Judge Fund appeared before the Board in regard to plat filed May 18th.9
1920 of Meyer's and Funk's Chippewa Heights Add it ion' to South Bend, Indiana. Action
deferred on, same until Tuesdays August 24th., 1920 at 10:00 A M. Board to investigate
this plat.

Dear Sir -
Confirming my conversation with you concerning the refusal of Thilman
Bros. Plumbers` in acknowledging our bill aga ins t 'them for damage to oub underground
conduits ar;d cable on May %th., 1920, the repairs amounting to 025.46 which they refuse
, t o pay,
The: facts of the .case are that this underground Gable began to fail and the
trouble WAs located at a point where Thilman Bros, had done some excavation work and the
pavement had been repaired. The trouble was lecat4i in the cable at that point and
found t4at the conduit had been broken and the cable injured by a pick or some sharp
tool. T#e damage was repaired, the labor amounting to the above mentioned ::'figure, which
Thilman Bros. absolutely - refused to recognize.
It is my understanding that Thilman Bros. have filed a b and wdth the board, -
Of Works guseanteeing the utilities against any such damage caused as herein before mentioned
Thilmp Bros'. acknowledged to our representative that they did the damage, but would
not pay one cent of it. The matter is therefore referred to you for such action as you
will take to protect the Public Utilities by a bond filed by these people.

Our Division Engineer Mr. D. T. Conrow has called to my attention
that certain corttr'a►ctded Farr 'aiikizig `exeavat ions in grading and , re -grad ing streets
damaging our property without notifying us in oreler to give us opportunity
to take care. of -our prQpe,rtg •ate -in -lnstalmots has been the cause of our patron's ,
service being toally interrupt6t.,
For spottcif instance we would respectfully callyour attention to the
grading of Main Street from!" Ewing Avenue south, which we knew nothing of until our
subscribers reported. tba.ir• te•laphone• $ervdae was out. Upon invest igat ion we found
that the contractor. had• graded• our- pole line on both 'the `north and south curbs of
Eckman Street at.,Ma:in. St.r.eet. and, a,11• the. c•irc;aits had been broken and wire removed.
This,. you. --an, see. ,is. a ser1ous• matter so far as the Telephone Company
is concerned, an& we. are. asking. your. cooperation. in seeing that we are advised when
any excavat ion is. to. be. made. and. gdve• as much advance notice as pose ible in order
to take care of the,aeckasary work to keep our subscribers in service,
In this connections it would also assist usin the consolidation
of oar lines and eliminating the duplicate pole lines in the all, allies if we could
have advance notice of fillies that are to be paved so that we can make -our cone
selidation of these lines before. the paving is done This *will also assist us
greatly with your co-operation.
We find considerable delay in carrying -.out your instructions where
streets are to be widened and our pole line re -located. The delay is experienced
when we have to get our loc"at ion ' from the City Engineer and we are wonder ing - if, you
_ could give the authority to some one person to issue the City permits for all*
` classes of work and these permits to be later approved by the Board and Erg ineer.
. As a4 illustration we would quote the following case on East -Calvert
Street from Michigan to Fellow the City insisted that we promptly remove the lam
from Calvert Street on a count of new pavement, but the Construction Foreman
was unable to secure permission for the setting Qf poles within the curb dine `as
E. this permission had to be sacured from the -City Engineer an for two days he was
unable to locate Mr.. ; Anderson and the Work was finally done without formal;
permission.

concerning the present system of requests for permits from JFour Honorable ,Beard.
At thetDresent time our Construction Department are Writing letters ,describ ing

the work donethat . they: ask- for the permits which results ' in some confusion _
and misunderstanding on the part of the inspector and makes it necessary for hire
fi to go ever. the plans in detail with the Engineer ar. Superintendnet of ,Construction -
We would .like t o ..request that we, be allowed., to submit prints for such worC . as we are
re,quas t ing permits ,showing, every,detail of %the work to be, done and a set of' codes
will be furnished so that the Inspector can interpret th- prints. If this is net
satisfactigry we would be glad to comply wii�h such set of codes as your Honorable
Board may wish As to use. .

P£rmisp ion granted the New JerseyIndiana & Illinois Ry. Co. the right
to close Prairie Avenue and Kemble Avenue at intersection of their right; of way for a period
of from five to ten days from August lath. ,1920. Kemble Avenue riot to be re -opined until
Prairie Avenue is -re-opened, Proper barricades and detours signs to be placed and the
Police a-nd Fire Department to be notified when streets are closed and re -opened.

