CONTRACT. THIS AGREMENT made and entered into this 20th. , day of May 1919 by and between L. H. VanderKarr, party of the first part, and the City of South Bend, Indiana, by its Board_ of Public Works, party of the second part , WITNESSEKM That for and in consideration of the parties hereinafter stated, to be paid to the party pf the first part by the party of the second part, the said party of the first Part hereby agrees to repair all asphalt pavements in the streets of said City under the direction of the Street Commissioner and to furnish all materials and labor required In dobt g said work until January lst., 1920. All of said re Nair ing is to be done at places as directed by the Street Commissioner of said City, or by his deputy. Saud party of the first part agrees to use first class material in dot#g said work, and he further agrees to use first class mater ial. it dot#g said work, and he further agrees to place barricades and red lights at the places where said: repair work is being done by him, in such manner as to protect all persons, in using said street, from injury. In consideration of the performance of said work by the party of the first part. the said party of the second part agrees to pay hits therefor the sum of Two Dollars and thirty five cents ($2.35# per sq. yd. for all resurfacing and re- pair work , except Where the grouting or foundation concrete is broken through or' in suchcondition that it cannot be used, in which instance the party of the first part shall receive three ($3. 00) Dollars per square yard. Said sums are to be paid after said work has been inspected and approved by the Street C ommiss ioner of said City, or by the City Civil Engineer. The party of the first part further agrees that he will do all work in a good workmanlike manner, and that he hereby guarantees all of said repair work to be and --remain in .good condition for a period of one year from the time` such re^air work Is done; and if duAing said year, said repair work so done should, be- e ore defective, the- party of the f first part agrees to re :.lace the same, with ,good, material or upon fail.'To to do so, to refund to said City the amount .received by him for such repairing. And. said party ofr the first part further agrees to indemnify and,_ save harmless the -said party of the second part from all damages to any person or propert by reason of the negligent performance of said Work by the party of the first part, And said party Of the first part further agrees that after repairing any placed In any of the streets of said City, ate will immediately thereafter remove all dirt and refuse to the curb of said street. And it is further agreed that the party of the first past may use all material taken out of the street repaired by him, which material is to in first class condition a.nd suitable to be used in doing said repair work.. And said party of the second part, as a part of the consideration of this contract, agrees to loan to said party of the first part, asphalt plant, all asphalt tools, which is now owns, and said party` of the first part agrees to pay for the use of the same and for such time as said tolls are actually used, give (5) cents per sq. yd. of asphalt surface laid and said f first part agrees to keep said tools and plant in good repair and return the same to said party of the second part in good condition less natural wear and tear, 687 The said .party of the f irst part agrees to do and execute said work at times and .places as des igua.ted by the Street Commissioner of said City, and under his direction. And it its should fall and refuse to do the same, as by the terma of this contract required, then said pasty of the see,ond party may at its opttion terminate this agreement, And if said party of the first part should . Bail to perform this agreement or any of its terms and conditions, or if he shall fail to do any work within one week after he is directed so to do,(except where shortage of materials is caused by , ra ilroad strike or freight embargo), then he agrees to pay said party of the second part the sum of fifty and no/100 dollars (50.0.0) as liquidated damages for such failure, and said party of the second part may retain said sum out of any money due said 'party of the f Ira part, sa Id sum to be 'pa id to se, id f irst party upon the c omplet ion of the work to be -d one under this c ontract.
