AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE
ARTICLE 4, LI LIGHT INDUSTRIAL AND GI GENERAL INDUSTRIAL DISTRICTS
TO CLARIFY AND ADD TO THE ALLOWED USES
STATEMENT OF PURPOSE AND INTENT
The Common Council of the City of South Bend, Indiana, recently adopted a new zoning
ordinance for the City of South Bend. Now that the ordinance has been in use for several months
it has been determined that certain changes are necessary to clarify and add to the uses allowed
in Light and General Industrial Districts.
Now, therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as
follows:
Section I. Chapter 21, Zoning, of the South Bend Municipal Code, Article 4 Industrial
Districts, Section 21-04.01 LI Light Industrial District is hereby amended as follows:
(a) Permitted Uses.
(1) Primary Uses.
(D) Industrial Uses: Including but not limited to: any of the following
industrial uses (except for those uses identified as Special Exception
Uses in this LI District, Primary Uses in the GI District or Special
Exception Uses in the GI District): Assembly or blending of
previously manufactured parts, sub-assemblies or components;
Cleaning, testing or repairing of goods, materials or products; Data
processing or analysis; Engineering or research laboratories;
Manufacture, processing, refining or fabrication of goods, materials or
products; warehousing; wholesaling= distribution centers and truck
terminals.
(E) Miscellaneous: Including but not limited to: Artificial Lake; bus, taxi,
or limousine terminal, with or without repair; Conference Center1
lumberyards.
Section II. Chapter 21, Zoning, of the South Bend Municipal Code, Article 4 Industrial
Districts, Section 21-04.02 General Industrial District is hereby amended as follows:
(a) Permitted Uses.
(1) Primary Uses.
(E) Miscellaneous: Including but not limited to: Adult Business *;
Artificial Lake; bus taxi or limousine terminal, with or without repair,
lumberyards.
Section III.
This Ordinance shall be in full force and effect from and after its passage by the Common
Council and approval by the Mayor.

Dear Council Members:
I hereby Certify that the above referenced ordinance initiated by the Area Plan Commission was
legally advertised on Thursday, March 3, 2005 and that the Area Plan Commission at its public
hearing on Tuesday, March 15, 2005 took the following action:
Upon a motion by Richard Warner, being seconded by Roland Kelly and carried, the
proposed ordinance initiated by the Area Plan Commission amending Chapter 21 of
the South Bend Municipal Code Article 4, LI Light Industrial and GI General
Industrial Districts to clarify and add to the allowed uses is sent to the Common
Council with a favorable recommendation. It is important to ensure that the new
Ordinance is updated to accommodate new uses and trends in development. The goal
of the Zoning Ordinance is to be more user friendly and to guide future development
in a positive direction. These additional uses are similar in intensity to the other
primary uses in the "LI" and "GI" Districts. Therefore, with the development
standards as set forth by the Ordinance, this text amendment meets the intent of the
Ordinance and will clarify some of the permitted uses in the Industrial Districts.
The deliberations of the Area Plan Commission and points considered in arriving at the above
decision are shown in the minutes of the public hearing, and will be forwarded to you at a later
date to be made a part of this report.

Requested Action:
The petitioner is requesting a text amendment to the City Zoning Ordinance. Through the course
of working with the new ordinance, it has been determined that some new uses need to be added
in order to clarify the allowable uses. The following uses are being added as primary uses to the
"LI" Light Industrial District: distribution centers and truck terminals; bus, taxi, or limousine
terminal, with or without repair; and lumberyards. The following uses are being added as
primary uses to the "GI" General Industrial District: bus, taxi, or limousine terminal, with or
without repair; and lumberyards. Because of the structure of the ordinance, truck terminals will
also be allowed in the "GI" General Industrial District.
Recommendation:
Based on information available prior to the public hearing the staff recommends that this petition
be sent to the Common Council with a favorable recommendation.
Analysis:
It is important to ensure that the new Ordinance is updated to accommodate new uses and trends
in development. The goal of the Zoning Ordinance is to be more user friendly and to guide future
