RESOLUTION NO. 420
RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
GOVERNING BODY OF THE DEPARTMENT OF REDEVELOPMENT OF
THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE FILING
OF AN AMENDATORY LOAN AND GRANT APPLICATION FOR PROJECT
NO. INDIANA R -66
WHEREAS, it is necessary and in the public interest that the
Department of Redevelopment of the City of South Bend avail itself of the
financial assistance provided by Title I of the Housing Act of 1949, as
amended, to carry out the urban renewal project described as Central
Downtown Area, Indiana R -66, and bounded generally by:
Beginning at a point formed by the intersection of the
north ROW line of LaSalle Avenue and the west ROW line of
Main Street; thence south along the west ROW line of Main
Street to the north ROW line of Washington Street; thence
west along the north ROW line of Washington Street to the
west ROW line of LaFayette Boulevard; thence south along
the west SOW lime of LaFayette -- Boulevard' to. the -south ROW line
of Jefferson Boulevard; thence east along the south ROW
line of Jefferson Boulevard to the west ROW line of Main
Street; thence south along the west ROW line of Main Street
to the south ROW line of Monroe Street; thence east along
the south ROW line of Monroe Street to the west ROW line
of Fellows Street; thence south along the west ROW line of
Fellows Street to the south ROW line of Monroe Street;
thence east along the south ROW line of Monroe Street and
proceeding in a northeasterly direction along said ROW
line to the center of the St. Joseph River; thence pro-
ceeding in a northwesterly direction along the center of
the St. Joseph River to the north ROW line of LaSalle
Avenue; thence west along the north ROW line of LaSalle
Avenue to the west ROW line of Main Street which is the
point of beginning;
hereinafter referred to as the "Project "; and
WHEREAS, it is recognized that the Federal contract for
such financial assistance pursuant to said Title I will impose certain
obligations and responsibilities upon the Local Public Agency and will
require among other things: (1) the provision of local grants -in -aid;
(2) a feasible method for the relocation of individuals and families
displaced from the project area; and (3) other local obligations and
responsibilities in connection with the undertaking and carrying out
of urban renewal projects; and
WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits
discrimination on the basis of race, color or national origin under any
program or activity receiving Federal financial assistance and Executive
Order 11063 prohibits discrimination on the basis of race, color, creed
or national origin in the sale, lease or other disposition of residential
property (including land intended for residential use) or in the use or
occupancy thereof; and
WHEREAS, the Local Public Agency has elected to make reloca-
tion payments in excess of $25,000, it is recognized that such payments
are to be made in accordance with the regulations governing relocation
payments; and the Local Public Agency has, or will have, available local
funds.
WHEREAS, the objectives of the Urban Renewal Plan cannot be
achieved through more extensive rehabilitation of the Project area:
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION OF THE DEPARTMENT OF REDEVELOPMENT:
1. That the United States of America and the Secretary of
Housing and Urban Development be, and they hereby are
assured of full compliance by the Department of Redeve-
lopment with regulations of the Department of Housing
and Urban Development effectuating Title VI of the Civil
Rights Act of 1964 and applicable Executive Orders.
2. That an application on behalf of the Department of Rede-
velopment for a loan under Section 102(a) of said Title I
in the amount of $29,8S6,OSS and for a project capital
grant, a relocation grant, and a Federal grant for the
making of rehabilitation grants to the full amount avail-
able for undertaking and financing the Project is hereby
approved, and that the Executive Director is hereby
authorized and directed to execute and to file such
application with the Department of Housing and Urban
Development, to provide such additional information and
to furnish such documents as may be required in behalf
of said Department, and to act as the authorized
correspondent of the Department of Redevelopment.
Adopted, at the regular meeting of the South Bend Redevelopment
Commission held on August 18, 1972 in the office of the Commission, 1200
County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
