RESOLUTION NO. 174
RESOLUTION OF THE CITY OF SOUTH BEND DEPARTMENT .
OF REDEVELOPMENT APPROVING THE UNDERTAKING OF
SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT
AND FILING OF AN APPLICATION
5, under Title I of the Housing Act of 1949, as amended (herein referred
le I "), the Secretary of the Department of Housing and Urban Develop -

WHEREAS Title VI of the Civil Rights Act of 1964, and the regulations of the De-
partment of Housing and Urban Development effectuating that Title, provide that
no person shall, on the ground of race, color, or national origin, be excluded
from participation in, be denied the benefits of, or be subjected to discrimination
in the un ertaking and carrying out of urban renewal projects assisted under Title
I of the H using Act of 1949, as amended; and
WHEREA3 it is desirable and in the public interest that the City of South Bend
Department of Redevelopment make surveys and prepare plans, presently esti-
mated to cost approximately Two Hundred and Seventy -Four Thousand, Three
Hundred and Fifty -Eight Dollars ($274,358) in order to undertake and carry out an
urban re ewal project of the character contemplated by Section 110(c) of Title I,
in that ar a proposed as an Urban Renewal Area, situated in the City of South
Bend, Co my of St. Joseph, and State of Indiana, which is described as follows:
Beginning at a point formed by the intersection of the north right -of -way
line of LaSalle Avenue and the west, right -of -way line of Main Street;
thence south along the west right -of -way line of Main Street to the north
rig t -of -way line of Washington Street; thence west along the north right -
of- ay line of Washington Street to the west right -of -way line of LaFayette
Boulevard; thence south along,tftg west right -of -way line of LaFayette
Boulevard to the south right -of -way line of Jefferson Boulevard; thence
east along the south right -of -way line of Jefferson Boulevard to the .west
right-of -way line of Main,Street; thence south along the west right -of -way
line of Main Street to the south right -of -way line of Monroe Street; thence
east along the south right -of -way line of Monroe Street to the west right -
of- ay line of Fellows Street; thence south along the west right -of -way
line of Fellows Street to the south right -of -way line of Monroe Street;
thence east along the south right -of -way line of Monroe Street and pro -
cee ing in a northeasterly direction along said right -of -way line to the
cen er of the St. Joseph River; thence proceeding in a northwesterly
dir ction along the center of the St. Joseph River to the north right -of -way
lin of LaSalle Avenue; thence west along the north right -of -way line of
La Ile Avenue to the west right -of -way line of Main Street which is the
poi t of beginning.

NOW, T EREFORE, BE IT RESOLVED BY THE REDEVELOPMENT COMMIS-
SION OF THE CITY OF SOUTH BEND:
1. That the proposed Urban Renewal Area described above is a slum, blighted,
deteriorated or deteriorating area appropriate for an urban renewal project and
that the undertaking by the City of South Bend, Department of Redevelopment of
surveys and plans for an urban renewal project of the character contemplated by
Section 1 0(c) of Title I in the proposed Urban Renewal Area is hereby approved.
2. That the financial assistance available under Title I is needed to enable the
City of South Bend, Department of Redevelopment to finance the planning and
undertaking of the proposed Project.
3. That it is cognizant of the conditions that are imposed in the undertaking and
carrying out of urban renewal projects with Federal financial assistance under
Title I, including those relating to (a) the relocation of site occupants, (b) the
provision, of local grants -in- aid,,, and (c) the requirement that the locality present
to the Secretary of the Department of Housing and Urban Development, as a pre-
requisite to approval. of the application described below, a workable program for
communi y improvement, as set forth in Section 101(c) of Title I, for utilizing
appropri to public and private resources to eliminate and prevent the development
'or sprea of slums and urban blight.
4. That the United States of America and the Secretary of the Department of
Housing and Urban. Development be, and they hereby are, assured of full com-
pliance b the City of South Bend Department of Redevelopment with regulations
of the De artment of Housing and Urban Development effectuating Title VI of
the Civil Rivhts Act of 1964. '
5. That it is the sense of this body (a) that a feasible method for the relocation
of individuals and families displaced from the Urban Renewal Area, in conformity
with the requirements of Title I, can be prepared, and (b) that local grants -in -aid
can and will be provided in an amount which will be not less than one -third of
the Net I roject Cost of the Project and which, together with the Federal Capital
Grant, w ll be generally equal to the difference between Gross Project Cost and
the prOCE eds or value of project land sold, leased, or retained for use in accord-
ance with the Urban Renewal Plan.
6. Th t the filing of an application bythe City of South Bend, Department of
Redevelo 3ment, for an advance of funds from the United States of America in an
amount n t to exceed Two Hundred Seventy Four Thousand, Three Hundred and
Fifty -Ei ht Dollars ($274, 358) for surveys and plans for an urban renewal project
in the pr posed Urban Renewal Area described above is hereby approved, and that
the Executive Director is hereby authorized and directed to execute and file such
application with the Secretary of the Department of Housing and Urban Development
to provide such additional information and to furnish such documents as may be required
by the Secretary and to act as the authorized representative of the City of South Bend,
Departm nt of Redevelopment.

1. That he is the duly qualified and acting Secretary of the City of South Bend
Department of Redevelopment herein called the "Applicant ", and the keeper of its
records; including the journal of proceedings of the Redevelopment Commission
herein cealled the "Governing Body ".
2. That the attached resolution is a true and correct copy of the resolution as
finally adopted at a meeting of the Governing Body held on the #.it day of ,
1967, and duly recorded in his office;
3. Th t said meeting was duly convened and held in all respects in accordance
with law and to the extent required by law due and proper notice of such meeting
was give ; that a legal quorum was present throughout the meeting, and a legally
sufficien number of members of the Governing Body voted in the proper manner
and for t e adoption of said resolution; and all other requirements and proceedings
under law incident to the proper adoption or passage of .said resolution, have been
duly fulfilled, carried out, and otherwise observed;
4. That if an impression of the seal has been affixed below, it constitutes the
official seal of the Applicant and this certificate is hereby executed under such
official seal. If no seal has been affixed below, the Applicant does not have and
is not legally required to have an official seal;
5. That the undersigned is duly authorized to execute this certificate.
