To the Honobable Board of Public Works,
of the City of South Bend,
In the matter of the Condemnation Resolution Numbered 61.
for the opening of a street from Sample Street South, on the West one -Eighth section
line of Sections 15 and 229 in Township 37 North, Range 2 East, South Bend, Indiana,
to Prairie Avenue.
NDED REMONSTRANCE OF NEW YORK CENTRAL RAILROAD COMPANY.
Now York Central Railroad Company, one of the propert owners whose'
property will be affected by the opening of said proposed street, respectfully remon-
strates against said proposed action, on each of the following grounds:
First: That there is no public'necessity for the opening of said street.
Second: That said proposed street or highway would cross through what is
common ly known as the Oliver Yards of this remonstrant; and will cross five tracks which
this remonstrantnow has constructed and in use as a part of its yards. That in addition'
to crossing said tracks of this remonstrant, slid street or highway will cross yard tracks
of the Grand Trunk Railway.Compagy and one or more tracks'of the New Jersey Indiana -
& Illinois Railway Company. That the said tracks of this remonstrant and said Grand Trunk
Railway Company are all in-opperation in the carriage of freight and passengers in -inter -
and Intro State commerce. That these tracks parallel wach other and lie in -such close
proximity that they preactically form a single railroad yard. That this remonstrant sever
several years -ago purchased additional land in the vicinity of this proposed crossing
and ppreppaared plans for the purpose of enlarging its yards in that ticinit ; by installing
10 additional tracks that it selected this particular vicinity for the enlargement of
its said yard-- which has only been delayed because of the war, and of financial,
conditions reAulting therefrom-- because there were no streets crossing its said tracks
f at the time of the construction of its present yards; and the selection and purchase
of said real estate for the construction of additional trackage; that in making this
selection, and in laying out its said yards, it,did so with regard to the use of Olive,
Street, which will accommodate all traffic in and out of the proposed territory soti ht to.
e'reacheA by said proposed street; and in planning its said yards, this remonstrant
reduced the bumber of its tracks°at Olive Street------ tracks, so that the use of
same would not be rendered impracticable and unsafe by:reason.of eontihuous'switehi
over said street; that, the land of this remonstrant -which is oocupiod Wy said tfias s
