Same_ referred -to City Engines The following resolution approved by the Board and copy of same filed in the CityControllers office. WHEREAS. the C ity of South Bend, Ind iena, by and through its Board of Public Warks, heretofore, by improvement resolution No. 752 caused South Michigan Street, from Ewing Avenue. to a point forty feet (401) north of Fairview Street, now in the City of South Bend, Indiana, to be improved by paving the same] and, WHEREAS, the Chicago, South Bend & Northern Indiana Railway Company Occupies & portion of said street for the operation of its electric railway, and by the terms and conditions of its franchise is required to pave a portion of said street; and, WHEREA89 the portion of said street required to be paved by said Railway Company was paved by the White construction Co., as contractor for such work, and same was completed by it as such contractor bald accepted by the ' City of South Bend, Indiana, on Nov eleber 17,1920; and, WHEREAS, the said Railway Company on the 22nd. day of November 1920, 'executed and filed with the said City of South Bend, Indiana, its sttpulatIon and -agreement waiving objections on ace unt of any illegality or irregularity in 'the proceddinga had for such improvement of said street and requested the City to issue bonds .to pro-oure funds ig1th which to pay that portion of the cost of said improvement chargeable against said Railway Company in the manner provided by an Act entitled " An Act Concerning Municipal Corporations, "approved March 6,1905; and all amendatory and supplemental acts thereto; and, f WHEREAS, it appears that the amount Chargeable to andpayable by said Railway Company by reason of said improvement amounts to the total sum of Five thousand three hundred ninety three and 73/100 5 ( ,393.73) Dollars, with interest from the 27th. day of November 1920 to the 1st. day of June 1921.
