Board met in regular session at 7: 15 P.M. All members present,
Petition. filed for pavement on Notre Dame Avenue from Jefferson
Blvd. to Division Street.. Same read and placed on file until Hatember 1920.
Hear :rag given on Improvement Resolution No. 836 for the
Pavefnent' on Ewing Avenue from Michigan Street to Miami" Street,, in the City of South
Bend, Ind i�.na.
Upon said hearing remonstrators appeared but no written° remora-
strar,.ce was filed. ( Mrs. and Mr. Warliuh, Wm. Braman, property owners on said street,
and F. L. Dennis of the Citizens Homes Company property owners on street appeared
at said hearing$ )And the Board being fully advised in the premises, decides that the
benefits to property liR_Vle to be assessed for said improvements are equal to the estimate
cost of same, as reported by the City Civil Engineer, and thereupon takes final action
on said resolution as originally adopted, and the same is hereby in all ;things, ratified
c onf irmed and approved..
Resolved further, that notices be published on the 9th. day of
September 1920 and on the 16th., clay of September 1020 in the South Bend Daily Tribune
a news paper of general circulation in said City, stating that thin Board will receive
bids for the construction of said improvements up to 10:00 A.I. on the 24th., day of
September.1920. The Board reserves the right to reject any and all bids.
Hearing given on Condemnation kes olut ion No. 57 for the Widening
of Kendall Street from Calvert Street to Sherrill Street, in the City of South Bend.,
Indisaa.
In the above matter no remonstrators appeared and no written
remonstrance was filed. The Board therefore sustain all former action taken, ;and. declare
the above .described property in all things condemned and appropriated 8or public use
and this resolution in all things, ratified, confirmed and approved.
The Board further ordered that the City Engineer be instructed
to prepare a roll of all owners or holders of property and of valuable:" interests therein
sought. to be taken or to be injuriously affected which ligt or ro*11 shall also describe
the property beneficially affected and show the awards of damages and assessments of
benefits in the above matter.
Deferred hearing had on the assessment roll and Final estimate
for pipe sewer on Wakewa Avenue from Iroquois Street to Lafayette Street, under
Improvement Resolution No. 755. In the City of South Bend, Ind"ia•na. "
In the above matter no further remonstrators appeared and no
further written -remonstrance filed and written remonstrance filed August llth.,
1920 is hereby sustained and said assessment roll modified. And the Board therefore
find that the property assessed in said roll filed July 21st.,1920 is benefitted
in the amount of assessment as shown on said roll as modified:- By placing assessment
on Lots " from 151 to 167 inclus ive Park Addition to Navarre Place, and the Board further
find that the roll filed Julwr;216t . ,1920 and the final estimate allowed July 21st. ,
1920 and as modified should be and the same are hereby in all things, ratified,, confirmed.

Hearing had on assessment roll and final estimate for Sidewalks
on Various Street, in the City, under Improvement Resolution No. _ in the City of.
South Bend, Indiana, In . the above matter no remonstrat trs appeared and no written
remonstrance was filed. The Board therefore findthat the assessment roll filed
is benefited do the amount of assessments as shown on said rolls; and
the Board further find that the assessment roll filed nd the final estimate
allowed should be and the same are hereby in all things, ratified,
confirmed and approved.
Certified c opu of court findings in John A. Hibbard vs City on the
Widening of Oakland Street was filed with the Board.. The sum of $227- 99 plus 6%
interest allowed paid by the Board out of Miscellaneous fund of the Board, this
making John Hibbard's damages on widening of Oakland Street $ 633.33
Resolution was then ordered prepared on the Oakland Street Grade, curb
and walk improvement.
Cert if ied copy of proceedings of New Jersey Indiana & Illinois Ry. Co.
vs City of South Bend, Indiana for damages for opening of Huron Street across
right of way was filed with the Board and placed on file. Suit d ismissef no
damages
The Board ordered that the New Jersey, Illinois and IndAna Ry." Co.
Grand Trunk R.:_ R. Co..,and New York Central Ry. Company: plank Huron Street crossing
where said. Huron Street was opened across their right of way.

The following resolution adopted
QIDEWALK WROVEMENT RESOLUTION NO. 842.
Resolved by the Board of Public Works of the City .of South Bend,
St. 'Joseph County, State of Indiana, that it is deeemed necessary to improve
the first alley east of Fellows Street from Indiana Avenue to Haney Avenue as fell
follows:- to -wit: -
Said alley shall be graded from property line to property line
to:.the established grade from IrLdiana Avenue to Haney Avenue, all as is more
particularly shown and all in accordance with the plans, profiles, detail drawings,
and specifications on file in the Office of the Department of Public Works of the
City of South Bend, Indiana in accordance with the profiles, details, drawings
and specifications or, file in the office of. the Departament of the Board of PI blic
Wei^ks of said City.; and such improvement is now ordered.
The cost of said improvement, including the cost of the street
and alley intersections, shall be assessed upon the real estate abutting on said
alley east of Fellows Street, all according to the method and manner provided
for in an Act of the General Assembly of the State of Indiana, entitled " An Act
Concerning Municipal Corporations, " approved March 6,190% and in accordance
with and pursuant to the provisions of all amendatory and supplemental acts.t.hereto
passed by the General Assembly of the State of Indiana. Assessments, if deferred
are to loe paid: in ten equal annual installments, with interest at the rate of Six
per cent per annum. A bond or bonds shall be issued to the contractor in payment
of such work, unless the property owners pay said assessment before said bond or
bands are issued. Under no circumstances shall the 'City of South Bend, be or be
}iald' respons ible for tknx any sum or sums , due from said property owner or owners
for said work or for the collection of the same, or for the payment of any bond
bonds certificate or certificates, issued to said contractor in payment for such
work, except for such moneys as shall have been actually received by the City from
the assessments for such improvement, or such moneys as said City is by said
above entitled Act .required to pay All proceedings had, and work done in the
making of said improvement, . assessment of property, collection *
