Committee Members Present: John Voorde, Jo M. Broden, Karen White, Sharon L. McBride Committee Members Absent: None Other Council Present: Gavin Ferlic, Tim Scott, Jake Teshka, Regina Williams- Preston, Oliver Davis (late) Other Council Absent: None Others Present: Kareemah Fowler, Graham Sparks, Bob Palmer Presenters: Lori Gesto, Kara Boyles Agenda: Bill No. 05-19-Alley Vacation- East/West portion of Dubail Street Committee Chair John Voorde called to order the Public Works and Property Vacation Committee meeting at 4:15 p.m. He introduced members of the Committee and proceeded to give the floor to the presenters. Bill No. 05-19- Alley Vacation- East/West portion of Dubail Street Lori Gesto, 1705 S. Olive Street, stated, I own the property adjacent to this (referencing a handout which is available in the City Clerk's Office). I'm the one (1) requesting this. It's not an alley, actually, it is a street that we use. Committeemember Jo M. Broden stated, It says subject to a utility easement agreement. Has that been secured? Ms. Gesto replied, Yes. Well, don't know about secured or if there is something more I need to write. They talked to me about that and that is not an issue for us at all. Kara Boyles, City Engineer with offices located on the 13`t' floor of the County-City Building, stated, That section of water main looks actually like a six (6) inch service. That is how the entire property gets served and not technically a public water main. If it goes through the vacation, it would just be on the owner to maintain that section of the water line versus the City. We actually requested they consider the vacation because they are using it now as a driveway to their property. So, it makes sense to do this. Committee Chair Voorde then opened the floor to members of the public wishing to speak in favor of or in opposition to this legislation. There were none. He then turned the floor back to the Committee for further comment or main motion. Ms. Gesto asked, Will it become our property? Ms. Boyles replied, Well, I'm not a surveyor, so I'm not sure how that will be recorded. It seems as though the property was acquired from that parcel to create that right-of-way, so, it might fall back. It makes sense. Councilmember Oliver Davis arrived at the meeting at 4:19 p.m. Committeemember Karen White made a motion to send Bill No. 05-19 to the full Council with a favorable recommendation. Committeemember Sharon L. McBride seconded this motion which carried by a voice vote of four(4) ayes.
