A. South Bend Central Development Area
(1) Staff report on curb and sidewalk work on
west side of Hill Street between LaSalle
and Colfax.
Mr. Kain noted the East Bank Phase 3 Sewer
Separation project is currently underway.
This phase is expected to take several months
to implement and impacts both commercial
and residential areas in the East Bank
Village. One impacted area is Hill St.
between LaSalle and Colfax where the
Commission also owns an approximately 0.5
acre lot.
The CSO work will focus primarily on the
east side of Hill St. and include the removal
of asphalt and sidewalks to install new sewer
pipes. New curbs and sidewalks will be
installed on the east side of the street. Staff
believes this is a good opportunity to repair
the sidewalk and treelawn area on the west
side of the street along the Commission
owned property. Staff further recommends
that a small portion of sidewalk and treelawn

by Access Imprinted Sportswear also be
replaced on the west side of the street.
The sidewalks on the west side along the
Commission property are in dilapidated
condition, posing as trip hazards to
neighbors. A relatively small investment can
help clean up and support the work of
existing residential and commercial
properties.
Staff recommends repair of the sidewalk and
treelawn area on the west side of Hill St.
between LaSalle and Colfax. The work will
involve the following:
1. Sidewalk removal and replacement
2. Removal and replacement of
driveway approach
3. Removal and replacement of trees
4. Treelawn
The cost of the services has been estimated to
be $11,600, which includes a 10%
contingency. This will greatly improve the
Hill St. area and help the work of existing
businesses and residents. Staff requests
approval of the use of South Bend Central
Development Area TIF in an amount not to
exceed $11,600.
Upon a motion by Mr. Alford, seconded by COMMISSION APPROVED THE EXPENDITURE OF
Mr. Varner and unanimously carried, the $11,600 FOR NEW SIDEWALKS ALONG HILL
Commission approved the expenditure of STREET TO COMPLIMENT THE CURRENT WORK
BETWEEN LASALLE AND COLFAX ON THE WEST
$11,600 for new sidewalks along Hill Street SIDE.
to compliment the current work between
LaSalle and Colfax on the west side.

(2) Authorization for installation of Orchestra
Pit Lift at the Morris Performing Arts
Center.
Mr. Inks noted that the Redevelopment
Commission is being asked to allow the
installation of an orchestra pit lift at the
Morris Park Performing Arts Center. The
Redevelopment Commission has the
authority to authorize these alterations in
accordance with the terms of a lease for the
property between the Redevelopment
Commission (Lessee) and the
Redevelopment Authority (Owner) entered
into May 1, 1997.
The letter from the Morris Park Performing
Arts Center and Morris Entertainment, Inc.,
states this project is fully funded in the
amount of$210,000 by private funds,
including matching funds from the
Community Foundation. Additionally, the
letter indicates the City's Board of Public
Works will serve as the contracting agent and
the City Engineering Department will
oversee the project.
Since there are sufficient funds to complete
the project and since the city will oversee
contracting and construction, these
alterations to the Morris will not reduce the
rental value of the project. Accordingly, staff
recommends Redevelopment Commission
approval.

Redevelopment Commission
City of South Bend
Morris Entertainment, Inc. hereby seeks
approval to purchase and have installed an
orchestra pit lift inside the theater. The
agreement to perform the work on this
project was initiated over twenty years ago
between the City of South Bend andMorris
Entertainment, Inc., a 501[c]3 corporation.
The project has the full support of the
management of the Morris Performing Arts
Center.
The original major restoration/renovation
begun on December 31, 1998, reopening the
venue in February of 2000 did not include a
new orchestra pit lift due to the lack of
available funds. The orchestra pit lift project
is estimated at$210,000. Morris
Entertainment, Inc. is pleased to report that
it has raised all funds necessary to fully
finance this final restoration/renovation
project, including a matching grant from the
Community Foundation of Saint Joseph
County, Indiana. Research has been
completed on orchestra pit lifts and we are
satisfied that the Serapid brand will meet all
the requirements and needs of the Morris.
Therefore, we seek approval to proceed with
the purchase and installation of a new
orchestra pit lift. We also wish the Board of
Public Works to serve as our agent and the

City's Engineering Department to oversee
the project. The project will be fully funded
by Morris Entertainment, Inc. A Letter of
Redevelopment Commission's approval of
the project. Thank you for your prompt

