RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
COMMISSION DESIGNATING THE MONROE- SAMPLE DEVELOPMENT
'•' AREA, DECLARING THE MONROE- SAMPLE DEVELOPMENT AREA TO
BE BLIGHTED AND APPROVING A DEVELOPMENT PLAN AND
CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE
MADE
WHEREAS, the City of South Bend Department of Redevelopment
has, pursuant to the Redevelopment of Cities and Towns Act of 1953,
as amended (the "Act "), conducted surveys and investigations and
has thoroughly studied that area in the City of South Bend, County
Of St. Joseph, State of Indiana, hereby designated as the Monroe -
Sample Development Area which is more particularly described by
a line drawn as follows:
A parcel of land being a part of the City of South Bend,
Portage Township, St. Joseph County, Indiana and being
more particularly described as follows, viz:
Beginning at the intersection of the centerline of
Michigan Street and Monroe Street in said City�nthgnce r

WHEREAS, upon such surveys, investigations and studies being
made, it has been found by the City of South Bend Redevelopment
Commission that the above - described area has become blighted to
an extent that such blighted conditions cannot be corrected by
regulatory process or by the ordinary operations of private enter-
prise without resort to the provisions of the Act, and it has been
further found that the public health and welfare would be bene-
fitted by acquisition in and redevelopment of such area under the
provisions of the Act; and
WHEREAS, the Commissioners have caused to be prepared maps
and plats showing the boundaries of such blighted area, the location
of the various parcels of properties, streets and alleys and other
features affecting the acquisition, clearance, replatting, replan -
ning, rezoning and redevelopment of such area, and indicating the'
parcels of property to be included or excluded in the acquisition
and portions of the area to be acquired which are to be devoted to
streets, alleys, levees, sewerage, parks, playground and other
public purposes under the redevelopment plan; and
WHEREAS, there was presented to this meeting of the Govern-
ing Body of the City of South Bend Department of Redevelopment for
its consideration and approval, a copy of Development Plan for the
project area dated February 2, 1981, which plan is entitled:
"MONROE- SAMPLE DEVELOPMENT AREA
DEVELOPMENT PLAN
SOUTH BEND, INDIANA"
and consists of 21 pages; and
WHEREAS, Title VI of the Civil Rights Act of 1964, as
amended and the regulations of the Department of Housing and Urban
Development effectuating that title, provide that no person shall,
on the grounds of race, age, sex, color or national origin, be
excluded from participation in, be denied the benefits of, or be
subject to discrimination in the undertaking and carrying out of
any federally assisted projects;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND
REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND
DEPARTMENT OF REDEVELOPMENT:
I. That the Monroe Sample Development Area „ which is de-
scribed in the first "WHEREAS" clause hereof, is blighted and
constitutes a menace to the social and economic interest of the
City of South Bend and its inhabitants and that it will be of
public utility and benefit to acquire real estate in such area
and redevelop the area under the provisions of the Act.
2. That the Department of Redevelopment proposes to
acquire such real estate and the interests therein within the
aforementioned boundaries as designated in the Development Plan
and under the conditions set out therein.
3. That it is estimated that the cost of acquiring the
properties in the area will be $1,025,000.00.
4. For purposes of the allocation provisions of the
Redevelopment of Cities and Towns Act of 1953, as amended (Indiana
Code 18 -7 -7) ( "Act "), the following areas of the blighted area
described in this Resolution shall be constituted an "Allocation
Area" for purposes of the Act and this Resolution:
A parcel of land being a part of the City of
South Bend, Portage Township, St. Joseph County,
Indiana and being more particularly described
as follows, viz:
Beginning at the intersection of the centerlines
of Michigan Street and Monroe Street in said
City; thence East, along said Monroe Street center-
line, to the centerline of Lincolnway East; thence
Southeasterly along said centerline to its inter -'
section with the centerline of State Road 23;
thence Southwesterly and Westerly along said center-
line (being, in part, also known as the centerline
of Sample Street) to its intersection with the center-
line of Michigan Street; thence North along said center-
line to the place of beginning.
S. Such allocation area shall be designated the "Monroe Sample
Development Allocation Area" ( "South Bend Allocation Area No. 311).
6. Any taxes levied on real property in said South Bend
Allocation Area No. 3 in 1981, for collection in 1982, and there-
after, except as hereinafter provided, for the benefit of any
taxing unit entitled to a distribution thereof, shall be allocated
and distributed as provided in the allocation and distribution
provisions of the Act, and more particularly as follows:
(a) the proceeds of such taxes attributable
to the lesser of (i) the assessed value'
of all such property in said Allocation
Area No. 2 for the assessment date with
respect to which the allocation and dis-
tribution is made or (ii) the assessed
value of all such property as finally
determined for the assessment date im-
mediately preceeding the effective date
of these allocation provisions, which
assessment date is March 1, 1981, shall
be allocated to, and when collected shall
be paid into the funds of the respective
taxing units entitled to a distribution
of such taxes;

