RESOLUTION NO. 542
RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
iv. COMMISSION CONFIRMING RESOLUTION 540 WITH RESPECT
TO THE CENTRAL DOWNTOWN PROJECT, IN R -66, AND FOR
MAKING CERTAIN CHANGES TO THE URBAN RENEWAL PLAN.
WHEREAS, the City of South Bend, Indiana, Department of
Redevelopment has, pursuant to the Redevelopment of Cities and
Towns Act of 1953, as amended, investigated and studied that
area of the City of South Bend, County of St. Joseph, State of
Indiana, designated as the Central Downtown Project, IN R -66,
which area is bounded by a line drawn as follows:
Beginning at a point formed by the intersection of the
north right -of -way line of LaSalle Avenue and the west
right -of -way line of Main Street; thence south along the
west right -of -way line of Main Street to the north right -
of -way line of Washington Street; thence west along the
north right -of -way line of Washington Street to the west
right -of -way line of Lafayette Boulevard; thence south
along the west right -of -way line of Lafayette Boulevard
to the south right -of -way line of Jefferson Boulevard;
thence east along the south right -of -way line of Jefferson
Boulevard to the west right -of -way line of Main Street;
thence south along the west right -of -way line of Main
Street to the south right -of -way line of Monroe Street;
thence east along the south right -of -way line of Monroe
Street to the west right -of -way line of Fellows Street;
thence south along the west right -of -way line of Fellows
Street to the south right -of -way line of Monroe Street;
thence east along the south right -of -way line of Monroe
Street and proceeding in a northeasterly direction along
said right -of -way line to the center of the St. Joseph
River; thence proceeding in a northwesterly direction
along the center of the St. Joseph River to the north
right -of -way line of LaSalle Avenue; thence west along
the north right -of -way line of LaSalle Avenue to the
west right -of -way line of Main Street, which is the point
of beginning.
WHEREAS, upon such investigation being made it has been
found by the Board of Commissioners of said Department that such
area has become blighted to an extent that such condition cannot
be corrected by regulatory process, or by the ordinary operations
of private enterprise without resort to the provisions of the Re-
development of Cities and Towns Act of 1953, as amended, and it
has been further found that the public health and welfare would
be benefitted by the further acquisition and redevelopment of
such area under the provisions of such act; and
WHEREAS, the Board of Commissioners has caused to be
prepared maps and plans showing the boundaries of such blighted
area, the location of the various parcels of properties, streets
and alleys and other features affecting the acquisition, clearance,
replanning and redevelopment of such area, indicating the parcels
of property to be excluded from acquisition and portion of the area
acquired which are to be devoted to streets, parks, playground, and
other public purposes under the redevelopment plan, and further
studies have shown the necessity of adding certain parcels to the
acquisition list and for the making of certain changes in the land
use, parking, and pedestrian circulation provisions in Area C in
order to update the Urban Renewal Plan to current market condi-
tions; and

WHEREAS, the Board of Commissioners did on August 12,
adopt Resolution 540 redeclaring, among other things, that
above described area is blighted and constitutes

WHEREAS, as required by law, the St. Joseph County Area Plan
Commission and the South Bend Common Council have considered and
approved said Resolution 540 and the Urban Renewal Plan (redevelop-
ment plan), and subsequently the Board of Commissioners did on
October 7, 1977, hold a public hearing for the purpose of presenting
said Resolution 540 and the plan changes approved therein to the
public and to hear and consider remonstrances concerning said
changes and such hearing was adjourned and continued to October
14, 1977, and again to this October 21, 1977; and
WHEREAS, said Redevelopment of Cities and Towns Act of 1953,
as amended, requires that the Board of Commissioners, after such
AVK hearing and consideration, shall take final action determining
the public utility and benefit of the project, either confirming,
modifying, or rescinding Resolution 540; and
WHEREAS, the Board of Commissioners desires to modify said
Resolution 540 and to confirm said Resolution 540 as so modified;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the City of South Bend Department of Redevelopment that Resolu-
tion 540 is modified by removing Acquisition Parcel 11 in Block 9
on the Land Acquisition Tabulations, Code No. R -213, Page 40d, from
the column headed "Acquire" and placing it back in the column
headed "Not Acquire ", and by reduction of the estimated cost of
acquiring the properties in the area, as specified in paragraph
numbered 3 of said Resolution 540, to $15,440,220.00.
BE IT FURTHER RESOLVED that it will be of public utility
and benefit to proceed with the plan of redevelopment as set forth
in Resolution 540 passed by said Board of Commissioners on August 12,
1977, referred to in the WHEREAS clauses above, and that said
Resolution 540 as hereby modified is now hereby approved, ratified,
and confirmed, including the changes in the Urban Renewal Plan
as presented in connection with the Urban Renewal Plan.
Adopted at a Regular Meeting of the South Bend Redevelopment
Commission, held on October 21, 1977, at the Office of the Commis-
sion, 1200 County -City Building, 227 W. Jefferson Blvd., South
Bend, Indiana.

AND FOR MAKING CERTAIN CHANGES TO THE URBAN RENEWAL
PLAN
adopted at a meeting of the Governing Body and Public Hearing
held on the 21st day of October, 1977. Said Resolution has
been duly recorded in the minutes of said meetina and public
hearina and is now in full force and effect. Said meeting and
public hearing was duly convened and held in all respects in
accordance with the law and the by -laws of the Local Public
Agency. To the extent required by law and said by -laws due and
proper notice of said meetinq and public hearing was aiven. A
legal quorum of members of the Governing Body was present
throughout said meeting and public hearing and a legally suf-
ficient number of members of the Governing Body voted in the
proper manner for the adoption of said Resolution.
All other requirements and Droceedings under applicable
law, said by -laws, or otherwise incident to the Droner adoption
of said Resolution, including any publication if required by law,
have been duly fulfilled, carried out and otherwise observed.