Ms. Jones noted that she is involved in
another organization that had something to
do with this and she took a tour of the Morris
and not only does it not decrease the
rentability, it greatly increases it. Right now
they manually do the lift and it takes days to
set that up. Therefore, the days preceding a
performance that requires the lift are not
rentable. There are people who want to come
in for short performances and the Morris
misses many such opportunities to let the
facility. This should enhance and increase
the Morris's rentability.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED AUTHORIZATION FOR

(3) Resolution No. 3050 accepting the transfer
of real property from the South Bend
Redevelopment Authority. (Vacant lots in
Monroe Park)
Mr. Relos noted while preparing to take the
remaining seven Housing Development
Corporation (HDC) properties in the Monroe
Park area through the disposition process,
staff discovered there are two vacant lots that
should also be taken through this process.
Both lots are next to properties with houses
on them, and can be combined with those
houses when sold.
Like the other HDC properties, these lots are
titled in the name of the Redevelopment
Authority (Authority), and need to be
transferred to the Commission for disposition
purposes.
A resolution authorizing this transfer was
approved by the Authority on July 18, 2012.
Once both bodies have approved their
resolutions, deeds will be prepared to transfer
these lots in to the Commission's name.
Staff requests approval of Resolution No.
3050.

(1) Proposal for environmental services
related to 635 S. Lafayette Blvd. (Ivy
Tower building)
Ms. Kolata noted that the Commission has
entered into an MOU with Union Station
Properties that includes environmental
remediation at the current Ivy Tower
property. That included providing a Phase I
and Phase II Environmental Assessment,
including assessment of asbestos and lead
based paint currently in the building.
Recently we have determined that a third
environmental issue, transformers and
associated PCBs, will need to be addressed
as part of the site clean-up. There are four
transformer rooms and each unit within the
rooms will need to be investigated and likely
need remediation. Also, the concrete floors
of the transformer rooms need to be
investigated to determine whether PCB
contamination is present and, if so, what
remediation needs to take place. Weaver
Boos was selected to handle the remediation
based on their work at the former foundry
demolition, handling a complicated
remediation in a very efficient manner.
Weaver Boos will also assist us in
coordinating the remediation work with the
rehabilitation of the building by the private
developer.
The Proposal outlines the following four
tasks:

2. through of the property. This task
also includes the coring of the floors
in the transformer rooms and the
analysis of those samples.
3. Prepare bid documents for the
remediation work.
4. Provide one hour on-call service
during remediation and remediation
oversight.
5. Project management and
coordination.
The work will be billed on a time and
material basis. Weaver Boos assumed a two
year time frame for all of this work. If it is
completed more quickly, then the number of
hours billed could be significantly less than
the number of hours assumed for this
proposal. The cost of the proposal is not to
exceed $198,720. The staff recommends
approval of this proposal.
One of the complicating factors of this
project is how to remediate part of the
building and make it available on a timely
basis for the private development to take
place. It needs to be coordinated so that
we're not in their way when they'd like to get
to a certain part of the building? This
proposal covers that coordination as well as
on-call service.
Mr. Varner asked if this accomplishes the
remediation. Ms. Kolata answered no, this is
only for the services of Weaver Boos. The
remediation itself would be additional

costs/contracts and would not be completed
by Weaver Boos but by outside contractors.
This will set the specs. It provides the
inspection services on the city's behalf to
advise how to proceed.
Ms. Jones asked, if we would have to wait
for their findings before the Redevelopment
Commission would know how to wrap our
arms around the cost of remediation. Ms.
Kolata responded that on the PCB's and the
transformers, that is correct. Staff has
preliminary estimates on the asbestos and the
lead based paint.
Mr. Varner asked if this falls in line with the
costs associated with removing the PCB's
and the transformers in the foundry building.
Ms. Kolata responded that it falls in line with
the entire environmental consultant project
cost. She explained that she misspoke on the
foundry building. The transformers had
actually been removed by the owner. The
city had to do the clean up of what was left
behind, which included concrete and soil
impacted by PCBs.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED THE PROPOSAL FROM

Commission approved the proposal from TOWER FACILITY RENOVATION PROJECT,
SPECIFICALLY TO REVIEW THE ENVIRONMENTAL

