AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING CHAPTER 17, ARTICLE 6, SECTION 17-49 OF THE
MUNICIPAL CODE TO INCREASE WATER SERVICE FUND CHARGES
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Chapter 17 of the Municipal Code to increase the
water service charge of all water users under § 17-49. The City of South Bend, Indiana, last
increased this rate in 2001.
Since 2001 when the water service charge was last increased, the Department of Water
Works has experienced a 30% increase in demand for repair of leaks. The revenue generated by this
Ordinance will enable the City to recover its current leak repair losses and meet the increased
demand.
This ordinance provides for an immediate increase of thirty seven cents ($0.37) per water
user and an additional increase of thirteen cents ($0.13) per water user effective January 1, 2006, for
a total increase from one dollar and fifty cents ($1.50) to two dollars ($2.00) per water user as of
January 1, 2006.
NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend
Indiana, as follows:
Section I. Chapter 17, Article 6, Section 17-49 of the South Bend Municipal Code shall be,
and hereby is, amended to read as follows:
Section 17-49 Assessment of charges; deposit in separate fund, purpose.
(a) The sum of one dollar and €i-ftp eighty seven cents ($1.~@ ~ per month shall be added
to the water service charge of all water users. Effective January 1, 2006, the sum of two dollars
($2.00) per month shall be added to the water service charge of all water users.
(b) All of said sums of money so collected shall be deposited in a separate fund of the Bureau
of Water Works and said fund shall be used solely for the repair and/or replacement of leaking water
service lines.
Section II. This Ordinance shall be in full force and effect from and after the time it has been
adopted by the Common Council and approval by the Mayor.

Due to the aging of the system and the increase in the number of service line leaks, we
find it necessary to request an increase of the leak insurance fund. The present charge of
$1.50 per month would increase .37 cents to $1.87, and an additiona1.13 cents in the year
2006.
We will again review this account in 2007 with an update to the Common Council. We
thank you for your consideration and understanding in this matter.
