RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT
OF REDEVELOPMENT AUTHORIZING THE FILING OF AN
AMENDATORY APPLICATION FOR AN EARLY CLOSEOUT
GRANT AND INCREASED CAPITAL GRANT FOR PROJECT
IND. R -57 AND TO INCORPORATE POOLING ARRANGEMENT
WITH PROJECT IND. R -66
WHEREAS, it is necessary and in the public interest that the City of South
Bend, Department of Redevelopment avail itself of the financial assistance
provided by Title I of the Housing Act of 1949, as amended, to carryout the
urban renewal project described as the LaSalle Park Urban Renewal Area, and
bounded generally as follows:
LaSalle Park Project bounded on the west by the alley
west of Chicago; bounded on the south by the alley
north of Western; bounded on the east by the alley
_ east of Meade; bounded on the north by Kankakee
Avenue, Washington Street, the LaSalle Park Beck's
Lake Park Area, and Linden Street.
hereinafter referred to as the "Project "; and
WHEREAS, it is recognized that the Federal contract for such financial
assistance, pursuant to said Title I, will impose certain obligations and
responsibilities upon the Local Public Agency and will require among other
things: (1) the provision of local grants -in -aid; (2) feasible method for
the relocation of individuals and families displaced from the project area;
and (3) other local obligations and responsibilities in connection with the
undertaking and carrying out of urban renewal projects; and
WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations of
the Department of Housing and Urban Development effectuating that Title,
provide that no person shall, on the ground of race, color, sex, or national
origin, be excluded from participation in, be denied the benefits of, or be
subject to discrimination in the undertaking and carrying out of the urban
renewal projects assisted under Title I of the Housing Act of 1949, as
amended; and

WHEREAS, the objectives of the Urban Renewal Plan cannot be achieved through
more extensive rehabilitation of the Project Area; and
WHEREAS, Section 106 (i) of the Housing Act of 1949, as amended recently by
Section 213 of the Housing and Urban Development Act of 1970, provides for
an early closeout grant and increased capital grant for the early closeout
of an urban renewal project if it has been determined that early closeout is
in the financial interest of the federal government based upon a projection
of future operating expenses exceeding the current fair reuse value of unsold
project land, and if the LPA does not expect to be able in the reasonable near
future, due to circumstances beyond its control, to dispose of the remaining
project land and if all other project activities are completed except non -cash
local grant -in -aid activities designated in the third provision to Section 110
(d) under the conditions specified therein; and
WHEREAS, the LPA has not provided the full amount of its share in local grants -
in -aid and that to rectify such shortages the federal government permits the
pooling of local grants -in -aid with another local project which has an amount
of local grants -in -aid in excess of its required one -third (1/3) share;
NOW THEREFORE, BE IT RESOLVED by the City of South Bend, Redevelopment Commission:
1. That the United States of America and the Secretary of Housing and Urban
Development be, and they hereby are, assured of full compliance by the

City of South Bend, Department of Redevelopment with regulations of
the Department of Housing and Urban Development effectuating Title VI
of the Civil Rights Act of 1964 and applicable Executive Orders.
2. That due to the fact that a large portion of unsold project land is
muck soil rendering it unbuildable and making it difficult to sell and
that all other project activities except non -cash local grant -in -aid
activities will be completed by September 30, 1973, a request for an
early closeout grant is in order because a projection of future
operating expenses would exceed the current fair reuse value of unsold
project land.
3. That an amendatory application on behalf of the City of South Bend
Department of Redevelopment for a loan under Section 102 (a) and
Section 106 (i) of Title I, referred to in the first WHEREAS clause
of this resolution, as amended by Section 213 of the Housing and Urban
Development Act of 1970, in the amount of $4,791,092 and for a Project
Capital Grant, including an early closeout grant and increased capital
grant and for a rehabilitation grant and a relocation grant to the full
amount available for undertaking and financing the project, is hereby
approved and that the Executive Director is hereby authorized and
directed to execute and to file such application with the Department of
Housing and Urban Development, to provide such additional information
and to furnish such documents as may be required in behalf of said
Department, and to act as the authorized correspondent of the City of
South Bend, Department of Redevelopment.
4. That said amendatory application for a loan of $4,791,092 incorporates
a pooling arrangement of local grants -in -aids between Projects Ind. R -57
and Ind. R -66 because the LPA has not provided its full share of local
grants -in -aid but there is an amount of local grants -in -aid in excess of
the one -third (1/3) local share provided for Project Ind. R -66, such
excess being sufficient to cover the shortage in R -57.
Adopted at the regular meeting of the City of South Bend Redevelopment Commission
held at the office of the Department of Redevelopment, 1200 County -City Building,
227 West Jefferson Boulevard, South Bend, Indiana on the 7th day of September, 1973.
