RESOLUTION NO. 630 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION RATIFYING AND CONFIRMING RESOLUTION NO. 626 WITH RESPECT TO THE EAST BANK DEVELOPMENT AREA, DECLARING THE EAST BANK DEVELOPMENT AREA TO BE BLIGHTED AND APPROVING DEVELOPMENT PLAN AND CONDI- TIONS UNDER WHICH RELOCATION PAYMENTS WILL BE MADE. WHEREAS, the City of South Bend Department of Redevelopment has, pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended (the "Act "), conducted surveys and investigations and has thoroughly studied that area in the City of South Bend, County of St. Joseph, State of Indiana, hereby designated as the East Bank Development Area which is more particularly described by a line drawn as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows, viz: Beginning at the point of intersection of the North right - of -way line of Sorin Street with the East right -of -way line of Niles Avenue in said City; thence South along said East right -of -way line of Niles Avenue to the centerline of the first fourteen (14) foot alley lying North of Cedar Street and between Niles Avenue and Hill Street; thence East along said centerline, to the centerline of Hill Street, along said Hill Street centerline, to the centerline of Jefferson Boulevard; an eighty -two and one -half (82.5) foot right -of -way; thence West, along said Jefferson Boule- vard centerline to the center of the St. Joseph River; thence in a Northwesterly and Northeasterly direction along the centerline of said River to its intersection with the pro- jected North right -of -way line of said Sorin Street; thence East, along said projection and along said North right -of- way line to the East right -of -way line of Niles Avenue which is the place of beginning. WHEREAS, upon such surveys, investigations and studies being made, it has been found by the City of South Bend Redevelopment Commission that the above - described area has become blighted to an extent that such blighted con- ditions cannot be corrected by regulatory process or by the ordinary operations of private enterprise without resort to the provisions of the Act, and it has been further found that the public health and welfare would be benefitted by acquisition in and redevelopment of such area under the provisions of the Act; and WHEREAS, the Commissioners have caused to be prepared maps and plats showing the boundaries of such blighted area, the location of the various par- cels of properties, streets and alleys and other features affecting the acqui- sition, clearance, replatting, replanning, rezoning and redevelopment of such area, and indicating the parcels of property to be included or excluded in the acquisition and portions of the area to be acquired which are to be devoted to streets, alleys, levees, sewerage, parks, playground and other public purposes under the redevelopment plan; and im - 2 - WHEREAS, the Commissioners did, on October 3, 1980, adopt Declaratory Resolution No. 626 designating the East Bank Development Area, declaring the East Bank Development Area to be blighted and approving a Development Plan; WHEREAS, as required by law, the St. Joseph County Area Plan Commis- sion and the South Bend Common Council have considered and approved said Resolution No. 626 and the Development Plan, and, subsequently, the Commis- sioners did, on December 5, 1980, and December 19, 1980, hold a public hearing for the purpose of presenting said Resolution No. 626 and to hear and consider remonstrances concerning said resolution; and WHEREAS, said Redevelopment of Cities and Town Act of 1953, as amended, requires that the Commissioners, after such hearing and consideration, shall take final action determining the public utility and benefit of the project, either confirming, modifying, or rescinding Resolution No. 626; and WHEREAS, the Commissioners desire to confirm said Resolution No. 626 without modification, except for changes in ownership as listed on pages 15 through 20 of the Development Plan; NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the City of South Bend Department of Redevelopment that it will be of public utility and benefit to proceed with the plan of redevelopment as set forth in Resolution No. 626, passed by said Commissioners on October 3, 1980, referred to in the WHEREAS clauses above, and that said Resolution No. 626 is hereby approved, ratified, and confirmed. ATTEST: v A Peter Donalds n, Secretary ON CITY OF SOUTH BEND, INDIANA DEPARTMENT OF REDEVELOPMENT L - dent Jay Nimt , Pres e eevelopmen Commission FINDING OF FACTS OF SOUTH BEND REDEVELOPMENT COMMISSION RE: EAST BANK DEVELOPMENT AREA December 19, 1930 The South Bend Redevelopment Commission has conducted a study of the East Bank Development Area and has found that the area has become