAIVER OF TECHNICALITIES
A. The Award of Bid, if any award be made, will be made within sixty (60) calendar days after the
opening of Proposals to the lowest responsible and responsive Bidder who's Proposal
complies with all the requirements prescribed, exclusive of technicalities waived. Until the
final award of the Bid, however, the right is reserved by the City to reject any and all
Proposals and to waive technical errors.
14. SPLITTING OF AWARDS/DIVISIBLE BIDS
A. Bids will be awarded on the basis of the total dollar amount for all items in the Proposal unless
the bid is described by the City as a Divisible Bid. The City may award a Divisible Bid to the
lowest responsible and responsive Bidder for each item or class of items as indicated in the
bid documents.
15. BIDDER QUALIFICATION
A. The City may require any Bidder to submit evidence of qualifications, and may consider any
evidence of the financial, technical, and other qualifications and abilities of the Bidder. The
City will not award a Contract to a Bidder who, in its opinion, is not fully qualified on the basis
of financial resources and responsibility, possession of adequate equipment, personnel,
experience, and past record of performance to perform the obligations to be undertaken
competently and without delay.
16. PURCHASE ORDERS
A. A Purchase Order will be issued to the successful Bidder after formal acceptance of the bid is
made by the City.
IT NEW MANUFACTURE
A. Unless otherwise specified in the Invitation to Bid, the items offered shall all be new and the
latest model of manufacture.
I& SOURCE OF SUPPLY
A. If the Bidder is not a manufacturer, the source of supply must be shown and all sub-
contractors must be identified.
19. PACKAGING
A. All items shall be delivered strongly packed and marked according to accepted commercial
practice unless otherwise directed in the Specifications. No charge shall be made for
containers and the City shall have no obligation to return containers unless otherwise
provided by the Specifications or Special Provisions. Any items not received in good
condition will be rejected.
20. INSPECTION OF GOODS
A. The City of South Bend reserves the right to inspect and have any goods tested after delivery
for compliance with the specifications. Notice of latent defects, which would make the item
unfit for the purposes for which they are required, may be given at any time within one year
after discovery of the defects.
B. All items rejected must be removed immediately by the Contractor at the expense of the
Contractor. If the Contractor fails or refuses to remove the rejected items, they may be sold
by the City of South Bend.
C. In some cases, at the discretion of the City, inspection of the commodities or equipment will
be made at the factory, plant, or other establishment where they are produced before
shipment.
D. The above provision shall not be construed in limitations of any rights the City may have
under any laws including the Uniform Commercial Code.
21. ASSIGNMENTS
A. No person to whom a Contract has been awarded may assign his interest in the Contract
without the consent, in writing, of the City.
22. CANCELLATION
A. The City of South Bend reserves the right to cancel any Contract for failure or refusal of
performance, fraud, deceit, misrepresentation, collusion, conspiracy, or any other misconduct
on the part of the Contractor.
23, DEDUCTION OF DAMAGES
A. If the City cancels the contract for any cause, it shall deduct from whatever is owed the
Contractor on the Contract or any other Contract, any amount sufficient to compensate the
City for any damages suffered by it because of the Contractor's wrongdoing.
24. METHOD OF INVOICING FOR PAYMENT
A. Contractor shall bill the City of South Bend
1. On regular invoice form giving a complete and detailed description of the goods delivered,
including purchase order number.
2. If the Contractor allows a discount, the period of time in which the City must make
payment to qualify for the discounts shall be computed from the date the City received the
invoice (completely filled out), or the date the goods are delivered and accepted,
whichever may be later, and shall not be less than twenty (20) days.
3. If more than one shipment is made under the Contract and on the same purchase order,
the City will make partial payments on a basis that is agreeable to both parties.
25. OWNERSHIP OF GOODS
A. The goods which are the subject of the Contract shall remain property of the Contractor until
delivered to and accepted by the City of South Bend.
26. ESTIMATED QUANTITIES
A. If the quantity set forth in the Notice to Bidders and Proposal is approximate and represents
the estimated requirements of the City for a specified period of time, the unit price and the
extended total price thereof shall be used only as a basis for the evaluation of bids. The
actual quantities necessary may be more or less than the estimate, but the City shall neither
be obligated nor limited to any specific amount. The City will, if at all possible, restrict
increases to twenty percent (20%) of the estimated quantity and will, if at all possible, restrict
decreases to twenty percent (20%) of the estimated quantity.
