NOWAK RECORDER RESOLUTION NO. 524 &R 6 v 35'P X84 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT ST JOSEPH CO. COMMISSION CONFIRMING RESOLUTION 522 WITH RESPECT z TO THE CENTRAL DOWNTOWN PROJECT, IN R -66 AND FOR I NDIANA MAKING CERTAIN CHANGES TO THE URBAN RENEWAL PLAN. FILED FOR RECORD WHEREAS, the City of South Bend, Department of Redevelopment has, pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended, investigated and studied that area of the City of South Bend, County of St. Joseph, State of Indiana, designated as the Central Downtown Project, IN R -66, which area is bounded by a line drawn as follows: Beginning at a point formed by the intersection of the north right -of -way line of LaSalle Avenue and the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the north right - of -way line of Washington Street; thence west along the north right -of -way line of Washington Street to the west right -of -way line of Lafayette Boulevard; thence south along the west right -of -way line of Lafayette Boulevard to the south right -of -way line of Jefferson Boulevard; thence east along the south right -of -way line of Jefferson Boulevard to the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the south right -of -way line of Monroe Street; thence east along the south right -of -way line of Monroe Street to the west right -of -way line of Fellows Street; thence south along the west right -of -way line of Fellows Street to the south right -of -way line of Monroe Street; thence east along the south right -of -way line of Monroe Street and proceeding in a northeasterly direction along said right -of -way line to the center of the St. Joseph River; thence proceeding in a northwesterly direction along the center of the St. Joseph River to the north right -of -way line of LaSalle Avenue; thence west along the north right -of -way line of LaSalle Avenue to the west right -of -way line of Main Street, which is the point of beginning. WHEREAS, upon such investigation being made it has been found by the Board of Commissioners of said Department that such area has become blighted to an extent that such condition cannot be corrected by regulatory process, or by the ordinary operations of private enterprise without resort to the provisions of the Re- development of Cities and Towns Act of 1953, as amended, and it has been further found that the public health and welfare would be benefitted by the acquisition and redevelopment of such area under the provisions of such act; and WHEREAS, the Board of Commissioners has caused to be prepared maps and plans showing the boundaries of such blighted area, the location of the various parcels of properties, streets and alleys and other features affecting the acquisition, clearance, replanning and redevelopment of such area, indicating the parcels of property to be excluded from acquisition and portion of the area acquired which are to be devoted to streets, parks, playground, and other public purposes under the redevelopment plan, and further studies have shown the necessity of adding certain parcels to the acquisition list due to the nonfeasibility of rehabilitation and for the making of certain changes in the land use provision in Block 6 in order to update the Urban Renewal Plan to current market conditions; and WHEREAS, the Board of Commissioners did on May 7, 1976, adopt Resolution 522 redeclaring, among other things, that the above des- cribed area is blighted and constitutes a menace to the social and ;J s� economic interests be of public utili the same under the Towns Act of 1953, Urban Renewal Plan and 8401039 of the City and its inhabitants and that it will ty and benefit to acquire such area and redevelop provisions of the Redevelopment of Cities and as amended, and approved the changes in the as presented in connection with said Resolution; WHEREAS, the Board of Commissioners did on this June 4, 1976, hold a public hearing for the purpose of presenting said Resolution 522 and the plan changes approved therein to the public and to hear remonstrances, if any, concerning said changes; and WHEREAS, said Redevelopment of Cities and Towns Act of 1953, as amended, requires that the Board of Commissioners confirm said Resolution 522; and WHEREAS, said Resolution 522, in the title thereof inadver- tently referred to "Minor" changes to the Urban Renewal Plan and said word "Minor" should be deleted from said title; NOW, THEREFORE, BE IT RESOLVED by the City of South Bend Redevelopment Commission that Resolution 522 is amended by dele- tion of the word "Minor" from the title thereof, that it will be of public utility and benefit to proceed with the plan of redevelopment as set forth in Resolution 522 passed by the Commission on May 7, 1976, referred to in WHEREAS clauses above, and that said Resolution 522 is now hereby approved, ratified and confirmed, including the changes in the Urban Renewal Plan as presented in connection with the Urban Renewal Plan.