blighted and conditions can not be corrected by the regulatory process or by ordi- nary operations of private enterprise. This finding is based on the following information: 1. Forty -seven (47) per cent of the land within the boundaries of the East Bank Development Area is currently vacant; 2. The entire area has been zoned "D" light industrial since 1922 and in spite of this, industrial use has declined; 3. The declining industrial use has had a deteriorating effect on residential and commercial property. Since 1960 the population of the area has declined 78 per cent, from 262 to 57, and the number of households has decreased 84 per cent, from 130 to 21; 4. There are 86 structures in the area and approximately 25 per cent are deficient, requiring varying amounts of structural repair; 5. The current assessed valuation of the entire area is $1,701,730. The South Bend Redevelopment Commission finds that it will be of public benefit to the public health and welfare to redevelop the East Bank Develop- ment Area. The Area, consisting of approx- imately 52 net acres, is located directly to the east of the Central Business District and is presently greatly underutilized. The Development Plan that follows provides for a coordinated effort on the part of both the public and private sectors to convert this largely vacant area to a vibrant, urban, residen- tial community with compatible commercial and retail uses. With a concept based on the reopening of the East Race of the St. Joseph River, the Area is envisioned as a pedestrian oriented community, combining park improvements, pedestrian paths and open spaces with re -use of certain existing, structures as well as encouraging new construction. In prior redevelopment projects large amounts of public sector actions were necessary to spur private development. Such is not the case with this particular project. The location and setting of the Area gives it a quality that is inherently attractive to private developers. The major public sector investment will be the acquisition and reopening of the East Race and creation of a park along the banks of the race to complement the attractive riverfront envir- onment in the downtown area. South Bend Park Department plans for the race itself provide for recreational amenities in the form of canoeing and white water kayaking as well as providing for a fish ladder and pedestrian pathway system. Originally constructed in the 1840's, the raceway provided hydraulic power to local industries such as the Singer Corporation and the A.C. Stanley Manu- facturing Corporation. The East Race served a ' useful function for over one hundred years until it was filled in during the 1950's and 1960's. The memory of the race did not fade with its destruction. City residents, community groups, business leaders and public officials began to investigate ways of reopening the race to provide recreational opportunities. The concept of reopening the race was formally proposed in the "St. Joseph River Corridor Study" prepared by Lawson Associates in 1973. In that study recom- mendations were made to improve the riverfront throughout the central area of South Bend, pro - viding parks and pedestrian ways along the river's path. At that time, the study suggested a re -use of existing structures in th- East Bank Area, along with compatible new construction, to create a predominately residential community with a mix of businesses and offices connected by a system of green spaces and pedestrian ways. Since that time the City of South Bend, through its Department of Redevelopment and Division of Planning, has been continuing this study and looking into existing conditions and land utilization in the Area. This Development Plan is the culmination of those efforts and sets forth the City's goals and plans ' for the re- emergence of the East Bank Area as a more vital part of South Bend. 1 1 -2- 10/3/80 L7 I� 11 w 1 1 II. Description of Project A. Boundaries of the East Bank Development Area A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the point of intersection of the North right -of -way line of Sorin Street with the East right -of -way line of Niles Avenue in said City; thence South along said East right - of -way line of Niles Avenue to the centerline of the first fourteen (14) foot alley lying North of Cedar Street and between Niles Avenue and Hill Street; thence East, along said centerline, to the centerline of Hill Street, a sixty -six (66) foot right -of -way; thence South, along said Hill Street center- line, to the centerline of Jefferson Boulevard, an eighty -two and one -half (82.5) foot right -of -way; thence Nest, along said Jefferson Boulevard centerline to the center of the St. Joseph River; t1 -.ence in a North- westerly and