Board met in reggular session at 7:15 P.M. G A. Elliott absent.

Deferred hearing had ON assessment roll and final estimate for
Grade, curb and walk on, Chapin Street from Indiana Avenue to Oliver Street,
under Improvomenta;Resolution No. 745..
On a -:count of report of the City En ixeer on condition of street,
the Board ordered that the hearin on this roll be old u u.nt11 May-4th..1991
at-7:15 P.M. at which time contractor will have had time to remedylairteets.
Derred he ing had on asse sment roll and final estimate for
Grade, curb and warton Cat pa Avenue from Indiana Avenue to Oliver Street,
under Improvement Resolution No, 746, In the City Of South,Bendch Indiana.
- I the above matter no remonstrators appeared and�no written
remonstrance was iled, the Board therefore find that the property assessed in said
roll filed _December 21st., 1921 is beaefitted in the amount of assessments as
shown on,said rolls, and the Board further find that'the assessment roll filed
December 21st., 1921 and the final estimate allowed December 21st.9192I should be
and the same are hereb in all things, ratified confirmed and approve
The Board ordered.the L ty Controll"dr notified to withhold the sum -of 1150.00
from monies due Contractor until such time defective walk and curb are replaced.
Deferred hearing had on assessment roll and final estimate for
pipe sewer on Stanfield Street from Howard Street to Corby Street, under Improvemet
resolution No. 806. IN the City,of South Bend, Indiana.,
In the above matter no further remonstrance was made, and the
Board therefore find that the property assessed in said roll filed December 21st.
1921 is benefitted in the amount of assessments as shown on said -roll,, and the
Board further find that the assessment roll filed December 21st., 1921 and' -the
final estimate Allowed December 21st., 1921 dhould be and the same are hereby in al
all things ratified confirmed and approved. °
Deferred hearing had on assessment roll and final estimate for
Grade, curb and walk on Main Street from Ewing Avenue to South line of Woodside
Street, under Improvement Resolution No. 440. In the City of South Bend, Indiana.
In the above matter no further remonstrance was filed and the
Board therefore find that the propety assessed in assessment roll filed December
21st.9 1920 is benefitted in the amount of assessments as shown on said roll, J
and the Mal further find th4t the assessment ro1L filed December 21st., 19 0
and the na estimate allowed December ?dlst , 1920 s]4ould be and the same are
hereby in all things, ratified, confirme and approve
Deferred hearing had on assessment roll and final estimate for
Trunk sewer on Divisiom St eet ?rom Meade Street to Chicago Street, under Improve-
ment Resolution No, fn the City of South Bend, Indiana.
The Board deferred all action, on said assessment roll until
Wednesday Debruary 2nd., 1921 at 7:15 P.M.

Matter of opening of Council Room for City Court Purposes discussed
and H. F.-Rostiser stated, that after holding a conference with the Mayor, and he
said he would leave this matter to the Board after lookin over the condition of
the City court room. The Board instructed the Clerk of the Board to notify
`Johnson not to Opel up the Council room for court purposes, and that they would
prohibit the use of .the Council room for same, and that the order of -Tuesday A. M,
stood, and that if he Johnson would open spid Couacilroom, he would be fired
(this last remark made by John F. De Haven);

The Pittsburg, Cixcinnati, Chicago & St. Louis Railroad Company, formerly

1st That the_cdst of widening said Ewin Avenue will exceed the benefits
to be derived therefrom;
2ad. The widening of said Ewing Avenue will interfere with the tracks aid
side. tracks and switch tr ckp of this xemonstra t in that the points of the switch of
what is commonl��rr called t o Mary Ann track or this remonstrant north of the present
Ewin Avenue wi11 be thrown ,into s id Ewing Avenue if widened as contemplated and rewqire
the om lete alteration., change and ag of the 'tracks' of this remonstrant in its
South Bend Yards, at an expense oi'' 25 060 �0, and will reader said tracks and yards

in f he sum of $25,000.00.

result in the curtailment of the-shippiag facilities of said International India, Rubber
Corporation by depriving it if the service of a partpof its present track facility,
4th. That there is no n cessity of public need for the widening of Ewing
Avenue
5th. That the lands of this remonstrant are assessed no damages whilelands.
East of this remonstrant owned by the International India Rubber Corporation, are awarded
1440.58 damages, and lands of the International India: Rubber Corporation West of this
k emonmraut are awarded 442 95 damn es; the land of Mabel Lee Matthews is awarded
