RESOLUTION RELATING TO ACQUISITION OF PROPERTY
BY CONDEMNATION IND. R -57, LASALLE PARK
it is necessary by the Board of Commissioners of the
!nt of Redevelopment of the City of South Bend, Indiana

the Department of Redevelopment of the City of South Bend,
has made an effort to purchase the above described property
owners, but the Department and said owners have been unable
as to the purchase price, or the preliminary title examination
n the property to be owned by the county auditor, or greatly

SOLVED, that the Executive Director cause a notice and final
writing to be made to each of the above owners at the
ve concurred -in price, which final offer shall include an

!nt of Redevelopment within 10 days from mailing and a
,tion that Eminent Domain proceedings will be instituted
;ely after said 10 day period if agreement cannot be reached

BE IT FURTHER RESOLVED by the Commissioners of the Department of
Redevelopment of the City of South Bend, Indiana, that in the event
an agreement cannot be reached on the purchase of the property
within 10 days after notice of final offer, then the Commissioners
do hereby determine that they shall proceed to acquire the above
descri ed parcels of real estate under the power of Eminent Domain
as des ribed by the laws of the State of Indiana in order to carry
out t redevelopment plan, and their attorney, Bruce C. Hammerschmidt,
h is di cted to file a complaint after said 10 day period in the
name o the City of> South Bend, Indiana on behalf of the Department
of Red. velopment in the appropriate Court of St. Joseph County,
Indian in order that an appraiser be appointed to establish the
value f said real estate.