Northeasterly direction along the centerline of said River to its inter- section with the projected North right -of- way line of said Sorin Street; thence East, along said projection and along said North right -of -way line to the East right -of -way line of Niles Avenue which is the place of beginning. B. Development Plan Goals & Objectives Goals and objectives for the redevelopment of the East Bank Development Area are: 1. To reverse the underutilization of existing land and structures through the creation of a downtown residential /mixed use area which will include: a. A medium density, pedestrian oriented residential development; b. Supporting neighborhood oriented commercial and retail development; -3- 10/3/80 ' c. Adaptive re -use of certain existing buildings; and ' d. New construction. a 2. To create an attractive park setting to complement the riverfront environ- ment. 3. To stimulate private sector partici- pation and investment consistent with overall goals and objectives. ' 4. To increase the tax base of the area. ' C. Types of Proposed Redevelopment Activities Realization of East Bank Development Area objectives will be accomplished by a combination of public and private actions. These actions include, but are not limited to, the following: property acquisition, relocation, clearance, ' vacation and dedication of public rights -of -way, provision for public facilities and improve- ments and any other activity pertaining to planning and implementing an urban redevelop- ment plan. -4- 10/3/80 t 1 III. Land Use A. Designation of Sub -Areas While the entire East Bank Development Area is envisioned as a residential /mixed use area as described in the Development Plan Goals and Objectives, two sub -areas have been designated in order to emphasize develop- , ment priorities. The sub -areas are identi- fied on Map I. Area A: The highest priority shall be on Multi - Family residential with secondary emphasis on Commercial development. ' Area B: The highest priority shall be on Commercial development with ' secondary emphasis on Multi- Family residential. B. Development Controls -5- 10/3/80 The controls and regulations for the Development Area are designed to provide for development that is consistent with Plan Goals and Objectives and to assure a high level of urban design. 1. Within the Development Area the following uses will be allowed: a. Residential: multi - family and two family dwellizig units b. Commercial: Antique & Gift Shops Apparel & accessories Shops ' Artists materials & Supplies Arts & Craft Supplies Athletic Clubs ' Bakeries, retail Ball Rooms Banks Barbershops ' Bars, nightclubs, and lounges Beauty Shops -5- 10/3/80 t I c. All proposed development is subject to review and approval by the East Bank Design Review Committee. 3. Minimum building height shall be two stories. 4. Height and area requirements shall be the same as those in the "G" Height & Area District as identified in Chapter 21, Article 4, Division o of the Municipal Code of the City of South Bend. 5. Off- premise signs may not be erected or placed within the East Bank Development Area. Sign size, design and placement shall be subject to review and approval by the East Bank Design Review Committee. ' 6. The Department of Redevelopment recognizes that there presently exist in the Area certain uses which do not conform to the ' Development Plan Goals, Objectives and Controls. Such uses will be allowed to continue unless the Department acquires the subject property through its regular acquisition procedures. along any waterway. -7- 10/3/80 a. Such uses may only be expanded within ' existing buildings. b. If such uses are damaged by fire or other means to an extent of less than ' 50% of its replacement cost, the use may be reconstructed, but if such damage is in excess of 50% of the replacement cost, the use may not be reconstructed except in accordance with the provisions of this Development Plan. 7. When feasible, utility lines shall be placed underground. C. Parking Regulations 1. No surface parking lots may be allowed ' along any waterway. -7- 10/3/80 2. Surface Parking lots of over ten spaces shall be screened from view as per adopted Design Guidelines. 3. Whenever possible, required parking shall be on site. However, off site parking will be allowed up to a distance of 500 feet from the main entrance of such use. 4. The construction of parking structures is recommended. 5. Multiple standards are recommended for parking stalls to accomodate compact as well as full -size automobiles. tD. Transportation 1 C c. Hydraulic Avenue between LaSalle Avenue and Madison Street; d. Ginz Avenue between Colfax Avenue and Washington Street right -of -way extended. 