55-1 Board met in regular session at 7:15 P.M.All members present. Deferred Hearing given on Condemnation Resolution No. 61 for the Opening of a Highway along the north and south center line of West of Section 15 Twp. 3 North Range 2 East from Sample Street to Ewing Ave me, in the Vity of South Bend, Indiana. In the above matter remonstrhtors appeared but no further written remonstranoes were filed. The Board after hearing all persons interested in said opening and upon request of Attorney Schellingger representing petitioners, deferred II- - this hearing until Wednesday -August 3rd., 192I.at 7:.15"P.M.- Hearin had'on assess oat roll and ,final estimate for Pavement on Ewing,Avenue from Mich1gan Sttieet to iami Street, under Improvement Resolution No. 836 in the.City of South Bend, Indiana* i Inthe 'above matter remonstratvrs appeared but no written remonstrance was filed. No: Eighteen (18) ownship No. T i-seven (37) North of Range Ho Three UT East, thence soun th 28.27 chains; thence north 64 degrees west 4.27 chains; thence North 26.80 chains to the center of a public gighway; thence East 4 chains to the:plaoe of beginning. do hereby remonstrate against the assessment of $5446.97 made against, said land because' of the grading of Oakland Street and constructing curb and walk thereon from Mishawaka Avenue to the north side of a proposed Boulevard along the St. Joseph River ,`for the following reasons: 1st. The said Board has no power to make any assessasdit Whatever against said land or any part thereof for said improvement, since it had no power to make -or let the contract for the making of the same. a 2nd. Deferred hearing had on resolution for pipe sewer on Blaine Avenue and queen Street from McCartney Street to Portage Avenue, under Improvement Resolu- tion No. 887. In the City of South Bend, Indiana. In the above matter a new petition was filed and no further wri- ten remonstrance was°filed and no remonstrators appeared. The Board over -ruled written remonstrance on file and being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same as reported by the City Civil Engineer, and thereupon, takes final action on said reslution as originally adopted and the same is hereby in'. all things, ratified, confirmed and approve*. Resolved further that notices be published on the 22nd. day of'July 1921 and on the 29th. day of July 1921 in the South Bend.News Times, stating that this Board will receive bids for the construction of said improvement up to 10:00 A.M. on the 9th. day of August 1921.a The Board reserves the right to reject any and all bids. r 4 The following property owners appeared about complaints of broken sidewalks caused by the White Construction Company, S. E. corner of Grant and Huron Streets in name of Antony Bu.gucki of 502 Grant Street. Ford and Phillip& northwest corner. -in name of Mike Chrobot of 616 Phillipa Street, At corner -of Phillip& and Ford ,`Northeast corner, in name of Valentine Piatraszawski of 618 So, Phillipa Street.. The Board agreed to take this matterpWith the White Construction Company and Councilman Olejniczak 'Forest -Hillier ; appeared before the Board in; regard .to 'assessment on Lot- �15 Oak Park 4th. Add. for .the, pAvement on Ewin Avenue, said lot in name of St. Joseph Loan and Trust Company, party by name of.Johnson has contract. Stated that assessments against lot now Is over assessed valuation. The Board advised Mr. Hillier they would look this matter up. Matter of defective condition of North Miehi n Street macadam pavement taken up with the -Board at�request of T. W. Slick, tKe-Board advised that Mr. Slick take whatever action is necessary to get the contractor to fix the pavement.
