Deferred hearing had on resolution for pipe sewer on Emerick Street from Sorin. Street to a point 100 feet northerly from —the center of Hagerty-Street,'under Improvement'Resolution No.. 850. In the City of South Bend, Indiana. In the above matter Attorney Walter Clements appeared before the Board and presented agreements of the Michigan Central Ry. Company, which form was referred to the Michigan Central Railway Company for signatures. The Board deferred all action on said resolution until Wednesday j April 12th., 1921 at 7:15 P.M. I The following petition was filed by property owners on .Division Street and who also a peared personally and objected to %he Geo. Cutter Company fencingup a part of Division Street. The Board referred the following petition to the City Attorney for whatever action necessary. To the Honorable Board of Public Works, cif .the City of South Bend, Indiana. The_undersi�gned, citizens residing in the vicinity of the inter- section of Division St., Bt Peter. Street and Notre Dame Street in the'City of South Bend,. respectfully represent to your Honorable Body that the Geor a Cutter Company has, without autority, fenced upp a part of Di�tision Street lying et ween St. Peter Street and Notre Dame Street, and has, denied the public access to said street. We, therefore, respectfullyy request that you take such action as may be necessary to cause vacation.of that part of the Street so wrongfully closed by the said George Cutter Company. ° C. 0. Hearing had on resolution for Trunk sewer on Indiana Avenue from Olive Street to Prairie Avenue, under improvement Resolution No. 853. In the City of South Bend, Indiana. In` the above matter property owners appeared requesting that said sewer be tut in and Wm. Calvert, Mr. May and 'others property owners appeared and objected o sewer being put in, and objected on a count of large amount of assessment their land would receive. Hearin had on Improvement Resolution No. 854 for the Pavement on Sorin Street from Emerick teet to Nedde Court, under Improvement Resolution Na. 854. In. the City of South Bend, Indiana. In the above matter remonstrators appeared but no written remonstrance was filed. And the Board being fully advised in the premises decides that the benefits t® :property liable to be assessed for said improvements are equal to the estimated cost of the same as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby In all things, ratified, confirmed and approved. Resolved further, that notices be published on the 7th. day of April 1921 and on the 14th. day of April 1921 in the South Bend Daily Tribune a newspaper of general circulation in said City','stat1ft°that°this Board will receive bids for the construction of said improvements up to 16:00 A.M. April 26th., 1921 at TO:00 A.M. The Board reserves the right to reject any and all bids. Hearing given on dondemnation resolution No. 58 for the Widening of of Mishawaka Avenue and Nineteenth Street at Northwest corner of Nineteenth Street, in the City of South Bend, Indiana. In the above matter no remonstrators appeared except Attorney F. Ltl Jellison representing Iva U. Engle and written remonstrance filed. The Board therefore ever -rule all written remonstrances and sustain all former action taken and declare t,r1e above described property in all things condemned and appropriated for public use and this resolution in all things ratified, confirmed and approved The Board further ordered that the City Engineer be instructed to 'prepare a roll of all owners or holders of propperty and of valuable Interests therein soughtto-be taken or to be injuriously affected which list or roll shall hkso describe the roperty beneficall affected and show the awards'of damages and assessments of benems in the above matter. The Board; agreed to pay Iva U. Engle out of the- City .Funds for amount due as set by appraisers; and not assess same to the territory bor* fi- cally affected: . 7 wEdnesday April 6th., 1921.
