NA A. NOWAK RECORD Nu 6 8 jf PM '84 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT ST. JOSEPH CO. COMMISSION RATIFYING AND CONFIRMING RESOLUTION NO. INDIANA 648 WITH RESPECT TO THE MONROE- SAMPLE DEVELOPMENT FILED FOR R E CC AREA, REDECLARING THE MONROE- SAMPLE DEVELOPMENT AREA TO BE BLIGHTED AND APPROVING A DEVELOPMENT PLAN. WHEREAS, the City of South Bend Department of Redevelopment has, pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended (the "Act "), conducted surveys and investigations and has thoroughly studied that area in the City of South Bend, County of St. Joseph, State of Indiana, hereby desig- nated as the Monroe- Sample Development Area which is more particularly described by a line drawn as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows, viz: Beginning at the Street and Monroe said Monroe Stree 'Jay East; thence intersection with Southwesterly and part, also known intersection with North along said intersection of the centerlines of Michigan Street in said City; thence East, along t centerline, to the centerline of Lincoln southeasterly along said centerline to its the centerline of-State Road 23; thence Westerly along said centerline (being, in as the centerline of Sample'Street) to its the centerline of Michigan Street; thence centerline to the place of beginning. WHEREAS, upon such surveys, investigations and studies being made, it has been found by the City of South Bend Redevelopment Commission that the above described area has become blighted to an extent that such blighted conditions cannot be corrected by regulatory process or by the ordinary operations of pri- vate enterprise without resort to the provisions of the Act, and it has been further found that the public health and welfare would be benefitted by acqui- sition in and redevelopment of such area under the provisions of the Act; and WHEREAS, the Commissioners have caused to be prepared maps and plats show- ing the boundaries of such blighted area, the location of the various parcels of properties, streets and alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning and redevelopment of such area, and indicating the parcels of property to be included or excluded in the acquisition and portions of the area to be acquired which are to be devoted to streets, alleys, levees, sewerage, parks, playground and other public purposes under the redevelopment plan; and WHEREAS, the Development Plan, adopted by Declaratory Resolution No. 633, adopted on February 2, 1981, and confirmed by Resolution No. 635, adopted on March 20, 1981, has been amended by Declaratory Resolution No. 636, adopted on April 16, 1981, and confirmed by Resolution No. 641, adopted on June 12, 1981; and WHEREAS, the Commissioners did, on November 24, 1981, adopt Declaratory Resolution No. 648, redeclaring, among other things, the Monroe- Sample Develop- ment Area to be blighted and approving a Development Plan and increasing the size of the Monroe- Sample Design Review Committee as established within the Monroe - Sample Development Plan; and WHEREAS, as required by law, the St. Joseph County Area Plan Commission and the South Bend Common Council have considered and approved said Resolution No. 648 and the Development Plan, and, subsequently, the Commissioners did, on February 5, 1982, hold a public hearing for the purpose of presenting said Reso- lution No. 648 and to hear and consider remonstrances concerning said resolution; and WHEREAS, said Redevelopment of Cities and Towns Act of 1953, as amended, requires that the Commissioners, after such hearing and consideration, shall take final action determining the public utility and benefit of the project, either confirming, modifying, or rescinding Resolution No. 648. WHEREAS, the Commissioners desire to confirm said Resolution No. 648 without modification; NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the City of South Bend Department of Redevelopment that it will be of public utility and benefit to proceed with the plan of redevelopment as set forth in Resolution No. 648 referred to in the WHEREAS clauses above, and that said Resolution No. 648 is hereby approved, ratified and confirmed. Adopted at a meeting of the South Bend Redevelopment Commission held on February 5, 1982, at the Office of the Commission, 1200 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana.
