Whereas, the, pet it loner. Indiana Northern Railway Company, heretofore on the 27th. day of May,1920 filed with this board its petition for permission to con- struct and maintain tracks . over Walnut and Olive Streets in the C its of South Bend, Ind iaan,_ and Whereas, this Board being tuly advised in the premises finds that, said petitioner is a railroad corporation duly crgaxised and ex ist iag" under the laws Of the State of Indiana; that t it Owns and operates a. steam railroad in the City Of South Bend aad that it is a common carrier and is subject to the laws -of the State and of the united States governing common carriers; that it was organised primarily for the purpose of --sery ing the Oliver Chilled Plow Company of the City of South Bead, aad is located aimost ent ire ly within the present plant of said c onpanV. or upon land . ad jaeest thereto, which is to be occupied by said c'Ompany with additional plant buildings and facilities now is pr oeess of construction; 'that is order , to meet the .aeseds of ,said plant when. expanded it will be necessary L to add to pet it ioaer t s present facilities by extend \ its present tracks and constructing new ores; that said tracks will lead to and connect with other lutes of railroad to the east and west of Olive sad Walnut Streets in said City, and in order to make such a onnect ions and operate said tracks it will be necessary to crosss said streets with petitioners tracks at the points ^hereinafter, desI- !gasted_. _ Now, _ therefore, be it r �s olved that said petition be granted and that said pet itioier is hereby gives the right to construct, maintain and operate railroad tracks over and across said Olive and Walnut Streets in said City of South Ben at such times as it may deem them L necessary at the following points:- 1. At a point on Walnut Street approximately 700 Feet south\ of the s out hern .l Ise of Sample Street cross ing on a curve of about 20 degrees; tangent to curve at center of the; street not to be less than 60 degrees with the center lute of said street, 2.. At a point .on Walnut Street approximately 2100 feet south ,of the s outhera line of Sample -Street and approximately 50 feet north of the north line of the right of way of the St. Joseph,- South Head 7 Southern Railroad Company on a curve of about. 20 degrees, tangent to a curve -at center of the street not to be less than 6odegrees with the center line- of said street. -3. A crossing on. Walnut Street parallel with'and immediately adjacent on the north to the right of way of the S. S. 41 8. R. R. 4. A crossing on Olive Street parallel with and immediately adjacent on the north to the right of way of the S. S. 41 S.r. R. - 5. Wednesday October 13th.,i920. x Property owners from the s outh. and of the city in the a is laity of the location of the asphalt plants on Calvert Street and South iiain Street appeared before ,the Board in regard to the smoke and dust nuisance caused by the operation of the asphalt plants in that section of the City. Present were, Miss Jessica Pond, of the Fabric Roll Protector Company, Mr. Quimby Taggart, Mr. Wells, Jacob.Kunt$ and Mrs Kuntz_ and Mr. Ed. MoEndarfer, all property owners and business people. Mr. J. G. Schaub sad of the Williston Construction Company and Mr. A. H. McDonald of the White Construction, Company present representing the asphalt plants. The Board heard complaints fr oUL the property owners present in regard to the dust and smoke nuisance caused by the asphalt plants of the Williston arid° White Construction Companys.
