RESOLUTION RELATING TO ACQUISITION OF PROPERTY
BY CONDEMNATION IND. R -57, LASALLE PARK

the Department of Redevelopment of the City of South Bend,
has made an effort to purchase the above described property
e owners, but the Department and said owners have been unable
e as to the purchase price, or the preliminary title examination
an the property to be owned by the county auditor, or greatly
red, or showing defects in title.
BE IT ESOLVED, that the Executive Director cause a notice and final
offer 'n writing to be made to each of the above owners at the
respec ive concurred -in price, which final offer shall include an
invita ion to discuss the acquisition of owner's property with the
Depart ent of Redevelopment within 10 days from mailing and a
notifi ation that Eminent Domain proceedings will be instituted
immedi tely after said 10 day period if agreement cannot be reached
on the purchase price within said 10 days.
BE IT FURTHER RESOLVED by the Commissioners of the Department of
Redeve opment of the City of South Bend, Indiana, that in the event
an agreement cannot be reached on the purchase of the property within
10 days after notice of final offer, then the Commissioners do hereby
determ'ne that they shall proceed to acquire the above described parcels
of rea estate under the power of Eminent Domain as described by the
laws o the State of Indiana in order to carry out the redevelopment
plan, and their attorney, Bruce C. Hammerschmidt, is directed to file
a comp aint after said 10 day period in the name of the City of South
Bend, ndiana on.behalf of the Department of Redevelopment in the
approp iate Court of St. Joseph County, Indiana in order that an appraiser
be app inted to establish the value of said real estate.