(b) the proceeds of such taxes in excess of
those described in clause (a) above shall
be allocated to the Department, and when
collected shall be paid into a special
fund hereinafter created.
7. The proceeds of such taxes distributed to the Depart-
ment pursuant to Paragraph 9(b) hereof shall be deposited in
a special fund designated "South Bend Department of Redevelop-
ment Monroe Sample Development Allocation Area (South Bend
Allocation Area No. 3) Special Fund" ( "Special Fund ")
be used only asprovided in the Act, and more particula rly d

to pay principal of and interest on any obligations issued by
the Department for the purpose of financing or refinancing the
redevelopment of South Bend Allocation Area No. 3 or (b) to re-
imburse the City for expenditures made by it for public improve-
ments in South Bend Allocation Area No. 3, or for rentals paid
by it for a building or off - street parking facility in South Bend
Allocation Area No. 3 under any lease entered into pursuant to
Indiana Code 18- 5 -3.3. When money in the Special Fund shall be
sufficient to pay when due all principal of and interest on
obligations payable therefrom, any excess over such amount shall
be paid to the respective taxing units entitled thereto in the
manner provided in Paragraph 6(a) hereof, and thereafter the
allocation and distribution provided for in Paragraph 6 hereof
shall be discontinued, and taxes on real property in South Bend
Allocation Area No. 3 shall thereafter be distributed without
regard to the provisions of Section 39.1 of the Act.
8. That it is hereby found and determined that the
objectives of the Development Plan cannot be achieved by regulatory
process or by the ordinary operations of private enterprise with-
out resort to the provisions of the Act.
9. That the Development Plan is hereby in all respects
approved and the Secretary is hereby directed to file a certified
copy of said Development Plan with the minutes of this meeting
and to have a certified copy of said Plan recorded in the Office
of the Recorder of St. Joseph County, Indiana.
10. That the United States of America be, and hereby is
assured of full compliance by the City of South Bend Department
of Redevelopment with regulations of the Department of Housing and
Urban Development effectuating Title VI of the Civil Rights Act
of 1964, as amended.