STkEET OR ALLEY IMPROVEMENT RESOLUTION N0. 836.
Be It Resolved by the Board of Public Works of the City of South Bend,
St. Joseph County, State of Indiana, , that it is des irad and deemed necessary to Improve
Ewing Avenue from Michigan Street to Miami Street as follows, t o-ttt: --
Said Avenue shall be graded and the roadway thereof shall be paved; and
also the roadway of certain portions of the streets and alleys which enter or intersect
said street shall be graded and paved. The paving material to be used in making said
improvement shall be Sheet Asphalt, Bitulithie, Asphaltic concrete or Brisk, and the foundatio
shall be pertland cement concrete six (6) inches thick for the sheet asphalt, bitulithic,
asphaltic concrete and brick or rolled gravel six '(6) inches thick forthe brick; also com-
bined cement curb and gutter shall be constructed along said avenue where same is not
already constructed where necessary; all manhole tops and storm water inlets shall be set
to the proper grade, cement marginal curb shall be constructed at all street and alley
intersections where necessary, all as is more particularly shown and all in acerdance
with the plans, profiles, detail drawings on file in the office of the Department of Public
Works of the City of South Bend , Indiana.

The following resolution was adopted by the Board.
CONDFMATION RESOLUTION NO. 57/$1920.
Resolved by the Board of Public Works of_, t he City of Sout-h Bend, Indiana,
That the following, described property be appropriated for. the use of said City:-
13 feet off East Side of Lot 6 in J. P. Creed's Addition to the Town
of Myler now a part of the City of South Bend, Indiana.
13 feet of:' east side of lot 1.2 in J. P. Creeds Addition to the Town
of Myler now p part of the City of South Bend, Indiana.
The -.following described property may be injuriously or beneficially
affected by such appropriation. Beginning on the south line of Indiana Avenue at
the intersection of the east line of the first alley west of Kendall Street; thence
south along the east line of said alley and said alley produced south to the north
line of Ewing Avenue;lthence east along the north Iine,of Ewing Avenue to a point
129 feet east of the east line of Kendall Street; thence north parallel with and
129 feet east of the east line of Kendall Street to the south line of Indiana
Avenue; thence west along the south line of Indiana Avenue ' to the place of begin-
ning.
The purpose of such appropriation is for the .Widening of Kendall Street
,from Calvert Street to Sherrill Street.
Notice of this resolution shall be published on the 19th. day of August
1920 and on the 26th. day of August 1920 in the South Bend Daily Tribune.
This Board, at its -office in the City Hall on the 8th. day of September
192.0 at 7: 1.5 P.M. will hear and , reee ive remonstrances from all persons interested
in cr affected by these proceedings.

The Board ordered that the City Contractor be notified to
complete sidewalk extensions at corner of Donald Street and Marine,Street and at
Fox Street and Miami Street.
The following guarantee bonds signed and approved by the Board:
Guarantee bond for the amount of three hundred and thirty three
Dollars and sixty seven cents ($333.67) signed by the White Construction Company
as pr inc ipal and Maryland Casualty Company of Baltimore, Md. as sureties for
8vement on Birner Street from Allen Street to Baline Avenue with asphaltic concrete
under Improvement resolution No. 6-74 for a period of five (5) years was approved
by the Board.° °
Guarantee bond for the amount of Five Thousand One hundred and
seventy five Dollars and ninety four cents ($5,175.94) for pavement on .Huron Street
from Alley East of Kosciusko Street to MeadeStreet with asphaltic concrete pavement
under Improvement kes olut ion No. 689 signed by the White. Construct ion Company
as principal and Maryland Casualty Company of Baltimore, Md. as sureties was
approved by the Board.
Guarantee bond for the amount of three thousand five hundred and
twenty two and eighty seven ($3, 522.87) for pavement on Miami Street from North
line of Pwing Avenue to the south City Limits, under Improvement Resolution No.
714 with Sheet Asphalt pavement, signed by the White Construction Company as
principal and Maryland Casualty Company of Baltimore, Md. as sureties for a period
of five years.
Guarantee bond for the amount of Four hundred and twenty seven
Ddllars and sixteen cents ($427.16$ for resurfacing of Bronson Street from
Main Street to .Lafayette Blvd . with asphaltic concrete, signed by,The White
Construction Com any ad pr inc ipal and Maryland Casualty Company of Md. as sureties
for a period of -rive years was approved by the Board.
