No. 533 with respect to the LaSalle Park Project, IN R-57, and for making certain changes to the Urban Renewal Plani 0 RESOLUTION NO. 535 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION CONFIRMING RESOLUTION NO. 533 WITH RESPECT TO THE LASALLE PARK PROJECT, IN R -57, AND FOR MAKING CERTAIN CHANGES TO THE URBAN RENEWAL PLAN. WHEREAS, the City of South Bend, Department of Redevelopment has, pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended, investigated and studied that area of the City of South Bend, County of St. Joseph, State of Indiana, designated as the LaSalle Park Project, IN R -57, which area is bounded by a line drawn as follows: Beginning at the point of intersection of the north right -of -way line of Linden Avenue and a line which is an extension of the west right -of -way line of the alley between and parallel to Sheridan Avenue and Chicago Street; proceed east along the north right-of- way line of Linden Avenue to a point 129.0 feet, more or less, east of the east right -of -way line of Falcon Street; thence south along a line which is 129.0 feet, more or less, east of and pa- rallel to the east right -of -way line of Falcon Street, a distance of 388.3 feet, more or less; thence at 90 degrees in a westerly direction a distance of 129.0 feet, more or less, to the east right -of -way line of Falcon Street; thence south along said right -of -way line a distance of 485.7 feet, more or less; thence at 90 degrees in an easterly direction a distance of 129.0 feet more or less, to the west right -of -way line of the alley between and parallel to Falcon Street and Lake Street; thence south along said alley right -of -way line a distance of 116.0 feet, more or less; thence at 90 degrees in an easterly direction a distance of 203.0 feet, more or less, to the east right -of -way line of Lake Street; thence south along said right -of -way line a dis- tance of 50.0 feet, more or less; thence at 90 degrees in an easter- ly direction a distance of 793.0 feet, more or less, to the west right -of -way line of the alley between and parallel to Kentucky Street and Dundee Street; thence south along said alley right - of -way line a distance of 250.0 feet, more or less; thence at 90 degrees in an easterly direction along a line north of and pa- rallel to the north right -of -way line of Washington Street, to the west right -of -way line of the alley west of and parallel to Kaley Street; thence north along said alley right -of -way line to the south right -of -way line of the New York Central Railroad; thence southeasterly along said right -of -way line to the east right -of -way line of the first alley east of and parallel to Meade Street; thence south along said alley right - of-way line to the center line of the first alley north of and parallel to Western Avenue; thence west along said alley center line to the west right -of -way line of the alley between and parallel to She- ridan Avenue and Chicago Street; thence north along said alley right -of -way line to the north right -of -way line of Linden Ave- nue which is the place of beginning. WHEREAS, upon such investigation being made it has been found by the Board of Commissioners of said Department that such area has become blighted to an extent that such condition cannot be corrected -by regula- tory process, or by the ordinary operations of private enterprise with- out resort to the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended, and it has been further found that the public health and welfare would be benefited_' by the acquisition and redevelop- ment of such area under the provisions of such act; and - 1 - r WHEREAS, the Board of Commissioners has caused to be prepared maps and plans showing the boundaries of such blighted area, the lo- cation of the various parcels of properties, streets and alleys and other features affecting the acquisition, clearance, replanning and redevelopment of such area, indicating the parcels of property to be excluded from acquisition and portion of the area acquired which are to be devoted to streets, parks, playground, and other public purposes under the redevelopment plan, and further studies have shown the ne- cessity of deleting certain parcels from the acquisition list in or- der to update the Urban Renewal Plan to current market conditions; and WHEREAS, the Board of Commissioners did on September 17, 1976, adopt Resolution No. 533 redeclaring, among other things, that the above described area is blighted and constitutes a menace to the social and economic interests of the City and its inhabitants and that it will be of public utility and benefit to acquire such area and redevelop the same under the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended, and approved the changes in the Urban Renewal Plan as presented in connection with said Resolution; and WHEREAS, the Board of Commissioners did on the October 15, 1976, hold a public hearing for the purpose of presenting said Resolution No. 533 and the plan changes approved therein to the public and to hear remonstrances, if any, concerning said changes; and WHEREAS, said Redevelopment of Cities and Towns Act of 1953, as amended, requires that the Board of Commissioners confirm said Resolution No. 533; and NOW, THEREFORE, BE IT RESOLVED by the City of South Bend Rede- velopment Commission that it will be of public utility and benefit to proceed with the plan of redevelopment as set forth in Resolution No. 533 passed by the Commission on September 1 7, 1976, referred to in WHEREAS clauses above, and that said Resolution No. 533 is now hereby approved, ratified and confirmed, including the changes in the Urban Renewal Plan as presented in connection with the Urban Renewal Plan.