INTRODUCTION
The Monroe - Sample Development Area provides the City of South Bend
an opportunity to focus on conflicting land -use patterns that currently
exist and plan for orderly stabilization and growth in a neighborhood that
has deteriorated over recent years. The Area, consisting of approximately
82 net acres, is adjacent to the southeast portion of the Central Business
District and currently contains residential, commercial and industrial uses
as well as a large amount of vacant land. The Development Plan that follows
is designed to establish specific sub -areas for each of thbse uses, buffer-
ing one from the other by landscaping and changing traffic patterns that
will enable each sub -area to function independently of the others. At the
same time the Plan recognizes that the sub -areas can be supportive of each
other by creating and retaining jobs, and reinforcing the existing resi-
dential area with housing for an available nearby work force.
Acquisition, relocation and clearance activities are to be princi-
pally located in the industrial sub -area with some additional activity
occuring in the commercial area. Through assemblage of land, various size
sites will be made available to private developers. In conjunction with
this, the Department of Redevelopment will seek commitments from businesses
locating in the area to target jobs to C.E.T.A. eligible individuals.
Building on the strength of the possible historic district along
St. Joseph and Carroll Streets and the newly created Edgewater Place
Historic District opposite the Development Area, the primary emphasis in
the residential neighborhood will be on rehabilitation of existing housing.
Additionally, some houses currently located in the industrial and commercial
sub -areas will be moved to new locations north of Bronson Street and new con-
struction will be encouraged on existing vacant lots.
With the adoption of this Plan, South Bend is in a position to re-
vitalize the Monroe - Sample area. Through the cooperation and involvement
of both the public and private sectors, this area can become a vital resi-
dential and industrial neighborhood area that compliments the downtown and
adds significantly to the tax base of the City.

II.
HISTORY OF PROJECT AREA
In the early history of South Bend, Monroe- Sample was a farming area
on the outskirts of the town. By 1859 most of the neighborhood was
annexed with the exception of St. Joseph and Carroll Streets. This
area, known as Taylor's Field, was developed as an upper middle in-
come neighborhood after 1874. The balance of the area was devoted
to workmens' housing for the nearby Birdsell Farm Equipment and
Studebaker Wagon factories, and was largely completed early in the
Twentieth Century.
The Monroe - Sample neighborhood began to decline during the 1950's
and this decline accelerated during the 1960's and 1970's. Since
1970 the number of housing units in the area has dropped by one -half
(112), resulting in a greatly reduced population and increased amount
of vacant land. Many of the structures remaining today are deterior-
ating and in need of substantial repair.
Recently the City of South Bend, through its Department of Redevelop-
ment and Division of Planning, has been examining existing conditions
and land utilization patterns throughout the neighborhood. This De-
velopment Plan is the culmination of these efforts and sets forth
the City's goals and plans for the revitalization of Monroe - Sample as
an urban residential and industrial area.
DESCRIPTION OF PROJECT
A. Boundaries of the Monroe - Sample Development Area
A parcel of land being a part of the City of South Bend,
Portage Township, St. Joseph County, Indiana, and being
more particularly described as follows, viz:
Beginning at the intersection of the centerlines of Michigan
Street and Monroe Street in said City; thence East, along
said Monroe Street centerline, to the centerline of Lincoln -
way East; thence Southeasterly along said centerline to its
intersection with the centerline of State Road 23; thence
Southwesterly and Westerly along said centerline (being, in
part, also known as the centerline of Sample Street) to its
intersection with the centerline of Michigan Street; thence
North along said centerline to the place of beginning.
B. Development Plan Goals and Objectives
In order to reinforce and revitalize the area, the following
goals and objectives have been established:
Create a new, positive identity for the area and provide
a pleasant urban environment by eliminating blighting
influences and land -use chaos.

a. Promote the development of commercial and industrial
expansion within planned sub - areas.
b. Expand the supply of housing for low and moderate
income families by rehabilitation and infill con-
struction.
2. Stimulate private sector participation and investment
consistent with overall goals and objectives.
3. Increase the tax base of the area.
4. Target applicable jobs created to CETA eligible
individuals.
C. Types of Proposed Redevelopment Activities
Realization of the Development Area objectives will be ac-
complished by a combination of public and private actions.
These actions include, but are not limited to, the following:
property acquisition, relocation, clearance, vacation and
dedication of public rights -of -way, provision for public
facilities and improvements and any other activity pertaining
to planning and implementing an urban redevelopment plan.
III. LAND USE
A. Designation of Sub -Areas
The Monroe - Sample Area is currently subject to conflicting
land -use patterns. In order to stabilize the area and allow
for orderly growth and development, several sub -areas have
been designated and are identified on Map 1.
Residential: The residential neighborhood north of Bronson
is to be strengthened through housing rehabilitation pro-
grams. New construction that is compatible with the exist-
ing character of the neighborhood will be encouraged. There
should be some selective moving of houses from the light
industrial area South of Bronson to fill in some of the
vacant lots in the sub -area. The proposed historic district
along St. Joseph and Carroll Streets can include professional
office use as well as residential.
Commercial: Three sub -areas are identified for commercial
development. They are located along Michigan, Monroe and
Lincolnway East. Residential use in this sub -area would
only be allowed in mixed -use structures.

