RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
COMMISSION DECLARING, CONFIRMING AND DELINEATING
THE NEIGHBORHOOD DEVELOPMENT PROJECT AREA (S) (MN #1)
MODEL NEIGHBORHOOD AREA # 1 AND (SE # 1) SOUTHEAST
s NEIGHBORHOOD AREA # 1 TO BE BLIGHTED AND APPROVING
AN URBAN RENEWAL PLAN AND CONDITIONS UNDER WHICH RE-
LOCATION PAYMENTS WILL BE MADE FOR PROJECT NUMBER
IND. A -10
WHEREAS, the City of South Bend Department of Redevelopment has, pursuant
to the Redevelopment of Cities and Towns Act of 1953, as amended, con-
ducted surveys and investigations and has thoroughly studied that area
in the City of South Bend, County of St. Joseph, State of Indiana, de-
signated as the Neighborhood Development Project, Indiana A -10, First
Year Action Area, which is more particularly described as follows:
Neighborhood Development Project Area Indiana A -10
located in the City of South Bend, County of St. Joseph,
State of Indiana with the first year action areas as
follows:
(W Model Neighborhood # 1
Beginning at a point on the southerly right -of -way line
of Orange Street and the westerly right -of -way line of
Olive Street; thence in a northerly direction along the
westerly right -of -way line of Olive Street to the north-
erly right -of -way line of Linden Avenue; thence in an
easterly direction along the northerly right -of -way line
of Linden Avenue to the easterly right -of -way line of
Sadie Street; thence in a southerly direction along the
easterly right -of -way line of Sadie Street to the south-
erly right -of -way line of Orange Street; thence in a
westerly direction along the southerly right -of -way line
of Orange Street to the westerly right -of -way line of
Olive Street which is the place of beginning, contain-
ing approximately 319,000 sq. ft.
Southeast Neighborhood Area # 1 Part of the Northwest
1/4 of section 13, Township 37 North, Range 2 East in
the City of South Bend, Indiana, more particularly des-
cribed as follows:
Beginning at the intersection of the West line of the
North -South alley adjacent and East of lots AF, AG and
AH in the Plat of the Commissioner's Subdivision of Lots
1 and C and the North line of Paris Street; thence south-
erly along the West line of said north -south alley ex-
tended to the south line of the east -west alley between
Paris Street and Pennsylvania Street; thence easterly along
the south line of said east -west alley to the intersection
of the east line of the north -south alley adjacent and
east of lot 73 in the Plat of Elder Place extended south-
erly; thence northerly along the east line of said north -
south alley extended southerly and the east line of the north -
south alley adjacent and east of lots 73, 52, 35, and 19 in
the Plat of Elder Place to the intersection with the north
line of the east -west alley adjacent and north of said lot
19 extended easterly; thence westerly along the north line
of said east -west alley extended and the north line of the
east -west alley adjacent and north of lots 2 through 19 in
the Plat of Elder Place and the north line of said east -
west alley extended westerly to the intersection with the
west line of the north -south alley adjacent and east of lots
AF, AG, and AH in the Plat of the Commissioner's Subdivision
of lots 1 and C extended northerly; thence southerly
along the west line of said north -south alley extended
northerly and the west line of said north -south alley
to the point of beginning, containing approximately
481,000 sq. ft.
