RESOLUTION NO. 533
RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION RE-
DECLARING THE LASALLE PARK RENEWAL AREA TO BE BLIGHTED AND RE-
APPROVING AN URBAN RENEWAL PLAN FOR PROJECT NUMBER INDIANA R -57
AND FOR THE MAKING OF CERTAIN CHANGES TO THE URBAN RENEWAL PLAN
WHEREAS, the City of South Bend, Department of Redevelopment, pursuant to the
Redevelopment of Cities and Towns Act of 1953, as amended, conducted surveys
and investigations and thoroughly studied the area in the City of South Bend,
County of St. Joseph, State of Indiana, designated as the LaSalle Park Urban
Renewal Area which is more particularly described by a line drawn as follows:
Beginning at the point of intersection of the north right -of -way
line of Linden Avenue and a line which is an extension of the west
right -of -way line of the alley between and parallel to Sheridan
Avenue and Chicago Street; proceed east along the north right -of-
way line of Linden Avenue to a point 129.0 feet, more or less,
east of the east right -of -way line of Falcon Street; thence south
along a line which is 129.0 feet, more or less, east of and parallel
to the east right -of -way line of Falcon Street, a distance of 388.3
feet, more or less; thence at 90 degrees in a westerly direction
a distance of 129.0 feet, more or less, to the east right -of -way
line of Falcon Street; thence south along said right -of -way line
a distance of 485.7 feet, more or less; thence at 90 degrees in
an easterly direction a distance of 129.0 feet, more or less, to
the west right -of -way line of the alley between and parallel to
Falcon Street and Lake Street; thence south along said alley right -
of -way line a distance of 116.0 feet, more or less; thence at 90
degrees in an easterly direction a distance of 203.0 feet, more
or less, to the east right -of -way line of Lake Street; thence
South along said right -of -way line a distance of 50.0 feet, more
or less; thence at 90 degrees in an easterly direction a distance
of 793.0 feet, more or less, to the west right -of -way line of the
alley between and parallel to Kentucky Street and Dundee Street;
thence south along said alley right -of -way line a distance of 250.0
feet, more or less; thence at 90 degrees in an easterly direction
along a line north of and parallel to the north right -of -way line
of Washington Street, to the west right -of -way line of the alley
west of and parallel to Kaley Street; thence north along said
alley right -of -way line to the south right -of -way line of the
New York Central Railroad; thence southeasterly along said right -
of -way line to the east right- of,way line of the first alley east
of and parallel to Meade Street; thence south along said alley
right -of -way line to the center line of the first alley north of
and parallel to Western Avenue; thence west along said alley center
line to the west right -of -way line of the alley between and parallel
to Sheridan Avenue and Chicago Street; thence north along said
alley right -of -way line to the north right -of -way line of Linden
Avenue which is the place, of beginning.
WHEREAS, upon such surveys, investigations and studies made, it has been found
by the City of South Bend Redevelopment Commission that the above - described
area is blighted to an extent that such blighted conditions cannot be corrected
by regulatory process, or by the ordinary operations of private enterprise
without resort to the provisions of the Redevelopment of Cities and Towns Act
of 1953, as amended, and it has been further found that the public health
and welfare would be benefited by the acquisition and redevelopment of such
area under the provisions of such Act; and
WHEREAS, the Commissioners have caused to be prepared maps and plans showing
the boundaries of such blighted area, the location of the various parcels of
properties, streets and alleys and other features affecting the acquisition,
clearance, replanning and redevelopment of such area, and indicating the parcels
of property to be included in the acquisition and portions of the area acquired
which are to be devoted to streets, parks, playground, and other public purposes
under the redevelopment plan; and
WHEREAS, certain parcels have not yet been acquired and the Redevelopment
Commission has determined that the acquisition of these parcels will in no
way further the rehabilitation of the LaSalle Park Project Area and therefore,
these acquisition parcels should not be acquired; and
WHEREAS, it is necessary to delete these acquisition parcels from the acquisition
list attached of the LaSalle Park Urban Renewal Plan in order to complete the
Project activities; and
WHEREAS, in connection with an application of the City of South Bend, Department
of Redevelopment to the Secretary of the Department of Housing and Urban De-
velopment for financial assistance under Title I of the Housing Act of 1949,
as amended, the approval by the Governing Body of the City of South Bend,
Department of Redevelopment, of an Urban Renewal Plan for the project area
involved in such application is required by the Federal Government before
it will enter into a contract for loan or grant with the City of South Bend,
Department of Redevelopment, under Title I; and
WHEREAS, there was presented to this meeting of the Governing Body of the City
of South Bend, Department of Redevelopment, for its consideration and approval,
a copy of the amended pages of the Urban Renewal Plan for the project area in
the land use provisions, which plan is entitled,
"URBAN RENEWAL PLAN
LASALLE PARK URBAN RENEWAL AREA NO. 1
PROJECT NO. IND. R -57
SOUTH BEND, INDIANA"
WHEREAS, the proposed changes to said Plan and the conditions under which the
Local Public Agency was reviewed and considered at the meeting; and
WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the
Department of Housing and Urban Development effectuating that title, provide
that no person shall, on the ground of race, color, sex, or national origin,
be excluded from participation in, be denied the benefits of, or be subjected
to discrimination in the undertaking and carrying out of urban renewal projects
assisted under Title I of the Housing Act of 1949, as amended:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION,
GOVERNING BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT:
1. That the LaSalle Park Urban Renewal Area, which is described in the first
"WHEREAS" clause hereof, is blighted and constitutes a menace to the social
and economic interest of the City of South Bend and its inhabitants and
that it will be of public utility and benefit to acquire such area and
redevelop the same under the provisions of the Redevelopment of Cities
and Towns Act of 1953, as amended.
