HomeMy WebLinkAboutNo. 0422 authorizing the filing of a neighborhood development program application for Program No. A-10O Q RESOLUTION NO. 422 ..w" RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT AUTHORIZING THE FILING OF A NEIGHBOR- HOOD DEVELOPMENT PROGRAM APPLICATION FOR PROGRAM NO. A -10 WHEREAS, it is necessary and in the public interest that the City of South Bend Department of Redevelopment avail itself of the financial assistance provided by Title I of the Housing Act of 1949, as amended, to commence a Neighborhood Development Program in the urban renewal area described in Exhibit "A" attached, hereinafter referred to as the "Program;" and WHEREAS, it is recognized that the Federal contract for such finan- cial assistance pursuant to said Title I will impose certain obligations and responsibilities upon the Local Public Agency and will require among other things (1) the provision of local grants -in -aid; (2) a feasible method for the relocation of individuals and families displaced from the urban renewal area comprising the Program; and (3) other local obliga- tions and responsibilities in connection with the undertaking and carrying out of the Program; and WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits discrimi- nation on the basis of race, color or national origin under any program or activity receiving Federal financial assistance, and Executive Order 11063 co prohibits discrimination on basis of race, religion, color, sex or national origin in sale, lease or other disposition of residential property (includ- ing landirtended for residential use) or in the use or occupancy thereof; and WHEREAS, the Local Public Agency has elected to make relocation pay- ments in excess of $25,000, it is recognized that such payments are to be made in accordance with the regulations governing relocation payments; and the Local Public Agency has, or will have, available local funds (other than local grants -in -aid or program funds) with which to pay its share of the payments in excess of $25,000, and WHEREAS, in those areas where clearance is proposed, the objectives of the Program cannot be achieved through more extensive rehabilitation of the urban renewal area comprising the Program. Now Therefore, be it RESOLVED by the South Bend Redevelopment Commis- sion of the City of South Bend Department of Redevelopment: 1. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the City of South Bend Department of Redevelopment with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders. 2. That an application on behalf of the City of South Bend Depart- ment of Redevelopment for a loan under Section 102(a) of said Title I in the amount of $ 1,480,100.00 and for a program capital grant, a relocation grant, and a Federal grant for the making of a rehabilitation grant to the full amount available for undertaking and financing the first increment of such Program is hereby approved, and that the Executive Director is hereby authorized and directed to execute and to file such application with the Department of Housing and Urban Development, to provide such additional information and to furnish such documents as may be required in behalf of said Department, and to act as the authorized correspondent of the City of South Bend Department of Redevelopment. 3. That it is hereby recognized that relocation payments made in excess of $25,000 are to be made in accordance with the regulations governing relocation payments and that the Local Public Agency has, or will have, available local funds (other than local grants -in -aid or project funds) with which to pay its share of the payments in excess of $25,000. Williams, Secretary BOUNDARY DESCRIPTION The Neighborhood Development Project is located in the City of South Bend, County of St. Joseph and State of Indiana as follows: Beginning at a point formed by the intersection of the north ROW line of Western Avenue and east ROW line of Williams Street; thence in an easterly direction along the north ROW line of Western Avenue to the east ROW line of Franklin Street; thence in a southerly direction along the east ROW line of Franklin Street to the north TOW line of Monroe Street; thence in a easterly direction along the north ROW line of Monroe Street to the east ROW line of Fellows Street; thence in a southerly direc- tion along the east ROW line of Fellows Street to the north ROW line of Monroe Street; thence in a generally easterly direction along the north ROW line of Monroe Street to the southwest bank of the St. Joseph River; thence in a generally south - easterly direction along the southwest bank of the St. Joseph River to the northwest property line of the George Cooper Memorial Bridge interchange; thence in a southwest direction along the northwest property line of the George Cooper Memorial Bridge interchange to the northeast ROW line of Lincolnway East; thence in a southeasterly direction along the northeast ROW line of Lincolnway East to the center line of the George Cooper Memorial Bridge; thence in a southwesterly direction along the center line of the George Cooper Memorial Bridge to the projected northeast ROW line of GeorgeAvenue; thence in a southeasterly direction along the northeast ROW line of George Avenue to the south ROW line of Sample Street; thence in a westerly direction along the south ROW line of Sample Street to the east ROW line of High Street; thence in a southerly direction along the east ROW line of High Street to the south ROW line of Calvert Street; thence in a westerly direction along the south ROW line of Calvert Street to the west ROW line of Franklin Street; thence in a northerly direction along the west ROW line of Franklin Street to the south POW line of Sample Street; thence in a westerly direction along the south ROW line of Sample Street to the projected northwest property line of the City of South Bend Municipal Service Facility; thence in a northeasterly direction along the northwest property line of the City of South Bend Municipal Service Facility to the projected east ROW line of Scott Street; thence in a northerly direction along the east ROW line of Scott Street to the southerly ROW line of the Penn Central Railroad; thence in a northwesterly direction along the southerly ROW line of the Penn Central Railroad to the west ROW line of Bendix Drive extended south; thence north along the west ROW line of Bendix Drive to the north ROW line of Bertrand Street; thence in an easterly direction along the north ROW line of Bertrand Street to the west ROW line Meade Street; thence in a northerly direction along the west ROW line of Meade Street to the north ROW line of the first alley north of Longley Avenue; thence in an easterly direction along the north ROW line of the first alley north of Longley Avenue to the west ROW line of Olive Street; thence in a southerly direction along the west ROW line of Olive Street to the nort{, ROW line of Longley Avenue; thence in an easterly direction along the north ROW line of Longley Avenue to the west ROW line of Huey Street; thence in a Page 1 Exhibit A Ii.
