HomeMy WebLinkAboutNo. 0349 approving undertaking of survey and plans for an Urban Renewal Project know as the Southeast Neighborhood and filing of an applicationRESOLUTION NO. 349 ESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING ` BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT, APPROVING NDERTAKING OF SURVEY AND PLANS FOR AN URBAN RENEWAL PROJECT KNOWN AS HE SOUTHEAST NEIGHBORHOOD AND FILING OF AN APPLICATION WHEREAS, under Title I of the Housing Act of 1949, as amended (herein referred to as "Title I "), the Department of Housing and Urban Development is authorized to extend financial assistance to local public agencies in the elimination and preventior of the spread of their slums and urban blight through the planning and undertaking of urban renewal projects; and WHEREAS, litle VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and Urban Development effectuating that Title, provide that no person shall, on the ground of race, color, or national origin, be ex- cluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of urban renewal projects assisted under Title I of the Housing Act of 1949, as amended; and WHEREAS, it is desirable and in the public interest that the City of South Bend, Department of Redevelopment make surveys and prepare plans, presently estimated to cost a proximately Four Hundred and Fifty Two Thousand, Seven Hundred and Seventy Five ($452,775) Dollars, in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of Title I, in that area proposed as an Urban Renewal Area, situated in the City of South Bend, County of St. Joseph, and State of Indiana, which is described as follows: Projec Number One of the Southeast Neighborhood is located in the City of Sou h Bend, County of St. Joseph and State of Indiana and is described as follows: Beginning at a point formed by the intersection of the north right -of -way line of Sample Street and the west right -of -way line of Michigan Street;thence in an easterly direction on the north right -of -way line of Sample Street to the east right- f-way line of Carroll Street; thence in a southerly direction along the east right -of -way line of Carroll Street to the north right -of -way line of Wen er Street; thence in an easterly direction along the north right -of -way line o Wenger Street to the east right -of -way line of Fellows Street; thence in a southerly direction along the east right -of -way line of Fellows Street to the south right -of -way line of Indiana Avenue; thence in a westerly direction along the south right -of -way line of Indiana Avenue to the west right- f -way line of Michigan Street; thence in a northerly direction along the welt right -of -way line of Michigan Street to the north right -of -way line of Sam le Street, which is the point of beginning. NOW, THEROFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION: 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated, or deteriorating area appropriate for an urban renewal project, that the cevelopment of such area for predominantly residential uses is necessary for the proper development of the community, and that the undertaking by the City of South Eend, Department of Redevelopment of surveys and plans for an urban renewal p oject of the character contemplated by Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved. 2. That the financial assistance available under Title I is needed to enable thE City of South Bend, Department of Redevelopment to finance the planning nd undertaking of the proposed Project. 3. Thi and carryi Title I, 1 provision to the Sec below, a v of Title ] and prever t it is cognizant of the conditions that are imposed in the undertaking ng out of urban renewal projects with Federal financial assistance under ncluding those relating to (a) the relocation of site occupants, (b) the of local grants -in -aid, and (c) the requirement that the locality present retary of Housing, as a prerequisite to approval of the application described orkable program for community improvement, as set forth in Section 101(c) , for utilizing appropriate public and private resources to eliminate t the development or spread of slums and urban blight. 4. That the Unided States of America and the Secretary of Housing be, and they hereby ar , assured of full compliance by the City of South Bend, Department of Redevelop ent, with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964. 5. That it is the sense of this body (a) that a feasible method for the re- location cf individuals and families displaced from the Urban Renewal Area, in conformit with the requirements of Title I, can be prepared, and (b) that local grants-in-aid can and will be provided in an amount which will be not less than one -third of the Net Project Cost of the Project and which, together with the Federal capital grant, will be generally equal to the difference between Gross Project Cost and the proceeds or value of project land sold, leased, or retained for use ir accordance with the urban renewal plan. 6. That the filing of an application by the City of South Bend Department of Redevelop ent for an advance of funds from the United States of America in an amount not to exceed Four Hundred and Fifty Two Thousand, Seven Hundred and Seventy Five ($452,775) Dollars for surveys and plans for an urban renewal project in the pr posed Urban Renewal Area described above is hereby approved, and that the Presi ent of the South Bend Redevelopment Commission is hereby authorized and directed to execute and file such application with the Department of Housing and Urban Development, to provide such additional information and to furnish such documents as may be required by the Administrator, and to act as the authorized representative of the City of South Bend, Department of Redevelopment.
