J 5 b ~ ~ ~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING A NEW SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE CITY OF SOUTH BEND WATER WORKS AND AMENDING CHAPTER 17, ARTICLE 4, SECTIONS 17-45 AND 17-46 OF THE SOUTH BEND MUNICIPAL CODE STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana last established a schedule of rates and charges for services rendered by the Water Works by Ordinance No. 9246-01 which was passed on August 27, 2001. Crowe Chizek, a financial consultant to the Board of Public Works, has carefully reviewed the City's rates and charges and has determined that an increase in such rates and charges is necessary to continue to provide quality services. The Common Council has determined that in order to meet the statutory requirements as provided in Indiana Code Section 8-1.5-3-8, it is necessary that the rates and charges be increased for services rendered by the Water Works of the City of South Bend. The Common Council further notes that such rate and charge increases will require the approval of the Indiana Utility Regulatory Commission of the State of Indiana. NOW, THEREFORE, BELT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. Chapter 17, Article 4, Section 17-45 of the South Bend Municipal Code shall be, and hereby is, amended to read in its entirety as follows: Sec. 17-45. Water Works rates and charges. Metered water charges shall be the larger of the minimum charges of subparagraph (b) and the rate charges of subparagraph (a) of this Section. In the case of multiple meters under a single billing entity, the charges shall be computed for each meter separately, not the summation of usage. Temporary service, where metered, shall be calculated upon the registration of a meter or meters installed at the approved meter rates. In such cases as the Utility may deem it impractical to install a meter for temporary service, there shall be a minimum monthly charge of - twenty nine dollars and fift cy ents ($~:6@ 29.50. If the water consumption computed at approved rates is known to be in excess of the - twent nine dollars and fifty cents ($x:96- 29.50) minimum charge, an authorized agent of the Utility shall have the right to estimate said water usage and the estimated usage shall be billed at the approved meter rates. Section II. Chapter 17, Article 4, Section 17-46.1 of the South Bend Municipal Code shall be, and hereby is, amended to read in its entirety as follows: Sec. 17-46.1. Suburban rates. Customers with water service outside the City limits shall incur an additional surcharge of twenty percent (20°Io) of the rates and charges. The surcharge is to recover additional costs including capital expenditures incurred by the Water Works to furnish services to customers outside the City limits. Section III. Chapter 17, Article 4, Section 17-46.3 of the South Bend Municipal Code shall be, and hereby is, amended to read in its entirety as follows: Sec. 17-46.3. Bulk sales charges. Sales tanker trucks or other bulk users shall be metered or estimated where metering is not feasible and the rates and charges shall apply except there shall be a minimum charge of twenty four dollars ($24.00) per month. Section IV. All Ordinances in conflict with the provision of this Ordinance are repealed upon this Ordinance becoming effective as set forth in Section V herein. -3- Section V. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and legal publication; provided, however, that this Ordinance shall not become effective except to the extent the schedule of rates and charges as set forth herein have been approved by the Indiana Utility Regulatory Commission, and all existing rates and charges of Ordinance No. $$9~}8~ 9246-01 shall continue in effect until such approval.
