No. 633 with respect to Monroe Sample Development Area to be blighted, approving development plan and conditions under which relocation payments will be madeV,A ky: b RESOLUTION NO. 635 0 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION RATIFYING AND CONFIRMING RESOLUTION NO. 633 WITH RESPECT TO THE MONROE— SAMPLE DEVELOPMENT AREA, DECLARING THE MONROE— SAMPLE DEVELOPMENT AREA TO BE BLIGHTED AND APPROVING DEVELOPMENT PLAN AND CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE. FiL4 v ), Ytrtr�di An ig 244 ?P f8 INDIANA FILED FOr, RECOt> WHEREAS, the City of South Bend Department of Redevelopment has, pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended (the "Act "), conducted surveys and investigations and has thoroughly studied that area in the City of South Bend, County of St. Joseph, State of Indiana, hereby desig- nated as the Monroe- Sample Development Area which was described in Resolution No. 633, said description having contained an error, the corrected legal description is more particularly described by a line drawn as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows, viz: Beginning at the intersection of the centerlines of Michigan Street and Monroe Street in said City; thence East, along said Monroe Street centerline, to the centerline of Lincoln - way East; thence Southeasterly along said centerline to its intersection with the centerline of State Road 23; thence Southwesterly and Westerly along said centerline (being, in part, also known as the centerline of Sample Street) to it intersection with the centerline of Michigan Street; thence North along said centerline to the place of beginning. WHEREAS, upon such surveys, investigations and studies being made, it has been found by the City of South Bend Redevelopment Commission that the above described area has become blighted to an extent that such blighted conditions cannot be corrected by regulatory process or by the ordinary operations of private enterprise without resort to the provisions of the Act, and it has been further found that the public health and welfare would be benefitted by acquisition in and redevelopment of such area under the provisions of the Act; and WHEREAS, the Commissioners have caused to be prepared maps and plats show- ing the boundaries of such blighted area, the location of the various parcels of properties, streets and alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning and redevelopment of such area, and indicating the parcels of property to be included or excluded in the acquisi- tion and portions of the area to be acquired which are to be devoted to streets, alleys, levees, sewerage, parks, playground and other public purposes under the redevelopment plan; and WHEREAS, the Comissioners did, on February 2, 1981, adopt Declaratory Resolution No. 633 designating the Monroe - Sample Development Area, declaring the Monroe- Sample Development Area to be blighted and approving a Development Plan; and WHEREAS, as required by law, the St. Joseph County Area Plan Commission and the South Bend Common Council have considered and approved said Resolution No. 633 and the Development Plan, and, subsequently, the Commissioners did, on March 20, 1981, hold a public hearing for the purpose of presenting said Reso- lution No. 633 and to hear and consider remonstrances concerning said resolution; and - 2 - WHEREAS, said Redevelopment of Cities and Towns Act of 1953, as amended, requires that the Commissioners, after such hearing and consideration, shall take final action determining the public utility and benefit of the project, either confirming, modifying, or rescinding Resolution No. 633; and WHEREAS, the Commissioners desire to modify said Resolution No. 633 in the manner identified on "Attachment A" and confirm said Resolution No. 633 as modified; NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the City of South Bend Department of Redevelopment that it will be of public utility and benefit to proceed with the plan of redevelopment as set forth in Resolution No. 633, as modified, referred to in the WHEREAS clauses above, and that said Resolu- tion No. 633, as modified, is hereby approved, ratified and confirmed. Adopted at a meeting of the South Bend Redevelopment Commission held on March 20, 1981, at the Office of the Commission, 1200 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana. Peter Dona d on, Secretary "ATTACHMENT A" RESOLUTION NO. 635 The following modifications are made to the Monroe - Sample Development Plan: 1. Page 3, III. A. - Commercial is to read as follows: Commercial: Two sub -areas are identified for commercial development. They are located along Michigan and Monroe Streets. 2. Page 5, III. C. - Transportation is to read as follows: C. Transportation In order to reinforce the integrity of the individual sub - areas, certain changes in street patterns are pro- posed (Map 2). 1. Fellows Street is to be closed at the intersection with Monroe Street to eliminate hazardous turning movements, discourage through- traffic, and encourage a residential environment. 2. Bronson Street from Columbia to Lincolnway is to be widened to permit truck access to the industrial sub -area. The intersection of Bronson and Lincoln - way will be realigned and a traffic light installed. 3. Rush Street is to be vacated from Bronson Street south approximately 400 feet and a new east -west street is to be constructed at that point between Fellows and Rush. 4. The turning radii will be improved at the northeast corner of Columbia and Bronson Streets and the south- west corner of Fellows and Bronson Streets. 5. George Avenue will be vacated. 6. Clinton Street from Bronson Street to Frontage Street will be vacated. 7. Various alleys in the area south of Bronson, as shown on Map 2, are to be vacated. X11. si FINDING OF FACTS OF SOUTH BEND REDEVELOPMENT CONMIISSION REGARDING MONROE- SAMPLE DEVELOPMENT AREA MARCH 20, 1981 The South Bend Redevelopment Commission has conducted a study of the Monroe- Sample Development Area. Based upon that study and following the other procedures required by I.C. 18 -7 -7 (the "Act ") including public hear- ing, the Redevelopment Commission hereby finds that the area has become blighted to such an extent that such conditions cannot be corrected by the regulatory process or by ordinary operations of private enterprise without resort to the provision of the Act and that the public health and welfare will be benefited by the acquisition and redevelopment of the area under the provision of the Act. This finding is based on the following informa- tion: 1. Twenty -nine (29) per cent of the land within the boundaries of the Monroe - Sample Development Area is currently vacant; 2. In the last ten years, the residential population has declined dramatically. Since 1970 the population of the area has declined 46 per cent, from 891 to 486, and the number of housing units has decreased 42 per cent, form 387 to 225; 3. There are 268 structures in the area and approximately 42 per cent are deficient, requiring varying amounts of structural repair.
