R -57, LASALLE PARR WHEREAS, it is necessary by the Board of Commissioners of the Department of Redevelopment of the City of South Bend, Indiana to acquire the following real estate in the urban renewal area known as Ind. R -57 - LaSalle Park Project Area in the City of South Bend, Indiana: trcel Number Owner Concurred -In Acquisition Price 8 -3 John McCoy $ 6065 8-9 Church of Kingdom of Christ 2510 9 -6 Walter Phillips 3265 10 -15 Walter Phillips 3700 17 -1 Wiley Hoover 335 17 -4 Robert Kimble 5500 17 -5 William Miflin 495 17 -6 Wiley Hoover 13175 17 -7 Robert Kimble 1040 30-12 Hattie Myers 4335 39 -15 Samuel M. Penegar 1070 41 -17 Albert Johnson 5605 43 -9 Anderson Jones 2545 43 -10 Arthur Jones 5000 43 -11 Anderson Jones 485 WHERK%S, the Department of Redevelopment of the City of South Bend, Indiana has made an effort to purchase the above described property from the owners, but the Department and said owners have been unable to agree as to the purchase price. BE IT RESOLVED, that the Executive Director cause a notice and final offer in writing to be made to each of the above owners at the respective concurred -in price, which final offer shall include an invitation to discuss the acquisition of owner's property with the Department of Redevelopment within 10 days from maili g and a notification that Eminent. Domain proceedings will be insti uted immediately after said 10 day period if agreement cannot be reach d on the purchase price within said 10 days. BE IT FURTHER RESOLVED by the Commissioners of the Department of Redev lopment of the City of South Bend, Indiana, that in the event an ag eement cannot be reached on the purchase of the property within 10 da s after notice of final offer, then the Commissioners do hereby determine that they shall proceed to acquire the above decribed parcels of re #1 estate under the power of Eminent Domain as described by the laws of the State of Indiana in order to carry out the redevelopment plan, and their attorney, Bruce C. Hammerschmidt, is directed to file a comp aint after said 10 day period in the name of the City of South Bend, Indiana on behalf of the Department of Redevelopment in the appropriate Court of St. Joseph County, Indiana in order that an app aiser be appointed to establish the value of said real estate. 1 ATTEST: this 6th day of April, 1967.
