RESOLUTION NO. 541
RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
COMMISSION CONCERNING CLOSEOUT OF THE CENTRAL DOWN-
TOWN RENEWAL AREA, PROJECT NO. IN. R -66, AND CON-
CERNING THE ISSUANCE OF BONDS.
WHEREAS, The City of South Bend Department of Redevelopment
has, pursuant to the Redevelopment of Cities and Towns Act
of 1953, as amended, designated as a redevelopment area that
area in the City of South Bend, County of St. Joseph, State
of Indiana, known as the Central Downtown Urban Renewal Area
which is more particularly described by a line drawn as follows:
Beginning at a point formed by the intersection of
the north right -of -way line of LaSalle Avenue and
the west right -of -way line of Main Street; thence
south along the west right -of -way line of Main
Street to the north right -of -way line of Washington
Street; thence west along the north right -of -way line
of Washington Street to the west right -of -way line of
Lafayette Boulevard; thence south along the west right -
of -way line of Lafayette Boulevard to the south right -of-
way line of Jefferson Boulevard; thence east along the
south right -of -way line of Jefferson Boulevard to the
west right -of -way line of Main Street; thence south
along the west right -of -way line of Main Street to the
south right -of -way line of Monroe Street; thence east
along the south right -of -way line of Monroe Street to
the west right -of -way line of Fellows Street; thence south
along the west right -of -way line of Fellows Street to
the south right -of -way line of Monroe Street; thence
east along the south right -of -way line of Monroe Street
and proceeding in a northeasterly direction along said
right -of -way to the center of the St. Joseph River; thence
proceeding in a northwesterly direction along the center
of the St. Joseph River to the north right -of -way line
of LaSalle Avenue; thence west along the north right -of-
way line of LaSalle Avenue to the west right -of -way line
of Main Street which is the point of beginning.
WHEREAS, the LPA has entered into an agreement with the Depart-
ment of Housing and Urban Development of the United States of
America ( "HUD ") known as Contract Indiana R -66 (LG) for the finan-
cing of said project, and
�+ WHEREAS, HUD has by letter dated August 29, 1977, to Peter J.
Nemeth, Mayor, City of South Bend, Indiana, requested the LPA
to adopt a certain resolution concerning the termination of
Contract Indiana R -66 (LG) and the possible financing of certain
development in the Project Area by the issuance of bonds;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND REDEVEL-
OPMENT COMMISSION, THE GOVERNING BODY OF THE CITY OF SOUTH BEND
DEPARTMENT OF REDEVELOPMENT:
1. That the LPA hereby agrees to cooperate in every way
with HUD and to do every act necessary to close out
and terminate Contract R -66 (LG) by August of 1978.
2. That, in the event grants are not available under the
United Mass Transportation Act and the Economic Devel-
opment Act for necessary development of the Project
Area, the LPA will perform every act necessary to issue
and sell its general obligation bonds as permitted by
law.
Adopted at the Regular Meeting of the South Bend Redevelopment
Commission held on September 16, 1977, at the Office of the
Commission, 1200 County -City Building, 227 W. Jefferson Blvd.,
South Bend, Indiana 46601.

THE UNDERSIGNED hereby certifies that:
He is the duly qualified and acting Secretary of the City of South
Bend Redevelopment Commission (herinafter called "Governing Body "), the
governing body of the City of South Bend Department of Redevelopment (herein-
after called "Local Public Agency ") and the custodian of the records of the
Governing Body, including the minutes of its proceedings; and is duly authorized
to execute this certificate.
Attached hereto is a true and exact copy of a Resolution 541;
RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION
CONCERNING CLOSEOUT OF THE CENTRAL DOWNTOWN RENEWAL AREA, PROJECT
NO. IN. R -66, AND CONCERNING THE ISSUANCE OF BONDS.
adopted at a meeting of the Governing Body held on the 16th day of September,
1977. Said Resolution has been duly recorded in the minutes of said meeting and is
now in full force and effect.
Said meeting was duly convened and held in all respects in accordance
with the law and the by -laws of the Local Public Agency. To the extent
required by law and said by -laws, due and proper notice of said meeting was given.
A legal quorum of members of the Governing Body was present throughout said meeting,
and a legally sufficient number of members of the Governing Body voted in the
proper manner for the adoption of said Resolution. All other requirements and
proceedings under applicable law, said by -laws, or otherwise, incident to the
proper adoption of said Resolution, including any publication, if required by
law, have been duly fulfilled, carried out, and otherwise observed.