3. Colfax Bridge and street between St. Joseph Street and Hill Street shall be improved per State vighway Department plans. 4. Transpo bus routes are encouraged to remain. It is recommended that bus shelters be placed in strategic locations. -8- 10/3/80 1. The arterial streets of Jefferson Blvd., ' Colfax Avenue, LaSalle Street and Hill Street will remain. ' 2. Portions of existing streets will be closed to through traffic to encourage a residential environment and allow for additional parking. (Map II) The portions to be closed are: a. Niles Avenue between Jefferson Blvd., and Washington Street; b. Niles Avenue between Madison Street and Cedar Street with the rerouting of Niles to Cedar Street; 1 C c. Hydraulic Avenue between LaSalle Avenue and Madison Street; d. Ginz Avenue between Colfax Avenue and Washington Street right -of -way extended. 3. Colfax Bridge and street between St. Joseph Street and Hill Street shall be improved per State vighway Department plans. 4. Transpo bus routes are encouraged to remain. It is recommended that bus shelters be placed in strategic locations. -8- 10/3/80 E. Public Improvements 1. In addition to the construction of the East Race the following public improvements are recommended: a. The closed portion of Niles Avenue between Jefferson Boulevard and Washington Street is to be widened to 52 feet to facilitate the construction of a 450 parking area; b. Construction of a continuous pedestrian pathway along the East Bank of the St. Joseph River on an easement that is to be dedicated to the City. -9- 10/3/80 ' IV. East Bank Design Review Committee ' In order to achieve a high level of design and insure a feeling of continuity throughout the development area-, an East Bank Design Review Committee is hereby established. The following paragraphs explain the makeup and duties of that committee. �I JI E. Design Guidelines The Redevelopment Commission, shall by Resolution, adopt a set of Design Guidelines for use by developers as they are planning their project. The East Bank Design Review Committee will base their recommendation to the Redevelopment Commission on how well the proposals have followed these guidelines. -10- 10/3/80 A. Establishment of Committee ' An East Bank Design Review Committee of five members shall be established consisting of the Executive Director of the Department of Redevel- ' opment who shall serve as Chairman of the Committee, the City Engineer, the Director of the St. Joseph County Area Plan Commission, the City Building Commissioner and one member appointed by the Redevelopment Commission. B. Terms: Members of such committee shall serve ' w— out pay for the duration of this Develop- ment Plan. Vacancies occurring through death, resignation or other causes, shall be filled ' for the unexpired term in the same manner as original appointments. ' C. Rules: The Committee shall adopt such rules and procedures as are necessary to conduct its business. Among other things, such rules may provide for the dates and times of meetings and ' hearings. ' D. Powers and Duties: The Committee shall function in an advisory capacity to the Redevelopment Commission. It shall review the proposals of the developers from the point of view of ' architecture, site planning, open space and other applicable considerations, and for compliance with the standards set forth in the East Bank Design Guidelines. In exercising these duties the Committee shall follow the procedures and act within the limitations established in ' subsequent sections. �I JI E. Design Guidelines The Redevelopment Commission, shall by Resolution, adopt a set of Design Guidelines for use by developers as they are planning their project. The East Bank Design Review Committee will base their recommendation to the Redevelopment Commission on how well the proposals have followed these guidelines. -10- 10/3/80 1 u I'll The Design Guidelines may be reviewed and revised as necessary by Redevelopment Commission action. F. Building Permits: No permit shall be issued by tie South Bend Building Department for the construction of any building in the project area or the reconstruction alteration, or rehabilitation of any building in the area unless the application for such permit shall bear an endorsement by the Committee that such proposed construction is appropriate and conforms to the standards set forth in the East Bank Design Guidelines. G. Review: All development plans filed hereunder sEa11 be accompanied by preliminary and final architectural plans and /or engineering drawings and specifications for the work involved. Such plans shall be reviewed for compliance with the standards and objectives of the Development Plan and Design Guidelines. Within thirty days from and after the date on which a development plan is filed with the Committee, Saturdays, Sundays