5. The Department of Redevelopment recognizes that there
presently exist in the Area certain uses which do not
conform to the Development Plan Goals, Objectives and
Controls. Such uses will be allowed to continue unless
the Department acquires the subject property through its
regular acquisition procedures.
a. Such uses may only be expanded within existing
buildings.
b. If such uses are damaged by fire or other means
to an extent of less than 50% of its replacement
costs, the use may be reconstructed, but if such
damage is in excess of 50% of the replacement
cost, the use may not be reconstructed except in
accordance with the provisions of this Development
Plan.

Industrial: The sub -area South of Bronson is designated
for industrial expansion and relocation. The present
street system will be modified to permit assemblage of
large parcels of land.
B. Development Controls
The controls and regulations for the Development Area are
designed to provide for development that is consistent with
Plan Goals and Objectives and to assure compatibility of

development throughout the area.
1. All proposed development is subject to review and approval
'
by the Monroe - Sample Design Review Committee.
2. Zoning requirements shall be the same as those in the "B"
'
Residence District, "C" Commercial Destrict, "D" Light
Industrial District, and "E" Heavy Industrial District
as identified in Chapter 21, Article 2, Divisions 5, 7,
10, and 11 of the Municipal Code of the City of South
Bend. Map 3 outlines the areas for each zoning classifi-
cation.
3. Height and area requirements shall be the same as those
'
in the "E" and "F" Height and Area Districts as identified
in Chapter 21, Article 4, Divisions 6 and 7 of the Munici-
pal Code of the City of South Bend. Map 4 outlines the
areas for each height and area classification.
4. Off- premise signs may not be erected or placed within
'
the Monroe- Sample Development Area. Sign size, design
and placement shall be subject to review and approval
by the Monroe - Sample Design Review Committee.
5. The Department of Redevelopment recognizes that there
presently exist in the Area certain uses which do not
conform to the Development Plan Goals, Objectives and
Controls. Such uses will be allowed to continue unless
the Department acquires the subject property through its
regular acquisition procedures.
a. Such uses may only be expanded within existing
buildings.
b. If such uses are damaged by fire or other means

6. When feasible, utility lines shall be placed under-
ground.
C. Transportation
In order to reinforce the integrity of the individual sub - areas,
certain changes in street patterns are proposed (Map 2).
1. Fellows Street is to be closed at the intersection with
Monroe Street to eliminate hazardous turning movements,
discourage through- traffic, and encourage a residential
environment.
2. Carroll Street is to be closed to through - traffic with
a cul -de -sac constructed between South Street and Monroe
Street. The commercial area along Monroe would have
access to Carroll.
3. Bronson Street from Marietta to Lincolnway is to be
widened to permit truck access to the industrial sub-
area.

4. Rush Street is to be closed from Bronson Street south
approximately one -half (1/2) block and a new east -west
'
street is to be constructed at that point between
Fellows and Rush.

5. Columbia Street and Carroll Street are to be closed
South of Bronson.
'
D. Public Improvements
Public Improvements will be primarily focused on the changes
in street patterns outlined previously. Additional public
'
improvements could include sidewalk, curb and gutter repair,
and improved street lighting.
E. House Moving
As mentioned previously, several houses in the industrial
and commercial areas have been selected for moving to a
'
different site North of Bronson Street to help fill in the
existing residential neighborhood. These houses will either
'
be homesteaded for $1 under the regulations of the existing
Bureau of Housing Homesteading Program, or, if the present
owner so desires, the owner will be temporarily relocated
during the move and take possession of the house again after
the move has been completed.

