HomeMy WebLinkAboutNo. 0346 approving/authorizing the submission of a code enforcement grant application for model cities east code areaRESOLUTION NO. 346 ; ESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING IODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENI APPRU M b 1ND AUTHORIZING THE SUBMISSION OF A CODE ENFORCEMENT GRANT APPLICATION -OR MODEL CITIES EAST CODE AREA WHEREAS, Section 117 of the Housing Act of 1949, as amended, authorizes the Secretary of Housing and Urban Development to make grants to municipalities and counties to assist them in carrying out programs of concentrated code enforcement in deteriorated or deteriorating areas in which such enforcement, together with certain public improvements to be provided by the locality, may be expected to arrest the decline of the are ; and WHEREAS, i has been found and determined by this body that there exists in this locality certain deteriorated or deteriorating areas for which a program of con- centrated code enforcement, combined with certain public improvements, may be expected to arrest the decline of the area; and WHEREAS, it is recognized that the grant of funds pursuant to Section 117 will impose cer ain obligations and responsibilities upon the City of South Bend, Department of Redevelopment, among which is the obligation to assure that any persons wh may be displaced as a result of the code enforcement and public improvemen s programs are relocated into decent, safe, and sanitary housing in accordance with the regulations of the Department of Housing and Urban Develop- ment; and WHEREAS, T tle VI of the Civil Rights Act of 1964 prohibits discrimination on the basis f race, color, or national origin under any program or activity receiving ederal financial assistance and Executive Order 11246 prohibits discrimina ion on the basis of race, color, creed or national origin in sale, lease, or they disposition of residential property (including land intended for reside tial use) or in the use or occupancy thereof: NOW, THERE�ORE, BE IT RESOLVED BY THE South Bend Redevelopment Commission, Governing Body of th City of South Bend, Department of Redevelopment: 1. That an application be filed with the Department of Housing and Urban Development on behalf of the City of South Bend, Department of Redevelopment for a code enforcement grant under Section 117 of the Housing Act of 1949, as amended, of two-thirds of the cost of undertaking and carrying out a code enforcement program, which cost is now estimated to be One Million, Eight Hundred and Thirty Two Thousaild, Three Hundred and Ninety Four ($1,832,394):Dollars in an area or areas to be designated and specially described in such application, and that the Executive Director is hereby authorized and directed to execute and file such ap- plication, to provide such additional information and furnish such documents as may be required by the Department of Hcusin� and Urban Development to execute and file requisition for funds, and to act as the authorized representative of the City of South Bend, Department of Redevelopment in the accomplishment of the code enforce- ment program and the President and Secretary of the Commission are hereby authorized to execute such contract or contracts as may be necessary for the grant applied for. 2. Thai; during the period of the contract for the code enforcement grant the City of South Bend, Department of Redevelopment will maintain a level of expenditures for code enforcement activities, exclusive of expenditures in any federally assisted code enforcement of Title I urban renewal project areas, that is not less than the average yearly expenditures for such activities throughout the locality for the two full fiscal years immediately preceding the filing of the application. 3.
