HomeMy WebLinkAbout07/18/12 Board of Public Safety MinutesAGENDA REVIEW SESSION �- JULY 18, 2012 52 The Board of Public Safety met in the Public Agenda Session at 8:07 a.m. on Wednesday, July 18, 2012, with Board President Patrick D. Cottrell, and Board Members Eddie Miller, John Collins, and Luther Taylor present. Board Member Laura Vasquez was absent. Also present were Police Chief Charles Hurley, Fire Chief Steve Cox, and Board Attorney Andrea Beachkofsky. The meeting was held in the Board of Public Works Conference Room, 13th Floor County City Building, South Bend, Indiana. CHANGES TO THE AGENDA Ms. Beachkofsky stated the Board does not need to set a Hearing date in the Regular meeting; that can be done during the Executive Session. She noted that since there are so many individual's schedules to work around, she would like it removed from the agenda and dealt with during the Executive Session. Fire Chief Steve Cox stated the Mayor will be attending the regular meeting to pin the badges on the firefighter's being promoted. He suggested that since the Police Department has two (2) promotions also, both the Fire and Police promotions be moved to the first and second items on the agenda so the families of the officers won't have to wait. Board members discussed the following items from the agenda: - Monthly Statistical Analysis — Fire Department Chief Steve Cox, Fire Department, stated the County still is under a burn ban. He stated over the last month or two (2), grass fires are up nearly 400% due to the exceptionally dry conditions. Chief Cox noted that those numbers are out of the ordinary for this time of year, but not unexpected. - Retirements — Fire Department Board of Safety Clerk, Linda Martin, stated she would like to make note of the accomplishments of one of the retirees, Timothy Janowiak. She stated he was responsible for getting the Fire Fighter's Memorial built in Seitz Park, along with the creation of the Firefighter's Blues Festival. She noted the first project he worked on was the purchase ofthe first Fire Safety House from the Blues Festival funds. Ms. Martin stated his nrnndect nrnieet was when the funds from the Firefighter's Blues Fest were used to send a child from Memorial's Pediatric Cancer Ward to Disney World. Board member Luther Taylor agreed and stated he was the Fire Chief when Mr. Janowiak came on the department, and he hit the ground running as the person in charge of Special Projects. - Promotions — Fire Department Mr. John Collins stated that both individuals being promoted today, Joseph Galea and Timothy Lancaster, are good people that will serve the Department well. - Monthly Statistical Analysis — Police Department Police Chief Charles Hurley stated almost all of the statistics are down this month, but most notably there is a significant decrease in burglaries. He noted he likes to give credit to his department for doing a good j ob in decreases in crime, but he also acknowledges that they are responsible for any increases. Board President Patrick Cottrell and Members Eddie Miller, John Collins, and Luther Taylor were present. Board member Laura Vasquez was absent. Also present were Police Chief Charles Hurley, Fire Chief Steve Cox, and Attorney Andrea Beachkofsky. Martin, Cler REGULAR MEETING JULY 18, 2012 The Board of Public Safety met in the Regular Meeting at 9:25 a.m. on Wednesday, July 18, 2012, with Board President Patrick Cottrell and Members Eddie Miller, John Collins, and Luther Taylor present. Board member Laura Vasquez was absent. Also present were Police Chief Charles Hurley, Fire Chief Steve Cox, and Attorney Andrea Beachkofsky. The meeting was held in the Board of Works Conference Room, 13th Floor, County City Building, South Bend, Indiana. CHANGES TO THE AGENDA Board President Pat Cottrell stated the Board would be moving the Fire and Police Department promotions to the first and second items on the agenda due to the large crowd in attendance. He added that item No. 3 under the Police Department, Set Hearing for Charges No. 2012 -05 — Bortone, was being removed from the agenda. 