and legal holidays excluded, the Design Review Committee shall submit its recommendations in writing to the Redevelopment Commission, stating in the case of a disapproval, the reasons therefor, and a copy of such recommendation shall be given to the applicant(s), the Building Department and the Executive Director of the St. Joseph County Area Plan Commission. In addition, the Committee shall indicate what modifications in plans or specifications are necessary to accomplish r:::,pliance. H. Amendments to Disapproved Plan: Within not more than t rty days after a disapproval, the applicants filing a development plan which has been disapproved, may file with the Com- mittee an amendment to such plan or an amended plan which shall be limited exclusively to changes made necessary to accomplish compliance with the grounds for disapproval stated by the Committee. An amendment or amended plan shall be approved or disapproved within not more than thirty days after filing thereof. -11- 10/3/80 L u 1 I. Prevention of Speculation: Purchase contracts will provide that the redeveloper agree that his purchase of the property is for the purpose of redevelopment and not for land speculation. Prior to the com- pletion of his redevelopment project, the redeveloper may not sell, lease, or otherwise transfer such land (or improvements) without the prior written consent of the City of South Bend, Department of Redevelopment. J. Adeguacy of Zoning and Other Codes and Regulations to Protect Project Area. As explained above, the new land uses in the project area will be subject to the established provisions of the South Bend Zoning Ordinance. All such uses will also be subject to the requirements of the Building Code and similar regulations. These codes and regulations in conjunction with the land use provisions, building requirements and restrictions as well as the design and development objectives established by the Plan will adequately protect the Development Area. K. Signs All proposals for signs within the Development Area shall be reviewed by the Committee and evaluated as to their keeping with the standards established in the Design Guidelines. -12- 10/3/80 I 0 C V. Project Proposals A. Land Acquisition The Land Acquisition Plan Map (attached)and Tab- ulation Sheets(pages 15 through 20) indicate real property to be acquired for redevelopment. The Tabulation Sheets also set forth parcel ownership and square footage for such land. Upon the acquisition of such properties, the City of South Bend Department of Redevelopment will either: 1. Demolish the structure or structures thereon and dispose of the land for redevelopment at its fair market value, excepting those cases when land is sold or !eased to another public body pursuant to Indiana Code 18- 7 -7 -20, for uses in accordance with the Development Plan; or 2. Sell or lease the property to purchaser or lessee at its fair market value, excepting those cases when property is sold or leased to another public body pursuant to Indiana Code 18- 7 -7 -20, for uses in accordance with the Development Plan subject to its being rehabilitated in conformance with the East Bank Design Guidelines. B. Property Rehabilitation All properties in the East Bank Development Area shall comply with the standards set forth in all applicable statutes, codes and ordinances, as amended from time to time, relating to the use, maintenance, facilities, and occupancy of existing property, including but not limited to, the Building, Plumbing, Heating, Electrical and Housing Codes. Redevelopers' Obligations The land acquired by the City of South Bend Depart- , ment of Redevelopment will be disposed of subject to an Agreement between the Department and the Redeveloper. The Redeveloper will be required by the contractual agreement to observe the Land Use and Building Requirements and Objectives of this Development Plan. They will further be required to submit a redevelop- ment schedule satisfactory to the City of South Bend Department of Redevelopment. The Redeveloper will not be permitted to defer the start of construction for a period longer than that required for the preparation of necessary redevelopment plans, their review, and approval by the City of South Bend Department of Redevelopment. ' 1. In addition, the following provisions will be included in the Agreement. ' a. That the Redeveloper will submit to the Department a plan and schedule for the proposed development. ' b. That the purchase of the land is for the purpose of redevelopment and not for specu- ' lation. c. That the land will be built upon and improved in conformity with the objectives and provisions of the Development Plan. d. That the building of improvements will be commenced and completed within a reasonable ' time. ' e.
