Estimated costs filed as follows :- , Walk on south side of Sample Street from Walnut Street to Washir* ton Axxnxx School estimated at......., 725,00 Pipe sewer on Werwinski Street from College Street to Wilber Street at.........................•.••.$3,923.00 Trunk sewer on Meade Street from Huron Street to Sample Street at.'....* 17.350.00 The City Engineer submitted the list of the property owners in the matter. of an appropr iat ion ofccerta, in property under 'Condemnet ioh Resolution No. 56 as shown on Page 333 Record No. 8 for the Widening of Ewing Avenue from Ersnperger Street to Olive Street in the City of South Bend, Indiana, which list includes the names of the owners iudd holders of of property and', of interests sought to be taken or bone-, ficially or injuriously affected, and the description of the several pieces of property which is affected by said appropr iat ion proceedings. Thereupon the Board proceeded to award the damages sustained and to assess the benefits accruing to each piece, of property on said list, It was thereupon, upon motion duly made and seconded and unanimously adopted, resolved that said list, together with the amount of benefits and damages and the benefits and net damages therein set forth.as the several parcels of land be adopted and that the respective amount, of benefits contained in said list to and are hereby assessed against the several tracts of land as specifically set forth in said list and that the respective amounts of damages be and are hereby awarded to the several tracts of land as specifically sot forth in said list, and that net benefits or net damages, as the case may be as to the respective tracts of land, contained in said list'are hereby awarded or assessed, as the case may be as to the said several tracts of land. The Board hereby further -sets off the benefits and damages each against the other where both benefits and damages are assessed, against the same piece of property, tract of land or interests, and hereby fixes the said respective net benefits as the amount that shall be paid by the respective owners as benefits and further hereby fixes the resRct ive owners as benefits and further hereby fixes the respective net damages as to the several tracts as the amount that shall be paid to the owners of the respective tract as damages. The Clark of this Board was instructed to prepare notices to the owners of each parcel of property showing the amount of the assessment of benefits or award of damages with a description of the property and it was unanimously agreed by the Board that the date of hearing on said awards of damages or assessments of benefits for this Widening proceedings be set at a future tame. Place one anchor in same' alley just north of Division Street. Concerning the improvement of the roadway of Lawndale Avenue from North li of Van Buren Street to Vassar Park Addition with asphalt, asphaltic concreto, bitulithic concrete or brick, pursuance to resolution No. 813 the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing -on said street to be improved requesting that it be'improved with different kind Of pavement than the kind hereotofore adopted by the.Bosrd in its preliminary order; and the City Engineer reports that the Williston Construction Company is the_1owest and best bidders for the kind of pavo- ment heretofore adopted by the Board and the Board find that said Williston Construction Company is the lowest and best bidder and hereby lets the contract for said improvement to him, and orders that said improvement be made with Aspaltic Concrete using Trinidad Lake Asphalt and all proceedings heretofore made in this matter are, hereby confirmed and ratified, Attested: - Veronica C . Resolved by' the Board of Publ io Works of the City of South Bend, Joseph County, State of Indiana, That it is deemed nee essary to improu from Portage�Avenue to Kessler Boulevard and Kessier'Boulevard from to Beale Street as f ollows, t o-wit: - Said streets shall be graded from property line to property line, also cement curb and cement sidewalk shall be con- structed on both sides off' said streets, all as is more particularly shown and all in accordance with the plans, profiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana. in accordance with theprofiles details drawings and specifications an file in the office of the Department of the Board of Public Works of said City; and such improvement is now .ordered. The cost of said improvement, including the cost of the street and alley intersections, shall beassesssd upon the real estate abutting on said Rase and Kessler Blvd. all according to the method and manner provided for in an Aut of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905, and in accordance with and pursuat to the provisions of all amendatory and supplemental acts thereto , passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with'interest at to rate of six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessment before said bond or bonds are issued,. Under no circumstances shall the City of South Bend, -be, or_b,e held respon- sible for any sum or sums , due from said property owner or- owners for aid work or for the collection of the same, or.. for the payment of any bond, bonds , . cert if i°- cate or certificates, issued to said contractor in payment for such works except for such moneys as shall have been actually received by the City from the assessment for such improvement, or such moneys as said City is by said above entitled act required to pay. All proceedings had, and work done in the making of said improve- ment, assessment of property,- collection of assessments and issuance of bonds ,therefor, shall be as provided for in said above entitled Act and amendments thereto. Notiee'of this resolution shall be published on the 25th. day of August 1920oand on the lst. day of September 1920 in the South Bend Daily Tribune This Board will give a hearing on this resolution in its off ice in the City Hall on the 15th4 day of September 1920 at 7:15 P.M.