WHEREAS, upon such surveys, investigations and studies being made, it
has been found by the City of South Bend Redevelopment Commission that
the above described area has become blighted to an extent that such
blighted conditions cannot be corrected by regulatory process, or by
the ordinary operations of private enterprise without resort to the
provisions of the Redevelopment of Cities and Towns Act of 1953, as
amended, and it has been further found that the public health and wel-
fare would be benefited by the acquisition and redevelopment of such
area under the provisions of such Act; and
WHEREAS, such findings have been made by the Commissioners by Resolution
No. 445, adopted at a regular meeting of the Commissioners held on
April 6, 1973; and
WHEREAS, the Commissioners have caused to be prepared maps and plans
showing the boundaries of such blighted areas, the location of the
various parcels of properties, streets and alleys and other features
affecting the acquisition, clearance, replanning and redevelopment of
such area, and indicating the parcels of property to be included in the
acquisition and portions of area acquired which are to be devoted to
streets, parks, playground, and other public purposes under the redevel-
opment plan; and
WHEREAS, the Commissioners have caused to be prepared a schedule of aver-
age gross rentals for standard housing within the City of South Bend, a
schedule of fixed relocation payments, and a schedule of average sale
prices for standard housing by bedroom size for use in the displaced
housing payment; and
WHEREAS, in connection with an application of the City of South Bend De-
partment of Redevelopment to the Secretary of the Department of Housing
and Urban Development for financial assistance under Title I of the
Housing Act of 1949, as amended, the approval by the Governing Body of
the City of South Bend Department of Redevelopment of an Urban Renewal
Plan for the project area involved in such application is required by the
Federal Government before it will enter into a contract for loan or grant
with the City of South Bend Department of Redevelopment under Title I; and
WHEREAS, the rules and regulations prescribed by the Federal Government
pursuant to Title I require that the conditions under which the City of
�✓ South Bend Department of Redevelopment will make Relocation Payments in
connection with the Urban Renewal Project contemplated by the application
be officially approved by the Governing Body of the City of South Bend
Department of Redevelopment; and
WHEREAS, there was presented to this meeting of the Governing Body of
the City of South Bend Department of Redevelopment for its consideration
and approval, a copy of an Urban Renewal Plan for the project area dated
April 6, 1973, which plan is entitled,

SOUTH BEND, INDIANA"
and consists of 88 pages and a set of conditions under which the City of
South Bend Department of Redevelopment will make Relocation Payments, which
set of conditions is set forth in the Relocation Plan attached hereto and
marked for the Urban Renewal Project contemplated by the application; and
WHEREAS, the Urban Renewal Plan and the conditions under which the Local
Public Agency will make Relocation Payments were reviewed and considered
at the meeting; and

WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations
of the Department of Housing and Urban Development effectuating that
IL title, provide that no person shall, on the ground of race, color, sex,
or national origin, be excluded from participation in, be denied the
benefits of, or be subjected to discrimination in the undertaking and
carrying out of urban renewal projects assisted under Title I or the
Housing Act of 1949, as amended, as well as other Civil Rights Acts and
Presidential Executive orders:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND REDEVELOPMENT
COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF RE-
DEVELOPMENT:
1. That the (MN #1) Model Neighborhood X61 and (SE #1) Southeast
Neighborhood # 1 of the Neighborhood Development Project
Area, which are described in the first "WHEREAS" clause
hereof, are blighted, deteriorated and deteriorating, and
constitute a menace to the social and economic interest of
the City of South Bend and its inhabitants, that said areas
are designated as urban renewal project areas, and that it
will be of public utility and benefit to acquire such areas
and redevelop the same under the provisions of the Redevel-
opment of Cities and Towns Act of 1953, as amended.
2. That the Department of Redevelopment confirms that it pro-
poses to acquire that land and the interests therein within
aforementioned boundaries as designated in the Urban Renewal
Plan and under the conditions set out therein.
3. That it is estimated that the cost of acquiring the properties
in the area will be $271,235.
4. That the schedule of average gross rentals for standard prop-
erty within the City of South Bend, that the fixed relocation
payment schedule and the schedule of average sale prices for
use in displaced housing payments is hereby, in all respects,
approved and the Secretary is hereby directed to file certi-
fied copies of these schedules as a part of the Relocation Plan.
5. That the conditions under which the City of South Bend Depart-
ment of Redevelopment will make the relocation payments are
hereby, in all respects, approved.
6. That it is hereby found, determined, and confirmed that the
objectives of the Urban Renewal Plan cannot be achieved
through more extensive rehabilitation of the Project Area.
7. That approval of the Urban Renewal Plan is hereby in all res-
pects confirmed.
8. That the United States of America and the Secretary of the De-
partment of Housing and Urban Development be, and they hereby
are, assured of full compliance by the City of South Bend De-
partment of Redevelopment with regulations of the Department
of Housing and Urban Development effectuating Title VI of the
Civil Rights Act of 1964, other Civil Rights Acts and Presi-
dential Executive orders.
Adopted at the Regular Meeting of the South Bend Redevelopment Commission
held on July 20, 1973, at the office of the Commission, 1200 County -City
Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