IV. MONROE- SAMPLE DESIGN REVIEW COMMITTEE
In order to achieve a high level of design and insure a feeling
of continuity throughout the development area, a Monroe - Sample
Design Review Committee is hereby established. The following
paragraphs explain the makeup and duties of that committee.
' A. Establishment of Committee

A Monroe - Sample Design Review Committee of five (5) members
shall be established consisting of the Executive Director
of the Department of Redevelopment, who shall serve as Chair-
man of the Committee, the City Engineer, the Director of the
St. Joseph County Area Plan Commission, the City Building
Commissioner, and one (1) member appointed by the Redevelop-
ment Commission.
B. Terms
Members of such Committee shall serve without pay for the
duration of this Development Plan. Vacancies occurring
through death, resignation or other causes, shall be filled
for the unexpired term in the same manner as original
appointments.
C. Rules
The Committee shall adopt such rules and procedures as are
necessary to conduct its business. Among other things, such
rules may provide for the dates and times of meetings and
hearings.
D. Powers and Duties
The Committee shall function in an advisory capacity to the
Redevelopment Commission. It shall review the proposals of
the developers from the point of view of architecture, site
planning, open space and other applicable considerations,
and for compliance with the standards set forth in the Monroe -
Sample Design Guidelines. In exercising these duties the
Committee shall follow the procedures and act within the
limitations established in subsequent sections.
E. Design Guidelines
The Redevelopment Commission shall, by Resolution, adopt
a set of Design Guidelines for use by developers as they
are planning their project. The Monroe - Sample Design
Review Committee will base their recommendation to the
Redevelopment Commission on how well the proposals have
followed these guidelines.

necessary by Redevelopment Commisison action.

F.
Building Permits
No permit shall be issued by the South Bend Building
Department for the construction of any building in the
project area or the reconstruction, alteration, or re-
habilitation of any building in the area unless the
application for such permit shall bear an endorsement
by the Committee that such proposed construction is
appropriate and conforms to the standards set forth in
The Monroe - Sample Design Guidelines.

G.
Review
All development plans filed hereunder shall be accompanied
'
by preliminary and final architectural plans and /or engin-
eering drawings and specifications for the work involved.
Such plans shall be reviewed for compliance with the stand-
ards and objectives of the Development Plan and Design
Guidelines. Within thirty (30) days from and after the
date on which a Development Plan is filed with the Commit-
tee, Saturdays, Sundays and legal holidays excluded, the
Design Review Committee shall submit its recommendations
in writing to the Redevelopment Commission, stating in the
case of a disapproval, the reasons therefor, and a copy of
such recommendation shall be given to the applicant(s), the
Building Department and the Executive Director of the St.
Joseph County Area Plan Commission. In addition, the Com-
mittee shall indicate what modifications in plans or speci-
fications are necessary to accomplish compliance.

H.
Amendments to Disapproved Plan
Within not more than thirty (30) days after a disapproval,
'
the applicants filing a Development Plan which has been
disapproved, may file with the Committee an amendment to
such plan or an amended plan which shall be limited ex-
clusively to changes made necessary to accomplish compliance
'
with the grounds for disapproval stated by the Committee.
An amendment or amended plan shall be approved or disapproved
within not more than thirty (30) days after filing thereof.

I.
Prevention of Speculation
Purchase contracts will provide that the redeveloper agree
that his purchase of the property is for the purpose of re-
development and not for land speculation. Prior to the com-
pletion of his redevelopment project, the redeveloper may not
sell, lease, or otherwise transfer such land (or improvements)
without the prior written consent of the City of South Bend,
Department of Redevelopment.