2. That an amendatory application in behalf of the City of South Bend, Department
of Redevelopment deleting from the acquisition list of the LaSalle Park
Urban Renewal Plan those acquisition parcels not yet acquired, which are

specifically enumerated on Attachment "A" which is attached hereto and
rw incorporated by reference herein, and amending the Cost Estimate and
Financing Plan and the Project Expenditure Budget to reflect the decrease
in expenditures caused by this deletion is hereby approved and that
the Executive Director is hereby authorized and directed to execute and
file such application with the Department of Housing and Urban Development,
to provide such additional information and to furnish such documents as
may be required in behalf of this Department and to act as the authorized
correspondent of the City of South Bend, Department of Redevelopment.
3. That the Urban Renewal Plan, together with the proposed amendments
thereto, is hereby in all respects approved and the Secretary is hereby
directed to file a certified copy of said Urban Renewal Plan, with proposed
amendments, with the minutes of this meeting.
4. That the United States of America and the Secretary of the Department of
Housing and Urban Development be, and they hereby are, assured of full
compliance by the City of South Bend, Department of Redevelopment, with
regulations of the Department of Housing and Urban Development effectuating
Title VI of the Civil Right Act of 1964.
Adopted at the Regular Meeting of the South Bend Redevelopment Commission held
at the Office of the Department of Redevelopment, 1200 County -City Building,
227 W. Jefferson Blvvd., South Bend, Indiana on the 17th day of September,
1976.

RESOLUTION NO. 40
RESOLUTION OF THE AREA PLAN COMMISSION OF ST.
JOSEPH COUNTY, INDIANA, DETERMINING THAT A
DECLARATORY RESOLUTION AND CERTAIN CHANGES TO
CERTAIN PAGES OF AN URBAN RENEWAL PLAN FOR IND.
R -57 APPROVED AND ADOPTED BY THE CITY OF SOUTH
BEND REDEVELOPMENT COMMISSION CONFORMS TO THE
MASTER PLAN OF THE CITY OF SOUTH BEND, AND
APPROVING THAT RESOLUTION AND THE URBAN RENEWAL
PLAN AS AMENDED.
WHEREAS, in connection with an application of the City
of South Bend Department of Redevelopment to the Department of
Housing and Urban Development Administrator for financial assis-
tance under Title I of the Housing Act of 1949, as amended, the
approval of the Governing Body of the Locality in which the proj-
ect is situated of an Urban Renewal Plan for the project area in
such application is required by the Federal Government before it
will enter into a contract for loans and grants with the City
of South Bend Department of Redevelopment under said Title I;
and
WHEREAS, the Governing Body of the Locality, under the
provisions of the Redevelopment of Cities and Towns Act of 1953,
as amended, may give its,approval of the Urban Renewal Plan only
after the Plan Commission of the Locality has issued its written
order approving a Declaratory Resolution which among other things
approves additional real estate acquisition and certain land use
changes to the Urban Renewal Plan approved and adopted by the Re-
development Commission of the Locality; and
WHEREAS, the City of South Bend Redevelopment Commission
has approved and adopted a Declaratory Resolution and an Urban
Renewal Plan, certain pages of which Plan have been changed or
amended, with respect to the LaSalle Park Project which is
known as Project No. Indiana R -57 and is identified in said Reso-
lution and Plan, and has submitted said Resolution and Plan to the
Area Plan Commission of St. Joseph County, both of which are
attached hereto and are made a part hereof.
NOW, THEREFORE, BE IT RESOLVED by the Area Plan Commission
of St. Joseph County, Indiana, as follows:
1. That the Urban Renewal Plan, as amended, for the
LaSalle Park Project conforms to the Master Plan of
Development for the City of South Bend.
2. That the Urban Renewal Plan, as amended, for the
LaSalle Park Project is in all respects approved, ratified
and confirmed.
3. That Resolution #533 of the South Bend Redevelopment
Commission with respect to the LaSalle Park Project
is in all respects approved, ratified and confirmed.
4. That the Secretary is hereby directed to file a copy
of said Declaratory Resolution and certain pages
amending the Urban Renewal Plan with the minutes of this
meeting.
Passed by the Area Plan Commission of St. Joseph County,
Indiana, one September 21, 1976.