1 L7 REGULAR MEETING JULY 18, 2012 54 FIRE DEPARTMENT APPROVE PROMOTION TO THE RANK OF CAPTAIN IN SPECIAL ASSIGNMENT - PATRICK KOTTKAMP In a letter to the Board, Fire Chief Steve Cox stated that the South Bend Fire Department has a vacancy for a Captain in the Fire Suppression Division. In accordance with the promotion policy established by the South Bend Fire Department and Local 362, Chief Cox recommended that Firefighter 1St Class Patrick Kottkamp be promoted to the rank of Captain in Special Assignment effective, July 18, 2012, for a probationary period of one year. Chief Cox stated that Firefighter Kottkamp was appointed to the South Bend Fire Department on October 25, 2000 and has proven his leadership skills and ability in fire suppression. Therefore, upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the promotion to Captain in Special Assignment on probationary status was approved. APPROVE PROMOTION TO THE RANK OF CAPTAIN IN SPECIAL ASSIGNMENT — RYAN ORT In a letter to the Board, Fire Chief Steve Cox stated that the South Bend Fire Department has a vacancy for a Captain in the Fire Suppression Division. In accordance with the promotion policy established by the South Bend Fire Department and Local 362, Chief Cox recommended that Firefighter 1St Class Ryan Ort be promoted to the rank of Captain in Special Assignment effective, July 18, 2012, for a probationary period of one year. Chief Cox stated that Firefighter Ort was appointed to the South Bend Fire Department on April 19, 2000 and has proven his leadership skills and ability in fire suppression. Therefore, .upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the promotion to Captain in Special Assignment on probationary status was approved. PRESENTATION OF BADGES Mayor Pete Buttigieg was present and pinned the badges on newly appointed Captains in Special Assignment Patrick Kottkamp and Ryan Ort. The Board joined Mayor Buttigieg in congratulating them and wishing them well. POLICE DEPARTMENT APPROVE PERMANENT PROMOTION — JOSEPH GALEA In a letter to the Board, Police Chief Hurley recommended that Sergeant Joseph Galea be promoted permanently to the rank of Lieutenant in the Uniform Division, 1St Detail, effective July 20, 2012. Chief Hurley stated in his letter that Sergeant Galea was placed in a special assignment as a Lieutenant in the Uniform Division on July 20, 2011. His supervisor, Captain Terry Young, made an evaluation of the progress of Sergeant Galea and recommended a permanent promotion based on his progress. Upon a motion made by Mr. Collins, seconded by Mr. Miller and carried, the recommended permanent promotion of Sergeant Galea, PN #495, no longer in Special Assignment, was approved effective July 20, 2012. APPROVE PERMANENT PROMOTION — TIMOTHY LANCASTER In a letter to the Board, Police Chief Hurley recommended that Sergeant Timothy Lancaster be promoted permanently to the rank of Lieutenant in the Uniform Division, 3`d Detail, effective July 20, 2012. Chief Hurley stated in his letter that Sergeant Lancaster was placed in a special assignment as a Lieutenant in the Uniform Division on July 20, 2011. His supervisor, Captain Jeff Rynearson, made an evaluation of the progress of Sergeant Lancaster and recommended a permanent promotion based on his progress. Upon a motion made by Mr. Collins, seconded by Mr. Miller and carried, the recommended permanent promotion of Sergeant Lancaster, PN #2017, no longer in Special Assignment was approved effective July 20, 2012. ACCEPT MINUTES OF PREVIOUS MEETINGS President Cottrell stated the Board would accept the Minutes of the Public Agenda Session, Executive Session, and Regular Meetings of the Board held on June 20, 2012 and the Special Meeting of June 27, 2012 as presented. FIRE DEPARTMENT ACCEPT AND APPROVE RETIREMENT — RUDY JIMENEZ President Cottrell advised that Fire Chief Steve Cox has submitted to the Board the Application and REGULAR MEETING JULY 18, 2012 55 Declaration for Retirement for Arson Investigator Rudy Jimenez effective June 21, 2012. Chief Cox noted that Mr. Jiminez has served the Department with loyalty and diligence during the last twenty - six (26) years, and nine (9) months. Chief Cox joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT — TIMOTHY JANOWIAK President Cottrell advised that Fire Chief Steve Cox has submitted to the Board the Application and Declaration for Retirement for Pump Engineer Timothy Janowiak effective June 30, 2012. Chief Cox noted that Mr. Janowiak has served the Department with loyalty and diligence during the last twenty -three (23) years, and nine (9) months. Board Member and former