Project R-56WHEREAS, ui to as "Tit' is authori; eiiminatioi the plannii RESOLUTION NO. 201 RESOLUTION OF SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT, APPROVING UNDERTAKING OF SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT AND FILING OF A REVISED APPLICATION, IND. EXP. PROD. R -56 Eder Title I of the Housing Act of 1949, as amended (herein referred e I "), the Secretary of the Department of Housing and Urban Development :ed to extend financial assistance to local public agencies in the i and prevention of the spread of their slums and urban blight through iq and undertaking of urban renewal projects; and WHEREAS Ti le VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and Urban Development effectuating that Title, provide that no person hail, on the ground of race, color, or national origin, be excluded from parti ipation in, be denied the benefits of, or be subjected to discrimination in the and rtaking.and carrying out of urban renewal projects assisted under Title I of the Housing Act of 1949, as amended; and WHEREAS it is desirable and in the public interest that the City of South Bend Department of Redevelopment make surveys and prepare plans, presently estimated to cost approximately Fifty Two Thousand One Hundred Fifty Seven Dollars ($52,157.00), in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of Title -I, in that area proposed as an Urban Renewal Ar a, situated in the City of South Bend, County of St. Joseph, and State of Indiana which is described as follows: The I dustriai Expansion Project, Indiana R -56, is located in the City pf South Bend, County of St. Joseph, State of Indiana, and is described as follows: Begi of C point New J paral dista of Ke Kemb 1 less, right north north of 94 Stree Stree NOW, THERE GOVERNING 1. T ing at the point of intersection of the north right -of -way line ter Street and the east right -of -way line of Kendall Street; south along the east right -of -way line of Kendall Street to a 570 feet, more or less, to the north right -of -way line of the rsey, Indiana and Illinois Railroad; thence west on a line el to the north right -of -way line of the said Railroad for a ce of 1,073 feet, more or less, to the west right -of -way line able Avenue; thence north along the west right -of -way line of Avenue and its extension, for distance of 375 feet, more or to the northwest right -of -way line of Prairie Avenue; thence ast for a distance of 278 feet, more or less, along the northwest of -way line of Prairie Avenue to the point of intersection of the ,est right -of -way line of Prairie Avenue and the extension of the right -of -way line of Cotter Street; thence east for a distance feet, more or less, along the north right -of -way line of Cotter to the intersection of the east right -of -way line of Kendall this point of intersection being the point of beginning. BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT: t the proposed Urban Renewal Area described above is blighted area ropriate for an urban renewal project, that the development of such a for predominantly nonresidential uses is necessary for the proper elopment of the community, and that the undertaking by the City of th Bend, Department of Redevelopment, of surveys and plans for an an renewal project of the character contemplated by Section 110(c) Title I in the proposed Urban Renewal Area is hereby approved. -l- 2. 3. t the financial assistance available under Title I is needed to ble the City of South Bend, Department of Redevelopment to finance planning and undertaking of the proposed Project. T at it is cognizant of the conditions that are imposed in the under - t king and carrying out of urban renewal projects with Federal f nancial assistance under Title I, including those relating to ( ) the relocation of site occupants, (b) the provision of local g ants -in -aid, and (c) the requirement that the locality present to tie Secretary of the Department of Housing and Urban Development, as a prerequisite to approval of the application described below, a w rkable program for community improvement, as set forth in Section Ml(c) of Title I, for utilizing appropriate public and private stsources to eliminate and prevent the development or spread of ums and urban blight. 4. T at the United States of America and the Secretary of the Department o Housing and Urban Development be, and they hereby are, assured of f 11 compliance by the City of South Bend, Department of Redevelopment w th regulations of the Department of Housing and Urban Development e fectuating Title VI of the Civil Rights Act of 1964. 5. Tat it is the sense of this body (a) that a feasible method for the location of individuals and families displaced from the Urban R newal Area, in conformity with the requirements of Title I, can be p pared, and (b) that local grants -in -aid can and will be provided i an amount which will be not less than one -third of the Net Project C st of the Project and which, together with the Federal capital grant, w'll be generally equal to the difference between Gross Project Cost a d the proceeds or value of project land sold, leased, or retained f r use in accordance with the urban renewal plan. 6. Tat the filing of a revised application by the City of South Bend, D partment of Redevelopment for an advance of funds from the United S ates of America in an amount not to exceed Fifty Two Thousand 0 e Hundred Fifty Seven Dollars ($52,157.00) for surveys and plans f r an urban renewal project in the proposed Urban Renewal Area, d scribed above is hereby approved, and that the Executive Director i hereby authorized and directed to execute and file such appli- c tion with the Secretary of the Department of Housing and Urban velopment, to provide such additional information and to furnish s ch documents as may be required by the Secretary, and to act as t e authorized representative of the City of South Bend, Department o Redevelopment.
