AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AMENDING
CHAPTER 9, ARTICLE 1, SECTION 2 OF
THE SOUTH BEND MUNICIPAL CODE, TO INCORPORATE
THE 2000 EDITION OF THE INTERNATIONAL FIRE CODE
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Section 9-2 of the
South Bend Municipal Code, to replace the 1998 Edition of the
International Fire Code with the most recent published edition of
the fire code used by the State of Indiana and used by the St.
Joseph County/City of South Bend Building Department.
The 2000 Edition of the International Fire Code, published by
the International Code Council (ICC), is the edition currently used
by the St . Joseph County/City of South Bend Building Department and
it is the Edition preferred for use by the South Bend Fire
Department and currently used by the State of Indiana. The
enactment of this amendment of Chapter 9, Section 2 of the South
Bend Municipal Code will enable the South Bend Fire Department to
use and enforce the fire code that is most up to date and
consistent with the code used by the Building Department and the
State, and to enable the South Bend Fire Department to use the most
recently adopted State Fire Code without need for future amendments
to the South Bend Municipal Code.
The Common Council of the City of South Bend determines that
it is necessary to incorporate into Chapter 9 of the South Bend
Municipal Code the language of Chapter 6 of the South Bend
Municipal Code in order to enable the Fire, Building and Code
Enforcement Officials responsible for promoting public safety to
use the most current standards available and to conduct their
operations consistently with the State of Indiana officials
responsible for enforcing fire safety requirements.
SECTION I. Chapter 9, Article 1, Section 9-2, of the South
Bend Municipal Code shall be, and hereby is, amended to read as
follows:
Sec. 9-2. Indiana Fire Code adopted by reference.
The 3-FE; fire code ~~ edition, adopted by reference and
incorporated into Chapter 6 Section 5 of the South Bend Municipal
Code, pursuant to IC 22-13-2-3 (B) , T-T,~~„~
International Code
Council (ICC), together with any and all ~r___=_~~ amendments and
supplements thereto is made a part of this chapter with the same
force and effect as though set out in full herein as the official
fire prevention code of the City of South Bend, Indiana, except for
such changes, additions or deletions as are specified in this
chapter. Copies of such fire code with such
amendments and supplements are on file and open for public
inspection in the offices of the Fire Department, Department of
Code Enforcement, and city clerk's office of the City of South
Bend, Indiana.
SECTION II. This ordinance shall be in full force and
effect from and after its passage by the Common Council, and
approval by the Mayor, and publication as required by law.

Respectfully report that they have examined the matter and that in their opinion, this bill
is being recommended to the full Council with a favorable recommendation as
substituted as follows:
The substituted version will automatically incorporate the fire code used by the Building
Department and the most up to date fire code used by the State of Indiana, without the
need for future amendments to Chapter 9 of the South Bend Municipal Code.

Dear Ms. Pfeifer:
On behalf of the South Bend Fire Department, I am submitting
Substitute Bill No. 5-05 to amend Chapter 9, Section 2 of the South
Bend Municipal Code. The purpose of the substitute bill is to
incorporate into the Municipal Code the most recently adopted fire
code used by the State of Indiana and the St. Joseph County/City of
South Bend Building Department. The difference between the
substitute bill and the original bill submitted is that the
substitute bill will automatically incorporate the fire code used
by the Building Department and the most up to date fire code used
by the State of Indiana, without the need for future amendments to
Chapter 9.
Either Fire Prevention Chief Howard Buchanon or I will present
the bill, and I will be available to address any questions of the
Health and Public Safety Committee. The Fire Department requests
your favorable consideration of this bill. Please feel free to
