Smith Mgr. of the Chicago, South Bend & Northern Indiana Railway Company and G. M. Gray Supt of the Chicago, Lake Shore and South Bend Ry. Company met with the Board and the matter of the conditions of certain cross.in s of their railways in this.City was discussed. `Mr, 8iith. agreed .� y � Gray and �Ir:" - o,coxsult with the Street Commissioner D._C. Layton and h y e was instructed by the Board=to give the.railway company the certain streets with defective crossings, Dr F.- G. Freyemarth appeared before the Board and took up the mstter,of the.City paying,for the waterused at the United States Health Clinic, The'Board agreed to pay for all water used at the Clinic and the Clerk was instructed to notify the Water Dept. to'send bills for water t,o this Department and same is to°be paid out of the water Fund of, the Board of Public Works. - Mr. Taylor of Rarter Heights appeared before the` Board in re and to the condition of.the-pavement in Harter Hei hts regard g .The Board instructed the Clerk to.notifyqthe Williston'Construction Company to make the necessary repairs on pavement,in ffarter Heights under their guarantee bond on.ofile in this,Office. The Board ordered two 100 C. P. lig-.1.ts on Peashway and Leeper v Mauer of condition of sidewalk and curbs on Ford Street, Dunham and Huron Streets filed,by-Councilffian Ole uiezak. the Board ordered J. W.`Doy1e of the White Construction Company to'take this mat er up with Councilman Olejniczak and make the necessary repairs. Board ordered a light placed at southeast corner of Scott Street and Dubmil Avenue, 1 Petition filed and resolution ordered prepared for sewer on Lebans Street frea Indiana Avenue to Broadway, Bid°received for the painting of the flag pale, dorners and all tin on the cupola of City Hall., This referred to the Janitor Chas. Johnson. Mr. ;J. W. Doyle Supt of the White Construction .Company appeared before the Board and took up the mat er of site for asphalt plant on DuShan.e propety on Sample Street and Olive Streets. Deferred action'unti.l Wednesday at 1:30 A.M. March 9th.11921 to make trip of investigation. t The following resolution adopted by the Board. TRUNK SEWER IMPROVEMFNT RESOLUTION NO. 853. Resolved by the Board of Public Works of the City of South Bend,, County of St. Joseph State of Indiana: -That it is desired and deemed xecessar to construct a sewer lu Indiana Avenue all in said City, which, from its size ana character, is not.only intended and adapted for use by property owners whose propertydfabuts tuna along the line of said sewer, but is also intended and adapted o receiving sewage from collateral dra ns a ready constricted or Which may be hereafter constructed and the same is hereby ordered -constructed in an d along the following line in. said City, to -wit:- Beginning at the inter- e.ction o the center line of Olive Street and Indiana Avenue; thence east along the center line of Indiana Avenue to the center of Grant Street with a 30 inch circular sewer; thence still east along the center of Indiana Avenue to.the cent& of Pulaski Street with a 24 inch ipe sewer• thence still east aloe the center of Indiana Avenue to the center of Walnut Street with a 20 inch pip sewer,, thence still east along the center of Indiana Avenue to the center of Webster Street with an 18 inch vitrified pipe sewer -thence still east alongg the center of Indiana A venue to the center of Arnold Street with a 15 inch -vitrified pippe sewer; thence still east along the center of Indiana Avenue to a oint 70 feet west of the westerly line of Prairie Avenue with a 12 inch vitrified pipe sewer; together with the neeessary manholes, storm water inlets, conduitsm flush tanks and house conneetions to the curb line &bong the line of said improvement: And to be built in accordance with the profiles, specifications, detail plans, maps and estimates now ow. file in the office of the De pasrteat of Public Works of said City which includes an estimate of the prapertidn:,that the cost of an.adequate local sewer, built along the above line, bears to the test of the main sewer, to be built as follows: The cost of an adequate local sewer, built along the line of above described, is hereby estimated and fixed to.be of the cost of the maix'sewer to be built along the said line as above set forth,.which proportion, as herein estimated and fixed, shall be taken quid adopted in all computations. requiring.& knowledge of the cost of such local sewer if built,alone the line where the main sewer is to be built. The cost of the construction or said sewer shall be divided as follows: 1. And each piece of,property in said district or area above described includin abutting property holders and the said City of South Bend, if the fisa d City is bene- ,fited , shall be assessed, as aforesaid, to pay said excess of cost overrand above what; would be equivalent to the cost of a local sewer; all of which will more Fully appeare bar reference to the profiles map, drawings and specifications now on file in,t e ffice of the Department of Publ1c Works of said City which, among other things,,gives the exact course of said pproposed main sewer overflows and its appurtenances, and the district or area which may be injuniousl or beneficially affected thereby as -shown by the heavy ' boundary lines marked on map and drawings, with proper words and figures written thereen, eiearly3.ndicating what said heavy boundary lines represent, and the district or area embraced thereby. Assessments it defearedI are to be paid in ten equal annual install- ments with interest at the rate of six per cent per annum. A bond or bonds shall be issued to the contractor in payment for said work., unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall the City.of. South Bend be or be held responsible for any sum or sums due from said property owner or Owners for said work, Ior for the collection of the ame, or for the .payment of any bond, bonds, certificate or certificates issued to said contractor in payment for such work except for. such moneys as shall have been actually received by said City from the assess-. meats for such -improvements. All proeeedtngs had and work done in the construction of said main sewer and its appurtenances,.manner of assessment of property collection of ,assessments and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly df - the State of Indiana, entitled " An Act Concerning Municipal Corporations, in matters perta. pertaining to the constitution alteration and maintenance of public drains and sewers, pro- viding for the construction, alteration and maintenance of such sewers and drains in such cities and within four miles thereof, also providing for the assessment of property speciall; benefittdd thereby for the payment thereof, in whole or in part, and for the collection, of such assessments, repealing all laws and parts of laws in conflict therewith, and declaring an emergency, approved March 6,1905 and all acts supplementary and amendatory thereto, passed by the General Assembly of the State.of Indiana. 2U0 Tuesday March 8th., 1921. cantina Notice of this resolution shall be published on the 10th. day of March 1921 and on .the lath. day of March 1921 in the South Bend Daily Tribune.