J. Adequacy of Zoning and Other Codes and_ Regulations to
As explained above, the new land uses in the project area
will be subject to the established provisions of the South
Bend Zoning Ordinance. All such uses will also be subject
to the requirements of the Building Code and similar regula-
tions. These codes and regulations in conjunction with the
land use provisions, building requirements and restrictions
as well as the design and development objectives established
by the Plan will adequately protect the Development Area.
K. Signs
All proposals for signs within the Development Area shall
be reviewed by the Committee and evaluated as to their
keeping with the standards established in the Design Guide-
lines.
IV. PROJECT PROPOSALS
A. Land Acquisition
The Land Acquisition Plan Map (attached) and Tabulation Sheets
(pages 11 through 17 ) indicate real property to be acquired
for redevelopment. The Tabulation Sheets also set forth parcel
ownership and square footage for such land.
Upon the acquisition of such properties, the City of South Bend
Department of Redevelopment will either:
1. Demolish the structure or structures thereon and dispose
of the land for redevelopment at its fair market value,
excepting those cases when land is sold or leased to
another public body pursuant to Indiana Code 18- 7 -7 -20,
for uses in accordance with the Development Plan;
2. Move the structure or structures thereon to a new loca-
tion and dispose of the land for redevelopment at its
fair market value, excepting those cases when land is
sold or leased to another public body pursuant to Indiana
Code 18- 7 -7 -20, for uses in accordance with the Develop-
ment Plan;
3. Sell or lease the property to purchaser or lessee at its
fair market value, excepting those cases when property
is sold or leased to another public body pursuant to
Indiana Code 18- 7 -7 -20, for uses in accordance with the
Development Plan subject to its being rehabilitated in
conformance with the Monroe - Sample Design Guidelines.

B. Property Rehabilitation
All properties in the Sample - Monroe Development Area shall
comply with the standards set forth in all applicable
'
statutes, codes and ordinances, as amended from time to time,
relating to the use, maintenance, facilities, and occupancy
'
of existing property, including but not limited to, the Build-
ing, Plumbing, Heating, Electrical Housing
and Codes.
All properties within the Development Area shall be maintained
'
so that the appearance of the premises and all buildings there-
on shall reflect a level of maintenance in keeping with the
standards of the area.
C. Redevelopers' Obligations
The land acquired by the City of South Bend Department of
Redevelopment will be disposed of subject to an Agreement be-
tween the Department and the Redeveloper. The Redeveloper will
be required by the Contractual Agreement to observe the Land
Use and Building Requirements and Objectives of this Develop-
ment Plan. They will further be required to submit a redevelop-
ment schedule satisfactory to the City of South Bend Department
of Redevelopment. The Redeveloper will not be permitted to
defer the start of construction for a period longer than that
required for the preparation of necessary redevelopment plans,
their review, and approval by the City of South Bend Department
of Redevelopment.
1. In addition, the following provisions will be included in
the Agreement.
a. That the Redeveloper will submit to the Department
a plan and schedule for the proposed development.
b. That the purchase of the land is for the purpose
of redevelopment and not for speculation.
c. That the land will be built upon and improved in
conformity with the objectives and provisions of
the Development Plan.
d. That the building of improvements will be commenced
and completed within a reasonable time.
e. That the redevelopers, their successors or assigns,
agree that there will be no discrimination against
any person or group of persons on account of race,
creed, color, sex, age, national origin, or ancestry
in the sale, lease, sublease, transfer, use, occupancy,
tenure, or enjoyment of the premises therein conveyed,

' or improvements erected or to be erected thereon,
nor will the Redeveloper himself or any person
claiming under or through him establish or permit
' any such practice or practices of discrimination
or segregation with reference to the selection,
location, number, use, or occupancy of tenants,
' lessees, sublessees, or vendees in the premises
therein conveyed, or improvements erected or to be
erected thereon.

et. seq.

VII. PROCEDURE FOR CHANGES IN THE APPROVED URBAN RENEWAL PLAN
The Monroe - Sample Development Plan may be modified or varied at any
time by a resolution of the City of South Bend Redevelopment Commis-
sion. Any change affecting any property or contractual right can be
effectuated only in accordance with applicable State and Local Law.