2T TERM "OR EQUAL"
A. Where the term "OR EQUAL" is used in these Specifications, the Bidder deviating from
specified item shall file with his/her bid a letter fully explaining and justifying his/her proposed
article or equal. The City of South Bend shall be the sole judge in determining if the "OR
EQUAL" offered meets the Specifications.

28. INDEMNIFICATION CLAUSE
A. The Contractor agrees to indemnify, defend, and hold harmless the City of South Bend, its
agents, officers, and employees from all costs, losses, claims and suits, including court costs,
attorney fees, and other expenses, arising from or out of the negligent performance of this
Contract by the Bidder or because or arising out of any defect in the goods, materials or
equipment supplied by the Bidder.
NOTE. Incoming mail does not reach the Board of Public Works until after 9:30 a.m. If
you are sending your bid via Federal Express or another overnight source, please
confirm that your package will arrive before the bid opening time and date.

VAC -CON, as seller, warrants all equipment manufactured by it, b e a r i n g i t s n a m e s h a l l
be free from defects in material , and workmanship, under normal use and service as
determined by us, for a period of (12) twelve months from the date of delivery to the first retail purchaser.
Should any equipment or part of such equipment sold hereunder prove to be defective in material or
workmanship within said period, and be returned to Seller's factory no later than 15 days after the
expiration date of the warranty, transportation charges prepaid by the Buyer, and upon examination be
found to be defective, such part will be replaced at the factory by the Seller free of charge, but the
Seller shall be under no further liability in respect to such warranty. It is expressly understood that the
Seller's liability is limited to furnishing of such replacement parts within a reasonable length of time and
that the Seller will not be liable for any dam -ages, losses or expenses arising in connection with the
use of or inability to use the unit(s), including but not limited to, injuries to persons or damage to
property, loss of profits or anticipated profits, or loss of vehicle use. Buyer shall be responsible for the
payment of duties or taxes on warranty parts, if applicable. The Seller shall be under no liability because
of normal wear and tear of operation or maintenance contrary to the manufacturer's official Operator's
Manual. The Buyer accepts any liability for damage or injury resulting from the removal or alteration
of safety guards and safety precautions provided on the unit at the time of delivery. This warranty
shall not apply and VAC -CON shall have no liability under it or otherwise if accident, careless
handling, or improper applications shall have injured the unit or if any repairs have been made to the unit
by other than VAC -CON, its agents or employees.
Warranties covering major components not of VAC -CON manufacture (power plants, hydraulics,
trucks, vacuum compressors, transmissions, electrical components, batteries, tires, etc.) are warranted by
their respective manufacturers.
We give no warranty express or implied, as to description, quality, productiveness or any other
matter and the Buyer hereby waives the right of refusal and return of the goods which is usually
connected with non -warranty.
It is the sole responsibility of the purchaser to use this equipment in an appropriate application and
a safe manner. VAC -CON assumes no responsibility or liability for its misuse.
FIVE (5) YEAR WARRANTY:
VAC -CON warrants that the fans, auxiliary engine water pump drive components (excluding engine
and pump) shall be free from defects in material and workmanship, under normal use and service as
determined by the manufacturer, for a period of sixty (60) months (not pro -rated) from the date the unit is
first placed into service.
TEN (10) YEAR WARRANTY:
VAC -CON warrants that the debris tank shall be free from defects in material and workmanship,
under normal use and service as determined by the manufacturer, for a period of one hundred and
twenty (120) months (not pro -rated) from the date the unit is first placed into service.
LIFETIME WARRANTY:
VAC -CON warrants that the water tanks shall be free from defects in material and workmanship,
under normal use and service as determined by the manufacturer, for the lifetime of the unit, from the date
the unit is first placed into service.
LIFETIME WARRANTY:
VAC -CON warrants the water pump drive belt and hydraulic pump drive belt for the lifetime of the
unit, from the day the unit is first placed into service. This warranty will exclude labor, covering PARTS ONLY.
