II 8401033 RESOLUTION NO. 648 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMIS- SION REDECLARING THE MONROE- SAMPLE DEVELOPMENT AREA TO BE BLIGHTED AND APPROVING A DEVELOPMENT PLAN. WHEREAS, the City of South Bend Redevelopment Commission ( "Commission "), governing body of the City of South Bend Department of Redevelopment ( "Depart- ment") did, on February 6, 1981, adopt Resolution No. 633 declaring the follow- ing area to be a blighted area within the meaning of the Redevelopment of Cities and Towns Act of 1953 (I.C. 18 -7 -7) ( "Act "): WHEREAS, said Resolution No. 633 was reconfirmed by Resolution No. 635, adopted on March 20, 1981 and was amended by Resolution No. 636, adopted on April 16, 1981 and confirmed by Resolution No. 641, adopted on June 12, 1981; and WHEREAS, it has been found that Monroe Sample Design Review Committee as established within the Monroe Sample Development Plan should be expanded in size; and WHEREAS, there was presented to this meeting of the Commission for its con - sideration and approval, a copy of the amended page of the Monroe - Sample Develop- Co ment Plan, a copy of which is attached hereto; and WHEREAS, the Development Plan and the conditions under which relocation pay- ments will be made was reviewed and considered at the meeting, and the expansion of the Monroe Sample Design Review Committee was considered; and WHEREAS, the Commission desires to expand the Monroe Sample Design Review Comittee and it is therefore necessary to amend the Declaratory Resolution No. 633: NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND REDEVELOPMENT COM- MISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT: 1. That the Monroe - Sample Development Area, which is described in the first "WHEREAS" clause hereof, is blighted and constitutes a menace to the social and economic interest of the City of South Bend and its inhabi- tants and that it will be of public utility and benefit to acquire such area and redevelop the same under the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended. 2. The Department of Redevelopment proposes to acquire land and the interests therein within aforementioned boundaries as designated in the Development "�' Plan, as amended, and under the conditions set out therein. A parcel of land being a part of the City of South Bend, W � CJ Portage Township, St. Joesph County, Indiana, and being a - - :r. more particularly described as follows, viz: a c, CJ � X � Beginning at the intersection of the centerlines of a, w :5,x Michigan Street and Monroe Street in said City; thence •acv ac "'m m H East, along said Monroe Street centerline, to the cen- g s� terline ofLincolnway East; thence Southeasterly along said centerline to its intersection with the centerline -. iz of State Road 23; thence Southlwesterly and Westerly along said centerline (being, in part, also known as the centerline of Sample Street) to its intersection with the centerline of Michigan Street; thence North along said centerline to the place of beginning. That the Development Plan, as amended, is hereby in all respects approved and the Secretary is hereby directed to file a certified copy of said Development Plan, as amended, with the minutes of this meeting. 5. That the United States of America be, and hereby is, assured of full com- pliance by the City of South Bend Department of Redevelopment with regu- lations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964, as amended. Adopted at the Rescheduled Regular Meeting of the South Bend Redevelopment Commission held on November 24, 1981 at the office of the Commission, 1200 County - City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601. MONROE- SAMPLE DESIGN REVIEW COMMITTEE In order to achieve a high level of design and insure a feeling of continuity throughout the development area, a Monroe - Sample Design Review Committee is hereby established. The following paragraphs explain the makeup and duties of that committee. A. Establishment of Committee A Monroe - Sample Design Review Committee of seven (7) members shall be established consisting of the Executive Director of the Department of Redevelopment, who shall serve as Chair- man of the Committee, the City Engineer, the Director of the St. Joseph County Area Plan Commission, the City Building Commissioner, and three (3) members appointed by the Redevelop- ment Commission. B. Terms Members of such Committee shall serve without pay for the duration of this Development Plan. Vacancies occurring through death, resignation or other causes, shall be filled for the unexpired term in the same manner as original appointments. C. It shall review the proposals of the developers from the point of view of architecture, site planning, open space and other applicable considerations, and for compliance with the standards set forth in the Monroe - Sample Design Guidelines. In exercising these duties the Committee shall follow the procedures and act within the limitations established in subsequent sections. E. Design Guidelines The Redevelopment Commission shall, by Resolution, adopt a set of Design Guidelines for use by developers as they are planning their project. The Monroe - Sample Design Review Committee will base their recommendation to the Redevelopment Commission on how well the proposals have followed these guidelines. N R 11/24/81 2/2/81