(2) Staff report on Data Realty facade
expenses.
Mr. Kain noted that on July 26, 2011, the
Commission approved the sale of Lot 4 at
Ignition Park to Data Realty Northern
Indiana, LLC, which is in its final
construction stages with an anticipated
opening in October 2012. At the same
meeting, the Commission also approved the
use of the AEDA TIF in the amount of
$1,400,000 for the Data Realty building
facade enhancement as well as $77,500 for
BSA LifeStructures to prepare facade
concepts and construction documents.
The breakdown of the facade costs and how
the Commission is fulfilling its commitment
to Data Realty are as follows:

*Staff is in the process of determining options to cover this amount.
The lowest, responsive bid for the metal
panels and screenwall received by the Board
of Public Works on 7/24/12 increases the
overall facade costs by $81,315.

Staff is recommending the following strategy
to address the increase in facade costs:
1. Request additional funds from
Commission to cover the bid amount
and award to lowest responsive
bidder.
2. The final invoices from BSA
LifeStructures for the facade concepts
and construction drawings have come
in under budget by $20,002.75.
Apply these towards facade costs.
3. Work with Data Realty and approved
metal panel bidder to reduce the
project scope in order to bring facade
costs lower to and if possible within
approved amount of$1,400,000.
Staff requested the Commission to
appropriate an additional $61,312.25 from
the Airport Economical Development Area
TIF towards the Data Realty facade work.
This amount in addition to the construction
drawing savings will cover the $81,315 gap
and allow the project to be awarded.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED FUNDS IN THE AMOUNT

D. South Side Development Area
(1) Resolution No. 3058 approving and
authorizing the execution of an
Amendment to the Addendum to the
Master Agency Agreement with the Board
of Public Works (Main-Lafayette
Corridor Project, Supplement #6)
Mr. Schalliol noted that Resolution No. 3058
adds funding to cover demolition services of
three structures and related out buildings
purchased for the Main-Lafayette Connector
project. The three structures proposed for
demolition are:
• 4101 S. Main St. (DeBuysser parcel—
residential structure)
• 4219 S. Main St. (Mink parcel—
residential structure)
• 4043 S. Michigan St. (Premier
College of Cosmetology—
commercial structure)
The Board of Public Works has sent Notice
of Quote letters to area contractors and
quotes are to be opened by the Board on
August 9. Depending on prices received, the
Board will award demolition on the 14th of
August. The project is scheduled to be
completed by November and all sites will be
prepped for the winter season.
Staff requests approval of Resolution
No. 3058 and the Addendum to the Master
Agency Agreement for the Main-Lafayette
Corridor Project, Supplement#6.
Mr. Varner asked if the construction
contracts were bid yet. Mr. Schalliol

responded that bids will be let later this fall
because the acquisitions are not all complete.
It was put off once because there was not
enough critical mass to complete the
acquisition. Mr. Varner asked if this project
constituted critical mass. Mr. Schalliol
responded yes, the city has the total
properties needed but there are parcels still
be worked through including Lock Joint
Tube, Showplace 16, the post office.
Upon a motion by Mr. Varner, seconded by COMMISSION APPROVED THE AMENDMENT TO

7. PROGRESS REPORTS
Mr. Inks noted that Commissioners were provided with
a list of the vendors paid so far in 2012 and for what
projects the payments were made. Staff provides the
summary to the Commission semi-anually.
Mr. Varner asked that the list be included in the
Commission's annual report.
Ms. Jones asked about the meeting Commissioners
requested to hear the comments from affected property
owners on Fellows Street. Mr. Schalliol noted that staff
is still looking at alternative options as Mr. Varner asked
them to at the July 12 meeting. Then such a meeting will
be set. There is one home owner who is adamantly
opposed. Staff is working on a way to configure his
driveway to be feasible.
Mr. Varner asked if the acquisitions will take a long
time. Mr. Schalliol responded that it depends on
whether there are still unwilling sellers and whether they
take the city to court to prevent them.
8. NEXT COMMISSION MEETING
The next meeting of the Redevelopment Commission is NEXT COMMISSION MEETING
scheduled for Thursday, August 16, 2012 at 9:30 a.m.
9. ADJOURNMENT
There being no further business to come before the ADJOURNMENT
Redevelopment Commission, Mr. Varner made a
motion that the meeting be adjourned. Mr. Alford
seconded the motion and the meeting was adjourned at
10:08 a.m.
