HomeMy WebLinkAboutNo. 0526 authorizing the filing of Amendatory Application for loan and grant, Project IN R-66RESOLUTION NO. 526 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION AUTHORIZING THE FILING OF AMENDATORY APPLICATION FOR LOAN AND GRANT, PROJECT IN R -66. WHEREAS it is necessary and in the public interest that the South Bend, Indiana, Department of Redevelopment avail itself of the financial assistance provided by Title I of the Housing Act of 1949, as amended, to carry out the urban renewal project described as Central Downtown Project, IN R -66, hereinafter referred to as the "Project ", which is more particularly described by a line drawn as follows: Beginning at a point formed by the intersection of the north right -of -way line of LaSalle Avenue and the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the north right -of -way line of Washington Street; thence west along the north right -of -way line of Washington Street to the west right -of -way line of Lafayette Boulevard; thence south along the west right -of -way line of Lafayette Boulevard to the south right -of -way line of Jefferson Boulevard; thence east along the south right -of -way line of Jefferson Boule- vard to the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the south right -of -way line of Monroe Street; thence east along the south right of way line of Monroe Street to the west right -of -way line of Fellows Street; thence south along the west right -of -way line of Fellows Street to the south right -of -way line of Monroe Street; thence east along the south right -of -way line of Monroe Street and proceeding in a northeasterly direction along said right -of -way to the center of the St. Joseph River; thence proceeding in a northwesterly direction along the center of the St. Joseph River to the north right -of -way line of LaSalle Avenue; thence west along the north right - of -way line of LaSalle Avenue to the west right -of -way line of Main Street which is the point of beginning. WHEREAS it is recognized the the Federal contract for such financial assistance pursuant to said Title I imposes certain obligations and responsibilities upon the Local Public Agency and requires among other things (1) the provision of local grants - in -aid; (2) a feasible method for the relocation of individuals and families displaced from the project area; and (3) other local obligations and responsibilities in connection with the under- taking and carrying out of urban renewal projects; and WHEREAS Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin under any program or activity receiving Federal financial assis- tance and Executive Order 11063 prohibits discrimination on the basis of race, color, creed or national origin in sale, lease or other disposition of residential property (including land in- tended for residential use) or in the use or occupancy thereof; and WHEREAS the objectives of the Urban Renewal Plan cannot be achieved through rehabilitation of the Project area: NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE LPA: 1. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the LPA with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders. 2. That an amendatory application on behalf of the LPA for a loan under Section 102(a) of said Title I and for a project capital grant, a relocation grant, and a Federal grant for the making of rehabilitation grants to the full amount avail- able for undertaking and financing the Project is hereby approved, and that the Executive Director of the LPA is hereby authorized and directed to execute and to file such amendatory application with the Department of Housing and Urban Development, to provide such additional information and to furnish such documents as may be required in behalf of said Department, and to act as the author- ized correspondent of the LPA. Adopted at the Regular Meeting of the South Bend Redevelopment Commission, held on July 1, 1976, at the Office of the Commission, 1200 County -City Building, 227 W.
