In the above matter no remonstrators appeared and no written remonstrance was filed. The Board after due consideration decided to continue said hearing until Wednesday May 4th. 1921 at 7:15 P.M. The Beard therefore being fully advised in the premises, decides that the, benefits to,propert l l-* to be assessed for said improvements are equal to the the, estimated cost of same•, as reported by the city Civil Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby in all, things, ratified, confirmed and approved... Referred hearing had on resolution for Trunk sewer on Indiana Avenue from Olive Street to Prairie Avenue, under Improvement Resolution No,. 853, In.the City of South Bend, Indiana. In the above matterprcperty owners petitioning for said sewer appeared, also Atty. Schellinger representing the Syndicate Company and Wm. B. >Calvert' property owners appeared against the putting in of said sewer. The Board after due consideration ever -ruled written remonstrance filed April 13th. 1and being fully advised in the premises, decides that the benefits to property Lam to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby in all things, ratified, confirmed and approved, Resolved further that notices be published on the 21st. day of April 1921 and on the 28th. day of April 1921 in the South Bend Daily Tribune, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. Councilamn Wiswienski appeared before the Board and requested that a resolution be adopted for grade curb and walk on Huey Street from Kenwood Ave. to Rogers Street. City Engineer investigated and the Board ordered a resolution prepared e Ongineer'filed assessment roll and final estimate for water connections on Ewing Avenue -from Michigan Street to Miami Street, under Improvement Resolution No. In the City of South Bend, Indiana.; to Resolved that notices as the assessments be published on the 22nd. day of April 1921 and on the 2 th. day.of April 1921 in the South Bend Daily Tribune, stating that this Board will give s hearing on the amount of such assessments at its •ffice� in the City Hall on the llth. day of May 1921 at 7:15 P.M. Resolved further, that -the entire work under the above contract be accepted and approved and_.the final estimate thereon allowed. ,Wednesda--A•ril 20th. 1921. Continued. Lake •:Sh@2�rf and11iChiglfl Street, by paving the roadway the same, and i I WHEREAS, the City Civil Engineer has prepared and filed in the office of this Board a report showing the number and . location of the service pipes, mains, conduits, lateral;, and connections which are, or will be necessary to accommceate the abutting property and the owners thereof with gas, .water, sewer; and other conveniences and necessaries: and also' said City Givil Engineer has prepared and filed in said office specifications showing the mater;al to be used. and the maner of laying said service pipes mains, conduits, laterals and connections from the mains to the. points in- side the curb lines. THEREFORE, be it resolved by the Board of Public Wcrkes of the .City of South Bend, Indiana, that the report of the City Civil Engineer. is adopted, and sa`d report and the specifications prepared and filed by him are made a part of this resolution as fully and effectually as if copied herein at full length; and it is fur- ther ordered that all of such private connections with the sewer, gas, and water mains be made in said street by :bringing them inside the curb lines thereof. " And be it further, resolved that notice by publication for two successive days in . South Bend " _ Tribune , a newspaper of general circulation printed and publ'shed in the City of South Bend : Indiana, be given to the owners of the property abutting upon said street to be improved directing them to make such sewer and water connections on or before the 14th. day of - May 1921 o and that if said connections are not made on or before said time and in accordance with the specl- fications. and report on file in the office of the Board . of the Public Works, then said Board will cause the same _ to be made and will asses the cost thereof against the property abutting epcn said street, and shall do all - other things pertaining thereto according to the provisions and requirmenls of Ordinance No. 1842 adopted by the Common Council cf. the City of South Fend on July 24, 1916, and cf all ether ordinances and law ' l` relating thereto. And. be it further resolved' and ordered that after the 20 day period has elapsed for the making cf said connection by the property owners, a notice shall be published for two weeks, once each week, in the South Bend Tribune , a newspaper of general circulation publ'shd in said city, requesting. bids from contraetors for the making of such connections as have not been made by the property owners, and -such notice shall fix a day, not earlier than ten days after the first of such publications, when bids shah be opened and a contract let for the doing of said work. f And be -it further ordered that the Northern Indiana Gas and Electric Company, w hich holds a fran- chise from, and is en»warel by said city, to furnish artificial gas to the citizens thereof, and is j . engaged in said business in ssil city, is- h3re-3y directed to make and install all service connections with its mains in said Street in accordance with the provisions of Ordinance No. 1555 adopted June 27 1910 and such other ordi- t Dances or laws applicable thereto; which connections are .