Fire Chief Luther Taylor stated he would like to acknowledge Tim for his great ability to work with the public on special projects. He noted Mr. Janowiak hit the ground running when he came on the department. Mr. Taylor added that Mr. Janowiak was instrumental in getting the Fire Fighter's Memorial built, purchasing the Fire Safety House, and creation of the Fire Fighter's Blues Fest. He stated Tim was a great asset to the department. Chief Cox joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT — ALFRED KIRSITS President Cottrell advised that Fire Chief Steve Cox has submitted to the Board the Application and Declaration for Retirement for Battalion Chief Alfred Kirsits effective June 27, 2012. Chief Cox noted that Mr. Kirsits has served the Department with loyalty and diligence during the last thirty -two (32) years, and six (6) months. Chief Cox joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT — GREGORY MACK President Cottrell advised that Fire Chief Steve Cox has submitted to the Board the Application and Declaration for Retirement for Lieutenant Gregory Mack effective July 9, 2012. Chief Cox noted that Mr. Mack has served the Department with loyalty and diligence during the last twenty -one (2 1) years, and three (3) months. Chief Cox joined the Board in thanking him for his commitment, dedication and years of distinguished service to the South Bend Fire Department and the citizens of South Bend. Upon a motion made by Mr. Miller, seconded by Mr. Collins and carried, the retirement was accepted and approved. APPROVE AND ENTER FINDINGS OF FACT — _CHARGE NO. 2012-03 — THOMAS SHEETS Attorney Andrea Beachkofsky presented the Findings of Facts for Charges No. 2012 -03 for the Board's approval, stating that Captain Thomas Sheets be suspended without pay from the South Bend Fire Department for a period of thirty (30), eight (8) hour days to begin on a date chosen by the Chief and that he be removed permanently from the position of self - contained breathing apparatus technician for the Department indefinitely. Upon a motion by Mr. Miller, seconded by Mr. Taylor and carried, the Findings of Fact were approved and entered as outlined above. FILING OF QUARTERLY TRAVEL AND TRAINING EXPENDITURES REPORT — APRIL MAY, AND JUNE 2012 Fire Chief Steve Cox submitted to the Board a written Quarterly Travel and Training Expenditures Report for the period of April, May, and June 2012. The report summarizes travel and training expenditures for the South Bend Fire Department personnel during this quarterly period. In his letter, Chief Cox stated that training is essential to all aspects of fire service and it is necessary to remain abreast of the most current firefighting technologies and emergency medical services. There being no questions concerning this report, President Cottrell stated the Quarterly Report for Travel and Training Expenditures would be accepted for filing. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — JUNE 2012 Fire Chief Stephen Cox submitted to the Board the monthly report for the month of June, 2012 compiled by the Prevention/Inspection Bureau of the Fire Department. Chief Cox noted a I REGULAR MEETING JULY 18, 2012 56 tremendous increase in grass fires over the summer. He stated that from May to June of 2012 there were forty-five (45) fires versus only two (2) the previous year. Chief Cox stated the Mayor's office declared a burn ban which is still in effect. Mr. Cottrell stated if there were no objections, the Board would accept the report for filing as presented. Upon a motion by Mr. Collins, seconded by Mr. Miller and carried, the Findings of Fact were approved and entered as outlined above. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — JUNE, 2012 Police Chief Charles Hurley stated all crime decreased in June, except, unfortunately, for homicide and non - resident burglaries. Mr. Cottrell stated it was removed from the agenda earlier at the Agenda Review Session because of scheduling conflicts, and announced at the beginning of this meeting. Ms. Kelli Stopczynski, WSBT Television, asked why the setting of the Hearing was delayed. Mr. Cottrell re- stated it was delayed due to scheduling problems. Ms. Stopczynski asked if Mr. Bortone was contesting the Charges. Mr. Cottrell stated all the Board knows is that he is has hired a lawyer and is contesting the Charges.
